I review the recent case of Edna Folz, a 73 year-old woman who was suffering through the end stages of very advanced Alzheimer's dementia when her case was adjudicated by the Wisconsin Supreme Court. I consider this case as an example of how courts are increasingly misinterpreting the ethical and legal decision-making standards known as substituted judgment and best interests and thereby threatening individuals' treatment decision-making rights as developed by other courts over the past two decades and creating serious roadblocks to health-care providers' ability to render appropriate patient care. The Wisconsin Supreme Court held that Edna's legal guardian could not authorize withdrawal of Edna's treatment, ruling that as a matter of law, if an incompetent person is not in a persistent vegetative state, it is not in his or her best interests for life-sustaining treatment to be withdrawn unless (s)he has executed an advance directive or other statement clearly indicating his or her desires. 相似文献

The aim of the present paper is to describe three different attempts, which have been made by philosophers, to define what quality of life is; and to spell out some of the difficulties that faces each definition. One, Perfectionism, focuses on the capacities that human beings possess: capacities for friendship, knowledge and creative activity, for instance. It says that the good life consists in the development and use of these capacities. Another account, the Preference Theory, urges that satisfying one's preferences, or desires, is what improves one's quality of life. And a third account, Hedonism, sees life-quality as consisting in the enjoyment of pleasure and the avoidance of pain. The paper describes and evaluates objections to each of these views, thereby displaying their weaknesses and strengths. Since no view comes out as the right one there is a choice to be made. At the end of the paper it is being discussed how well each of the views cohere with different methodologies used in quality of life research. Also it is suggested that considerations about what the research is to be used for are relevant. 相似文献

该研究旨在对老年人合法权益受侵此类特殊生活事件的应对意向(CI)和情境性应对(SC)进行比较分析,多元因素分析结果鉴别出应对意向的五种方式及其三种基本类型,以及六种情境性应对方式和四种应对类型。研究也发现今老年人采用不同方式的CI和SC的旨弱程度存在的异同点。同时,多元回归分析结果表明,年龄、文化程度、经济状况和法规了解程度是影响CI和SC的显著因素,此外健康状况和性别也分别对CI和SC产生影响。 相似文献

James Gilbert has provided fascinating and valuable historical sketches of the interactions of science and religion in American culture in this century, especially those taking place between 1945 and 1962. Yet, taken together, it is unclear what conclusion is to be drawn from these interactions. Ian Barbour has distinguished eight theologies of God's role in nature, together with corresponding models of divine activity. This essay examines these ideas in the light of a theology of the cross. Three of Barbour's approaches—the neo-Thomist, the kenotic, and the existentialist—are able to provide different aspects of a theology of divine action that is consistent with belief that God's definitive revelation takes place in the Crucifixion and Resurrection of Jesus of Nazareth. These approaches encourage attention to a part of traditional doctrines of Providence, the idea that God acts by "cooperation" with natural processes. The kenotic character of divine involvement in the world means that the regularities of the basic interactions of physics are maintained. The idea of cooperation can be extrapolated into the past, to give some insight into ways of understanding God's activity in originating the universe. 相似文献

The paper justifies the concept of “thematic structure” or “order of knowledge” over the traditional “classification of sciences”
due to the uncertainty of many classification criteria. The thematic structure of science has, of course, various levels and
various dimensions. Arguments against any forms of separating the humanities from sciences in the traditional sense of the
term are presented and discussed. Equally unacceptable are attempts at sharp separation of technical disciplines and humanities.
The thematic structure of humanities is not created by some material aspects but rather through the interest — or problem-oriented
aspects. In addition to the natural sciences and the humanities there exists an important sphere of sciences on artefacts
or, using the term by H. Simon, the sciences of the artificial. For the contemporary research activities is typical what could
be denoted as “interdisciplinary or multidisciplinary complex.” The paper traces a set of epistemological criteria for the
justification of the relative independence of a scientific discipline.

Chaos theory is beginning to find applications in the field of medicine. The theory of chaos should be introduced to students to help them as they make the transition from learning the scientific literature to actually applying this newly acquired knowledge in clinical situations. Chaos theory will give the students a powerful conceptual framework from which they can better understand the limits of predictability in clinical situations.
