Abstract: | The medical malpractice always arouses an important case law. Sentences published these last months illustrate. The courts try to establish a just balance between the interests of the professionals and those of the patient. The biggest rigour in the exemption and the organisation of the care is required from the doctor. He has, besides, to inform his patients about the side effects of products and has to assume the consequences of the hospital-borne infections contracted before the adoption of the law of December 30th, 2002. At the same time, the Court of cassation refuses to hold the doctor responsible for the patient's act or to make them bear the therapeutic alea. |
