The Tennessee Supreme Court's decision in Davis v. Davis, a case that raises the question of how to allocate frozen embryos in the event of divorce, addresses many of the legal issues posed by in vitro fertilization. The decision considers the interests of the progenitors as well as of the children who may result. For example, the court held that gamete providers' discretion regarding the disposition of embryos can be limited only when their decisions would harm the children who might be born. The court also made clear that efforts to seek genetic parenthood are protected only when accompanied by a desire to raise the resulting children, a conclusion that also affects other reproductive technologies. In addition to elaborating an analytic framework, the court set guidelines for resolving disputes when the couples had made no prior agreements, including holding that while the embryos are ex-utero the desire to avoid genetic parenthood almost always trumps the wish to become a parent. The well-reasoned analysis in Davis v. Davis should help shape legal and ethical discussion regarding the use of in vitro fertilization for many years to come. 相似文献

Abstract. Imre Lakatos's philosophy of science can provide helpful leads for theological methodology, but only when mediated by the disciplines that lie between the natural sciences and theology. The questions of relativism and truth are used as indices for comparing disciplines, and Lakatos's theory of natural science is taken as the starting point. Major modifications of Lakatos's work are demanded as one moves from the natural sciences, through economics, the interpretive social sciences, literary theory, and into theology. Although theology may consist of Lakatosian research programs, it also includes programs of interpretation and programs for living. A Hypermasculinity Inventory was developed to measure a macho personality constellation consisting of three components: (a) calloused sex attitudes toward women, (b) violence as manly, and (c) danger as exciting. The 30 forced-choice items were selected by a two-stage internal consistency item analysis. Issues of substantive and structural validity were addressed by considering item content, test format, homogeneity of items, and the factor structure of items. The Cronbach α coefficient for the Hypermasculinity Inventory was .89 in the present sample of 135 college men. External validity was assessed by correlating scores of the Hypermasculinity Inventory with self-reported drug use, r(135) = .26, p < .01, aggressive behavior r(135) = .65, p < .001, and dangerous driving, r(136) = .47, p < .001, following alcohol consumption, and delinquent behavior during the high school years, r(135) = .38, p < .01. Construct validity was supported further by a pattern of theoretically meaningful correlations with the Personality Research Form (D. N. Jackson, 1974, Goshen, NY: Research Psychologists Press). Abstract. The present article continues an earlier critique of Robbins's and Rorty's neopragmatism. Their skepticism about the traditional concept of correspondence and about the criteria for truth are both unjustified, and their own assertion of meaning as usefulness either presupposes a prior notion of linguistic reference or fails to qualify as a sufficient criterion for knowledge. The difficulties with neopragmatism have implications for two other areas of the religion/science discussion, postmodernism and empirical Theology. Postmodernism shares neopragmatism's mistakes regarding the philosophy of language and can be rejected without endangering one's empiricism, humanism, or naturalism. By contrast, the strengths of empirical Theology, and of religious empiricism in general, can be preserved without Robbins's proposed ban on metaphysics. 相似文献

The importance of consulting with other professionals to maintain acceptable standards of care is well documented in many health care professions. However, evidence indicates that many psychologists fail to utilize consultation when needed, and that consultation use varies along dimensions such as the education and training of the consultee, the type of setting, number of years in practice, and proximity to available consultants. In this article, we review the research on the use of consultation by psychologists as well as other health care professionals. We discuss the clinical, ethical, and legal implications of seeking consultation as a professional psychologist. A pair of experiments were conducted using a simulated courtroom trial of a criminal case. In Experiment I subject-jurors were asked by defense counsel either to imagine themselves as the defendant (empathy-inducing appeal) or to pay close attention to evidence (nonempathy appeal). Later the judge delivered only general instructions or, in addition, charged jurors to give consideration only to the facts presented. When there was no Fact-focused judge's charge, juror-subjects who heard the empathy-inducing appeal rated the defendant's actions as more lawful and attributed less of the cause for the incident to his personality than did their counterparts in the nonempathy condition. Experiment II included individual differences in the tendency to empathize as an additional mediating variable. The original pattern of effects found for the manipulated variables in Experiment I appeared again, but were overshadowed by the stronger effects of the individual difference variable and of subject sex. Subject-jurors who scored high on the empathy individual difference measure rated the defendant less guilty, assigned less cause to him, and showed corresponding mood shifts when they heard the empathy-inducing appeal.
