| 摘 要： | 介绍了艾滋病毒感染者和病人违法犯罪现象的现实、危害及暴露出的法律空缺，并建议：对《刑法》作相应修正，增设故意传播艾滋病毒罪；修改《监狱法》、《罪犯保外就医病残范围》等法律法规，为建立专门的羁押场所提供法律保障；建立艾滋病职业暴露保障机制，维护执法人员和医护人员合法权益。

| Abstract: | On the basis of introducing the current situation,harm and legal defect of violating the law by HIV/AIDS patients,it suggests amending the criminal law,supplementing accusation of transmitting HIV on purpose first;then modifying the laws and rules such as jail act,the scope of illnesses and deformity for offenders bailed out for medical treatment,etc.,for the sake of providing the legal safeguard to set up a special place to detain the HIV offender;establishing the mechanism to protect the policeman,doctor,... |
