建设性后现代主义视域中的法律逻辑

随着以怀特海的过程思想、有机哲学为基础的建设性后现代主义思想对诸多学术领域的深度影响,在这种视域中研究法律逻辑似乎也具有了可能性。随着非形式逻辑、论证理论、法律方法以及司法实践等相关研究的发展,这种研究也具有了必要性。在建设性后现代主义视域中,法律逻辑应当是开放的、具体的、非中立和不确定的,这显然与现代性视域中的法律逻辑不完全一致。然而,前者并非对后者的逆反、对抗或颠覆,恰恰相反,前者的理论旨趣在于对后者的包容、摄入与超越。如果说后者追求的价值目标是真和善（正义）,那么,前者则在此基础上追求美与和谐。这种观点并非仅仅是人为的预制,更有其内在发展的逻辑。

Legal Logics in the View of Constructive Postmodernism

Within the deep influence of Constructive Postmodernism on many fields,based on Whitehead＇s process thought or organic philosophy,it seems that it is possible to study legal logics in this view.Within the developing of studies on informal logics, argumentation theory,legal methods and judicial practice,it seems that it is necessary to study legal logics.In this view,legal logics should be open,individual,unneutral and undecided,which is different obviously from the legal logics in the view of modernism. The former is not adversary or against the latter,but including,prehension and beyond the latter.If the latter is pursuing the goal of value as real and good（right）,then the former is pursing the goal of value as beauty and harmony on the basement of the latter.In fact,this idea is not only from artificial proposition,but also according to its developing nature.
