我国资源物权立法的生态伦理考量

人际伦理观下的资源物权立法的理论与实践局限,导致了人与资源的紧张关系。资源物权立法应凸现生态伦理观的价值取向,并具体贯彻生态限制、可持续发展的资源利用、环境权限制以及强化资源物权的生态义务等原则。加强生态伦理观的价值取向在我国资源物权立法中的渗透力度,确立有关资源物权立法的一般生态原则,为防止生态伦理成为生态乌托邦,特别应将资源物权的生态义务类型化、内化。

The Environmental Ethics Consideration of Resources Real Right Legislation in Our Country

The limitation of theory and practice of resources real right legislation within the interpersonal ethics view has caused tension between the human and resources.The resources real right legislation should emphasize the value orientation of view about environmental ethics,and implement the principle of environmental limitation,the principle of resources use of sustainable development,the principle of the limitation of environment right as well as the principle of strengthening environmental responsibility of resources real right in real right legislation concretely.We should strengthen the permeation dynamics of the value orientation of the environmental ethics in our country resources real right legislation,and establish general environmental principles which are related to resources real right legislation,for preventing environmental ethics become the environmental Utopia,we should make environmental responsibility of the resources real right type and internalize specially.
