Counter-terrorism officials in the USA and the UK responded to the events of 11 September 2001 and 7 July 2005 with an increasing resort to the use of ‘intelligence-led policing’ methods such as racial and religious profiling. Reliance on intelligence, to the effect that most people who commit a certain crime have a certain ethnicity, can lead to less favourable treatment of an individual with that ethnicity because of his membership in that group, not because of any act he is suspected or known to have committed. This paper explains the context in which intelligence-led policing flourishes, and how this discussion contributes to the profiling debate in both the USA and the UK, and then sets out two key contentions. First, we argue that Article 14 ECHR as applied under the UK Human Rights Act has a more protective, and less ‘prosecutorial’, conception of discrimination than has the US Equal Protection Clause, meaning that judges need not find a discriminatory motive to find that discrimination has occurred. Second, we contend that Article 14 provides the judiciary with the key tool of proportionality, which, when properly applied, makes it harder for discrimination to stand up to scrutiny. 相似文献

This essay critically examines economist and philosopher Amartya Sen's writings as a potential resource in religious ethicists' efforts to analyze discrimination against girls and women and to address their well-being and agency. Delineating how Sen's discussions of missing women and gender and cooperative conflict fit within his capability approach to economic and human development, the article explores how Sen's methodology employs empirical analysis toward normative ends. After nearly a century's study, what do psychologists now know about intergroup bias and conflict? Most people reveal unconscious, subtle biases, which are relatively automatic, cool, indirect, ambiguous, and ambivalent. Subtle biases underlie ordinary discrimination: comfort with one's own in–group, plus exclusion and avoidance of out–groups. Such biases result from internal conflict between cultural ideals and cultural biases. A small minority of people, extremists, do harbor blatant biases that are more conscious, hot, direct, and unambiguous. Blatant biases underlie aggression, including hate crimes. Such biases result from perceived intergroup conflict over economics and values, in a world perceived to be hierarchical and dangerous. AbstractThe present study tested a model in which the perceived incompatibility of ethnic Russian and regional North Caucasian identities mediates the relationship between perceived discrimination and acculturation strategies in two generations of ethnic Russian minority members living in the Kabardino-Balkar Republic, North Caucasus, Russian Federation. Two identities might be perceived incompatible when they represent conflicting sets of norms and values and the two communities may place competing demands on individual commitment and loyalty. We sampled 105 dyads from ethnic Russian families (youth: M = 18 years, SD = 2.35, 48.6% female; parents: M = 43 years, SD = 6.97, 68.6% female). The questionnaire included measures of perceived discrimination, perceived identity incompatibility, and acculturation strategies. The results of multigroup path analysis showed that the perceived identity incompatibility mediated the relationship between perceived discrimination and two strategies, aimed at culture maintenance (integration and separation) in both generations. Identity incompatibility is regarded as a psychological mechanism that explains the impact of perceived discrimination on minority acculturation preferences in a multicultural region. 相似文献

ABSTRACT— A widespread form of bias has slipped under our cultural and academic radar. People who are single are targets of singlism : negative stereotypes and discrimination. Compared to married or coupled people, who are often described in very positive terms, singles are assumed to be immature, maladjusted, and self-centered. Although the perceived differences between people who have and have not married are large, the actual differences are not. This study examines the explanations and justifications offered by those engaged in selecting housemates. The rationale for the research follows the recent housing demographic, whereby shared living has become increasingly popular among young adults in Western countries. This study sought to address the surprising lacuna in the extant research through the application of discursive psychology to understanding prejudice and discrimination within the context of contemporary social and political sanctions against openly discussing prejudice. Data were drawn from interviews with young New Zealanders aged from early twenties to early thirties who were experienced with house sharing. Detailed results are presented involving discrimination based on age, gender, and ethnicity. The study found that rigid narrow preferences were stated with respect to age, gender was less important, and ethnicity was talked about cautiously, especially if there was the possibility of significant cultural differences or language barriers. 相似文献

In an arbitrary matching-to-sample procedure, two mentally retarded subjects learned conditional discriminations with two sets of stimuli. Each set included a spoken name (N1 or N2), an object (O1 or O2), and a printed symbol (S1 or S2). One subject selected conditionally (a) O1 upon N1, and O2 upon N2, and (b) S1 upon O1, and S2 upon O2. The other subject selected conditionally (a) S1 upon N1, and S2 upon N2, and (b) O1 upon S1, and O2 upon S2. For both subjects, selections of O1 and S1 produced one type of food, F1; selections of O2 and S2 produced a different type of food, F2. Both subjects also learned identity-matching performances, selecting O1, O2, S1, S2, F1, and F2 conditionally upon those stimuli as samples; F1 followed selections of O1, S1, and F1; F2 followed selections of O2, S2, and F2. Matching performances consistent with stimulus class formation involving the names, objects, symbols, and foods were demonstrated on probe trials, even though these performances had not been taught explicitly. Next, new objects, X1 and X2, were presented on identity-matching trials, producing F1 and F2, respectively. Without further training, X1 was selected conditionally upon N1, S1, and O1, and X2 was selected upon N2, S2, and O2. When the contingencies were changed so that selections of X1 and X2 were now followed by F2 and F1, respectively, X2 was selected conditionally upon N1, S1, and O1, and X1 was selected upon N2, S2, and O2. Class membership of X1 and X2 had apparently changed.
