The non-citizen is the new ‘other’. From popular discourse to political pronouncements and academic research, the non-citizen has become one of the subjects du jour. Among the ranks of the non-citizen, one finds a lesser-known category of people which has yet to be considered seriously by liberal political theory – the stateless. Thus far, liberal political theory has either ignored this category of persons or subsumed them under the subjects of immigration or refugeehood. The present article challenges this theoretical exclusion in two ways. First, it analyses the treatment of statelessness within the works of three prominent theorists on just membership – Michael Walzer, Seyla Benhabib and William Barbieri, Jr – and contends that these authors ignore the stateless as a unique category of non-citizen. Secondly, it explains why statelessness demands a distinct theoretical framework than is currently provided for within liberal political theory. The article contends that just membership questions necessitate not simply looking at who is let in and what naturalization procedures should be extended to them, but also entails examining who has always been on the inside and to whom we need to justify their continued exclusion.  相似文献

This article contributes to the understanding of the role of religion in the public and political controversies about homosexuality in Africa. As a case study it investigates the heated public debate in Zambia following a February 2012 visit by United Nations Secretary General Ban Ki-moon, who emphasised the need for the country to recognise the human rights of homosexuals. The focus is on a particular Christian discourse in this debate, in which the international pressure to recognise gay rights is considered a sign of the end times, and Ban Ki-moon, the UN and other international organisations are associated with the Antichrist and the Devil. Here, the debate about homosexuality becomes eschatologically enchanted through millennialist thought. Building on discussions about public religion and religion and politics in Africa, this article avoids popular explanations in terms of fundamentalist religion and African homophobia, but rather highlights the political significance of this discourse in a postcolonial African context.  相似文献

In contemporary moral and political philosophy, there are two leading approaches to the justification of rights. These could be broadly identified as deontological theories and consequential theories. These two schools of theories each have their own strengths and weakness, while there is also a third contractual approach that is under represented. Because Rawls' and Scanlon's well-known contractual theories are designed for purposes other than the justification of rights, the purpose of this paper is to establish a principle of rights on the basis of Rawls' justification device of the "original position." First, it supplies a criterion based on human conduct or action. Second, based on this account of human conduct, different types of relationships are constructed and presented to the parties in the "original position." Third, it will show that the parties in the "original position" would choose one of these relationships as the principle of rights. Finally, Rawls' first principle of justice will be reformulated. The procedure of choosing a principle of rights in this paper could also be viewed as a demonstration that, when properly situated and motivated, human beings exhibit their potential as rational beings.  相似文献

Caregiving practices in Tanzania are potentially affected by socio‐demographic change such as urbanization and globalization. The aim of this study is to explore adult caregivers' discourses regarding the responsibility of caregiving, related to guidance and control of children in Tanzania. Data was collected in focus group discussions with parents and grandparents in an urban area of Tanzania. The analysis found two interpretative repertoires: guidance and control as a community matter and guidance and control as a family matter. These repertoires are related to responsibility and to an ideological dilemma regarding parental authority and individual's rights. The findings are discussed in relation to the tendency to polarize between ideologically traditional versus modern societies. This illustrates how lived ideology of caregiving responsibility is historically and socially situated, in the local context and how the spread of Children's Rights ideology needs to be understood in this context. Common-sense morality and legislations around the world ascribe normative relevance to biological connections between parents and children. Procreators who meet a modest standard of parental competence are believed to have a right to rear the children whom they brought into the world. I explore various attempts to justify this belief, and find most of these attempts lacking. I distinguish between two kinds of biological connection between parents and children: the genetic link and the gestational link. I argue that the second can better justify a right to rear.  相似文献

Opponents of male circumcision have increasingly used human rights positions to articulate their viewpoint. We characterize the meaning of the term “human rights.” We discuss these human rights arguments with special attention to the claims of rights to an open future and to bodily integrity. We offer a three-part test under which a parental decision might be considered an unacceptable violation of a child's right. The test considers the impact of the practice on society, the impact of the practice on the individual, and the likelihood of adverse impact. Infant circumcision is permissible under this test. We conclude that infant circumcision may be proscribed as violating local norms, even though it does not violate human rights.  相似文献

In the present research self-respect is defined as a person’s ability to see the self as someone who has the same basic rights and dignity as others. Self-respect fills a gap in previous theorizing on the self because unlike other self-concepts it can be linked to assertiveness and claim making. Self-respect was empirically distinguished from self-competence and self-confidence (Study 1) as well as from psychological entitlement, self-esteem and self-acceptance (Study 2). Self-respect predicted assertive responses above and beyond these other self-scales in two correlational studies (Studies 1 and 3) and one experiment (Study 2). As predicted, self-respect was not related to aggressive responses, but psychological entitlement was (Studies 2 and 3). Implications for future research are discussed.  相似文献

This article is an attempt to negotiate the spaces between a number of problematic positions concerning Hinduism and human rights through the close study of one particular text, the Rājadharmaparvan of the Mahābhārata. By examining safeguards and provisions for subjects articulated in the text’s discourse of kingly duty, it engages with some of the arguments forwarded in the theoretical literature on human rights. Here it interrogates, in particular, the idea that Hinduism is distinctively incompatible with these norms in a way other historical or cultural traditions are not. The article concludes by asking whether it is possible to counter Eurocentric tendencies in global debates without furthering illiberal agendas within local ones. Discussing the appropriation of ‘Raj dharma,’ and the texts that deal with it, by the Hindu Right, it briefly outlines some recent moves in human rights theory that help facilitate the reclamation of a rich and plural textual heritage.  相似文献

ABSTRACT

Same-sex marriage has become a divisive issue in established western democracies. As in earlier research on abortion, there is now a growing body of studies which suggests that religious factors, such as identity, belief and practice, are the most frequent predictors of opposition towards gay marriage. Yet, what we know about the combined influence of these religious factors remains unexamined. Mindful of this omission, this study examines the relationship between regular church attendance and a belief in God on attitudes towards same-sex marriage and abortion rights. Using the recent survey data from Northern Ireland, the results suggest that not only are those who belong but do not believe distinctive in terms of their demographic makeup, but they are also significantly more likely to adopt a liberal stance in relation to both these issues – gay marriage and abortion rights – than the most religiously devout, or those who both belong and believe.  相似文献
