Me and mine     
In this paper we articulate and diagnose a previously unrecognized problem for theories of entitlement, what we call the Claims Conundrum. It applies to all entitlements that are originally generated by some claim-generating action, such as laboring, promising, or contract-signing. The Conundrum is spurred by the very plausible thought that a later claim to the object to which one is entitled is a function of whether that original claim-generating action is attributable to one. This is further assumed to depend on one’s being identical to the person who performed the claim-generating action. But the right theory of personal identity for grounding these later claims proves quite elusive. In demonstrating both the Claims Conundrum and diagnosing its source, we begin with its (previously unobserved) instantiation in John Locke’s theories of personal identity and initial acquisition, and then we gradually expand its net to include both Lockean and non-Lockean theories of both, moving ultimately to show that this is a problem for most entitlements generally. We then diagnose the source of the trouble, showing that a basic assumption about the link between attributability and identity that most people take to be obvious is in fact false, clearing a path for future investigation into this overlooked but serious problem’s resolution.  相似文献

There is currently a stalemate over the correct approach to legal liability. To take a prominent example, it remains a point of contention whether land owners should be held liable for injuries to trespassers. Many of those who insist that land owners should be held liable for injuries to trespassers maintain this for purely economic or pragmatic reasons. In contrast, those on the other side frequently defend their view on the grounds that, in such trespass cases, owners are not morally responsible for the injuries. We maintain that the best way forward for all parties in this debate is to recognize the existence of “morally responsible liability”—of cases where owners qua owners are morally responsible for damages caused by their property. Once this is recognized, the debate can be framed in terms of whether there are economic or pragmatic reasons for legal liability to diverge from morally responsible liability. Unfortunately, there is no good account of morally responsible liability in the literature. Taking lessons from the failings of the few extant accounts, we draw on the work of A. M. Honoré and Jeremy Waldron to develop an account of our own. We argue that owners are morally responsible for damages caused by their property when and because their taking ownership of something leads to increased risk to others. We explain how and why such increases in risk come about, and how our account captures our intuitions concerning various cases, including those concerning injuries to trespassers.  相似文献

Few studies have examined objectification in the context of romantic relationships, even though strong theoretical arguments have often made this connection. This study addresses this gap in the literature by examining whether exposure to mass media is related to self-objectification and objectification of one's partner, which in turn is hypothesized to be related to relationship and sexual satisfaction. A sample of undergraduate students (91 women and 68 men) enrolled in a university on the west coast of the United States completed self-report measures of the following variables: self-objectification, objectification of one's romantic partner, relationship satisfaction, sexual satisfaction, and exposure to objectifying media. Men reported higher levels of partner objectification than did women; there was no gender difference in self-objectification. Self- and partner-objectification were positively correlated; this correlation was especially strong for men. In regression analyses, partner-objectification was predictive of lower levels of relationship satisfaction. Furthermore, a path model revealed that consuming objectifying media is related to lowered relationship satisfaction through the variable of partner-objectification. Finally, self- and partner-objectification were related to lower levels of sexual satisfaction among men. This study provides evidence for the negative effects of objectification in the context of romantic relationships among young adults.  相似文献

The multiple-realizability argument has been the mainstay ofanti-reductionist consensus in philosophy of mind for the past thirty years. Reductionist opposition to it has sometimes taken the form of the Disjunctive Move: If mental types are multiply-realizable, they are not coextensive with physical types; they might nevertheless be coextensive with disjunctionsof physical types, and those disjunctions could still underwrite psychophysical reduction. Among anti-reductionists, confidence is high that the Disjunctive Move fails; arguments to this effect, however, often leave something to be desired. College students were trained on problems similar to the water jar problems developed by Luchins (1942). Some students were instructed that a particular rule would solve all the problems, others had the same problems but were not instructed about the rule, and a third set of students had a series of novel problems in which no single rule operated throughout. In two experiments students in the instructed rule group not only performed best in training but also performed best when transferred to a condition in which a single novel rule was appropriate. Although results from the set of conditions most similar to those of Luchins suggested that students sometimes inappropriately persisted in rule usage, the overall results suggest that rigidity is not a necessary outcome of instructed problem solving. Indeed, many of the results were consistent with the notion that instructed problem solving is flexible problem solving.  相似文献

Sales management control systems (SMCSs) are designed to align salespeople's activities and actions with organizational objectives. This article reviews and synthesizes over 50 SMCS articles published in sales, marketing, and management journals over the past 30 years. We begin by building a comprehensive framework that enables us to classify prior research into digestible categories (e.g., SMCSs as antecedents, SMCSs as consequences). Next, we present an analysis of gaps in the literature. Among other findings, our analysis reveals that there is an overwhelming focus on the use of formal (specifically behavior- and outcome-based) controls as compared to their informal control counterparts. Finally, we suggest avenues for future research: (1) mapping and understanding the full spectrum of control mechanisms, (2) developing a fuller understanding of the often-overlooked forms of control (e.g., input and cultural controls), and (3) more thoroughly analyzing how controls operate (or do not operate) as an integrated system.  相似文献
