非法行医罪的司法现状与治理完善——某省近五年105例司法案例的实证分析

从中国裁判文书网上检索自2017年1月5日至2021年12月24日近五年间发生在湖北的全部105例非法行医罪案例的一审判决书，以此为数据依据，并通过查找相关文献进行综合研究。发现近年来非法行医罪多发生于“黑诊所”内，主体为未取得医生执业资格的人，发生患者身体健康受到严重损害甚至死亡的结果。结合理论争议与司法实践，从相关司法判决和统计数据出发，围绕“情节严重”“执业资格”“非法行医行为”等焦点问题进行深入分析，指出非法行医罪治理的困境，在此基础上为治理非法行医罪提供有益建议和对策。

Judicial Status and Governance Improvement of the Crime of Illegal Medical Practice: Empirical Analysis of 105 Judicial Cases in a Province over the Last Five Years

This study retrieves all 105 first-instance judgments of illegal medical practice crimes that occurred in Hubei from January 5, 2017, to December 24, 2021, from the China Judgments Online Database. Using this data as a basis and conducting a comprehensive study through relevant literature, the research finds that in recent years, illegal medical practice crimes have mainly occurred in illegal clinics, with the perpetrators being individuals without a valid medical practice qualification. The outcomes of these crimes often result in severe harm or even death to the health of the patients. Combining theoretical controversies with judicial practices, the study conducts in-depth analysis around key issues such as "serious circumstances", "medical practice qualifications", and "illegal medical practices". It points out the challenges in governing the crime of illegal medical practice and provides valuable suggestions and strategies for addressing these challenges.
