This paper examines the functions of narrative within legal argumentation. My purposes are these: 1) to repudiate common assumptions that differentiate argumentation and storytelling in the law; 2) to begin to theorize anew how legal argumentation functions; 3) to explore the difficulties of evaluating the law's argumentative narratives; and 4) to trace some of the anxiety that judges themselves reveal about their roles as storytellers. I conclude that narrative is necessary to law's claims to authority, even as it complicates our understandings about how legislative policy decisions produce effects, and even as judges themselves seek to mask its importance.  相似文献

When two masked, to-be-attended targets are presented within approximately 500 msec of each other, accurate report of the second target (T2) suffers more than when targets are presented farther apart in time--an attentional blink (AB). In the present study, the AB was found to be larger when taboo words were presented as a first target (T1), as compared with the AB found when emotionally neutral, negative, or positive words were presented as T1, suggesting that taboo words received preferential attentional processing. Comparable results were also obtained when taboo words were presented as to-be-ignored distractors in single-target rapid serial visual presentation (RSVP). Arousal, but not valence, ratings of the emotional words predicted accuracy on subsequent targets in both dual- and single-task RSVP. Recognition memory for taboo words accounted fully for the negative relationships between arousal ratings and accuracy on subsequent targets, suggesting that arousal-triggered changes in attentional allocation influenced encoding of taboo words at the time they were encountered.  相似文献

A study was conducted to determine the effects of vocal cues on judgements of dominance in an interpersonal influence context. Physical measures of human vocal cues and participant ratings of dominance were obtained from videotapes of actors delivering short influence messages. After controlling for linguistic and visual content of messages, results indicated that mean amplitude and amplitude standard deviation were positively associated with dominance judgments, whereas speech rate was negatively associated with dominance judgments. An unexpected interaction revealed that mean fundamental frequency (F0) was positively associated with dominance judgments for male speakers but not significantly associated with dominance judgments for female speakers. F0 standard deviation was not significantly associated with dominance judgments. Results support the conclusion that dominance judgments are inferred from multiple sources of information and that some vocal markers of dominance are more influential than others.  相似文献

This study aimed to investigate whether a range of tasks that have been generally classed as requiring insight form an empirically separable group of tasks distinct from tasks generally classed as non-insight. In this study, 24 insight tasks, 10 non-insight tasks, and tests of individual differences in cognitive abilities and working memory were administered to 60 participants. Cluster analysis of the problem-solving tasks indicated that the presumed insight problems did tend to cluster with other presumed insight problems, and similarly the presumed non-insight problems tended to cluster with other presumed non-insight tasks. Performance on presumed insight problems was particularly linked to measures of ideational flexibility with a different pattern of results for the non-insight tasks. Spatial insight problems were linked to spatial flexibility and verbal insight tasks were linked to vocabulary scores. The results are discussed in relation to recent developments of dual process theories of thinking.  相似文献

Being born at extremely low birth weight (ELBW; ≤1,000 g) is associated with enduring visual impairments. We tested for long‐term, higher order visual processing problems in the oldest known prospectively followed cohort of ELBW survivors. Configural processing (spacing among features of an object) was examined in 62 adults born at ELBW (Mage = 31.9 years) and 82 adults born at normal birth weight (NBW; ≥2,500 g: Mage = 32.5 years). Pairs of human faces, monkey faces, or houses were presented in a delayed match‐to‐sample task, where non‐matching stimuli differed only in the spacing of their features. Discrimination accuracy for each stimulus type was compared between birth weight groups, adjusting for neurosensory impairment, visual acuity, binocular fusion ability, IQ, and sex. Both groups were better able to discriminate human faces than monkey faces (p < .001). However, the ELBW group discriminated between human faces (p < .001), between monkey faces (p < .001), and to some degree, between houses (p < .06), more poorly than NBW control participants, suggesting a general deficit in perceptual processing. Human face discrimination was related to performance IQ (PIQ) across groups, but especially among ELBW survivors. Coding (a PIQ subtest) also predicted human face discrimination in ELBW survivors, consistent with previously reported links between visuo‐perceptive difficulties and regional slowing of cortical activity in individuals born preterm. Correlations with Coding suggested ELBW survivors may have used a feature‐matching approach to processing human faces. Future studies could examine brain‐based anatomical and functional evidence for altered face processing, as well as the social and memory consequences of face‐processing deficits in ELBW survivors.  相似文献

When viewing ambiguous figures like the classic duck/rabbit, people alternately perceive one interpretation and then the other, but not both interpretations at once. When two identical ambiguous figures appear together, the majority of observers perceive them as identical, and they typically alternate in unison. Just as most observers cannot see a single figure as both a duck and a rabbit, most cannot see one figure in a pair as a duck and the other as a rabbit even though the two figures and their features are spatially distinct. Is this inability to see both interpretations an inherent limitation of the visual system or is it just due to differences in top-down processing? We show that a simple prompt immediately allows people to see both interpretations, to their own surprise.  相似文献

At near-threshold levels of stimulation, identical stimulus parameters can result in very different phenomenal experiences. Can we manipulate which stimuli reach consciousness? Here we show that consciousness of otherwise masked stimuli can be experimentally induced by sensory entrainment. We preceded a backward-masked stimulus with a series of rapid visual events presented at 12 Hz for 800 ms. Peaks in visual sensitivity (d′) were observed when the target appeared at the time that the next entraining stimuli would have occurred. Observers’ sensitivity for identical masked near-threshold stimuli increased by factors as large as 55%, but only at this precise moment in time. These data thus reveal that awareness of near-threshold stimuli can be manipulated by entrainment to rhythmic events, supporting the functional role of induced oscillations in underlying cortical excitability, and suggest a plausible mechanism of temporal attention.  相似文献

Many Evangelical Christians are avid fans of the Left Behind series despite the shocking amounts of violence and death the novels contain. This enthusiastic support is puzzling, given that Evangelicals frequently criticize the mainstream entertainment media for the displays of violence in movies, television programs, and video games. In this article, I attempt to explain why the fictional violence of the Left Behind series entertains Evangelical audiences, while the fictional violence of the mainstream media repulses them. I examine Evangelical tastes in entertainment in light of the general increase in displays of violence in the American entertainment industry over the last two centuries. I argue that Evangelicals are as entertained by displays of violence as mainstream audiences are, as long as the violence is in line with key Evangelical values.  相似文献
