Courts usually treat control over human bodies and body parts as a property issue and find that people do not have property
rights in themselves. This contradicts the liberal philosophical principle that people should be able to perform any self-regarding
actions that do not cause harm to others. The philosophical inconsistencies under pinning the legal treatment of body parts
arguably stem from a misplaced judicial preoccupation with‘property’. A better approach would be to hold a policy inquiry
into the degree of liberty a society wishes to grant its inhabitants. Only once this substantive issue has been addressed
should property be raised as a possible method of implementing the policy.

Honoring a living will typically involves treating an incompetent patient in accord with preferences she once had, but whose objects she can no longer understand. How do we respect her “precedent autonomy” by giving her what she used to want? There is a similar problem with “subsequent consent”: How can we justify interfering with someone's autonomy on the grounds that she will later consent to the interference, if she refuses now? Both problems arise on the assumption that, to respect someone's autonomy, any preferences we respect must be among that person's current preferences. I argue that this is not always true. Just as we can celebrate an event long after it happens, so can we respect someone's wishes long before or after she has that wish. In the contexts of precedent autonomy and subsequent consent, the wishes are often preferences about which of two other, conflicting preferences to satisfy. When someone has two conflicting preferences, and a third preference on how to resolve that conflict, to respect his autonomy we must respect that third preference. People with declining competence may have a resolution preference earlier, favoring the earlier conflicting preference (precedent autonomy), whereas those with rising competence may have it later, favoring the later conflicting preference (subsequent consent). To respect autonomy in such cases we must respect not a current, but a former or later preference. 相似文献

Adopting a dynamic within-person perspective on employee innovation, the present study investigates the role of situational job autonomy and momentary work engagement as day-level correlates of innovative behaviour. Anticipating individual differences in the strength of these intraindividual associations, we propose dispositional creative self-efficacy (CSE) to serve as a cross-level moderating influence amplifying the day-specific predictive power of autonomy and work engagement for innovative behaviour. Hierarchical linear modelling analyses of the nested data from 123 employees surveyed over 5 consecutive work days suggest that both autonomy and work engagement positively predict self-reported innovative behaviour on a daily basis. Whereas the engagement–innovation link emerges as homogenous across persons, results indicate that the daily within-person effect of autonomy on innovative behaviour varies significantly as a function of CSE such that it is greater for individuals who hold higher rather than lower CSE beliefs. Implications for future research, limitations, and practical implications are discussed. 相似文献

In this reflective study, I perceive the impact of my own written feedback on students’ academic writing skills in particular and on learning in general. Anchored on Schon’s reflection-on-action (ROA) framework, my reflection arose from a content analysis of my written feedback on 80 student drafts and 44 feedback responses. I found that my written feedback is of two types: focus on form and focus on meaning. Coding the feedback led to an identification of six feedback functions: instructive/using imperatives (18.36%); suggestive (15.31%); asking questions/probing (23.98%); stating a personal opinion (6.12%); corrective (29.59%); and affirming/negating (6.63%). The categorisation of feedback according to these functions was influenced by Wolsey’s feedback functions (2008) which was adapted by Alvarez, Espasa and Guasch. Results revealed that I employ corrective feedback, probing questions and instructive feedback more frequently than suggestive feedback, personal statement or affirmation/negation. I also found that my feedback on form (59%) is higher than my feedback on meaning (41%). I explain the relationship of these findings by identifying some confounding factors that enabled me to interrogate my assumptions, along with a discussion of their implications. 相似文献

Serene Khader and Rosa Terlazzo have each recently proposed theories of adaptive preferences (APs) which purport to both respect persons’ agency and provide an effective political tool. While Khader and Terlazzo thus share a similar goal, they take fundamentally different paths in its pursuit: Khader offers a perfectionist account of APs and Terlazzo an autonomy-based theory. In this paper, I argue first that if it is to adequately respect persons’ agency, a theory of APs should in some way include autonomy considerations. If it is to provide an effective political tool, however, our theory should not be entirely autonomy-based, but include a condition addressing a preference’s compatibility with basic flourishing. The suggestion is thus that it is worth considering the possibility of a ‘mixed,’ rather than exclusively perfectionist or exclusively autonomy-based, theory of APs. I outline two such theories. The first, I argue, does quite well with respect to the political efficacy aim of AP theorizing, but has difficulty satisfying the respect for agency aim. The reverse is true of the second. I conclude by suggesting that respect for agency should in this context take priority over political efficacy and that we therefore should accept the latter of the two theories outlined. 相似文献

We investigated the role of autonomy in counterfactual thinking in two experiments. Autonomy emphasises intrinsic motivation and reduced preoccupation with external outcomes. Experiment 1 demonstrated that autonomy influences both the number and content of counterfactual thoughts, particularly for individuals performing a task rather than reading about someone else performing a task. Experiment 2 investigated the performance improving effects of counterfactual thinking, while considering the role of autonomy. Individuals higher in autonomy were more likely to focus on undoing controllable aspects of their behaviour compared to individuals lower in autonomy. Controllable (versus uncontrollable) counterfactual thoughts were associated with greater performance improvement on a subsequent task. Self-regulatory traits such as autonomy may be important in the types of counterfactual thoughts that people generate. We discuss the mechanisms by which autonomy may exert an influence on counterfactual thinking and consider the implications of the findings for the functional theory of counterfactual thought. 相似文献
