State actors arguing for the rights of undocumented children often attempt to strengthen children's deservingness by portraying their parents as bad parents who put their children at risk. Through ethnographic observations in Malmö, Sweden and Birmingham, UK, this article shows how such demonization of the parents by the state is not reflected in the everyday life experiences of undocumented families themselves. While the state views the parents as putting their children at risk by ‘hiding’ them, the parents view the state as putting their children at risk by trying to deport them. The article discusses how parents act as ‘humanitarian agents’ responsible for caring for the children when state support to the deserving, rights-bearing child is limited by the notion of the deportable migrant child. These parental practices of unrecognized emotional labour are analysed as motherwork. The interdependent character of family life in deportability is highlighted through how children take on parental responsibilities as well and how stress and knowledge about their irregular situation is shared across generations. To conclude, the article argues that if one neglects the intergenerational context of undocumented children's rights, one risks marginalising the human rights of both children as well as adults. 相似文献

This article argues for a new Christian theological rationale for human rights that takes into account serious contemporary critiques of rights language. Human rights derive from our being made in the image of God. But rather than being static metaphysical properties which humanity possesses, they form a moral language about the image of God, which must be constantly refashioned to suit the times. Furthermore, the human community to which these rights belong is not mere created humanity, but instead the humanity of the eschatological kingdom of heaven, of which the ecumenical church is the messenger. The ecumenical task, then, is to articulate a more holistic conception of what the image of God means to ensure that human rights language does not become narrowly sectarian. 相似文献

What is the relationship between human rights and the rights of states? Roughly, while cosmopolitans insist that international morality must regard as basic the interests of individuals, statists maintain that the state is of fundamental moral significance. This article defends a relational version of statism. Human rights are ultimately grounded in a relational norm of reciprocal independence and set limits to the exercise of public authority, but, contra the cosmopolitan, the state is of fundamental moral significance. A relational account promises to justify a limited conception of state sovereignty while avoiding the familiar cosmopolitan criticisms of statist accounts. 相似文献

In a modern and secularized world, churches and religious groups that fight in the public sphere for social justice justify these actions in the name of defending human rights. This has been the path taken to express in non‐religious language what they understand to be a God‐given mission. Based on the distinction between civil rights, political rights, and social rights, which make up the set of human rights, this article analyzes the relationship between the notion of religious mission and the struggle for human rights; how neoliberal ideology, in an anti‐humanist perspective, criticizes the notion of social rights and social justice with the denial of any human right above the laws of the market; and the challenges that this neoliberal ideology poses for the justification of the social and political action of religious groups and institutions in the contemporary globalized world with a growing post/anti‐humanist culture. 相似文献

This essay aims to review mainstream literature and research perspectives on the sociology of human rights with the further focus on relationship between human rights and religion. We consider the challenges of late engagement of sociology with human rights and current narratives of the relationship of human rights and religion that encompass normativity as the central category of historically oriented sociology. We discuss the contribution of two empirical research mainstreams on human rights and religion and focus on a new field of study—sociology of religious freedom. A detailed new agenda for sociological research on human rights and religion is explored in the final part of our assessment. 相似文献

Rights, autonomy, privacy, and confidentialityare concepts commonly used in discussionsconcerning genetic information. When theseconcepts are thought of as denoting absolutenorms and values which cannot be overriden byother considerations, conflicts among themnaturally occur. In this paper, these and related notions areexamined in terms of the duties and obligationsmedical professionals and their clients canhave regarding genetic knowledge. It issuggested that while the prevailing idea ofautonomy is unhelpful in the analysis of theseduties, and the ensuing rights, an alternativereading of personal self-determination canprovide a firmer basis for ethical guidelinesand policies in this field. 相似文献

Following several political-psychological approaches, the present research analyzed whether orientations toward human rights are a function of right-wing authoritarianism (RWA), social dominance orientation (SDO), basic human values in the sense of Schwartz (1992 ), and political ideology. Three dimensions of human rights attitudes (endorsement, restriction, and enforcement) were differentiated from human rights knowledge and behavior. In a time-lagged Internet survey ( N = 479), using structural equation modeling, RWA, universalism and power values, and political ideology (measured at Time 1) differentially predicted dimensions of human rights attitudes (measured at Time 2 five months later). RWA and universalism values also predicted self-reported human rights behavior, with the effects mediated through human rights endorsement. Human rights knowledge also predicted behavior. The psychological roots of positive and negative orientations toward human rights, consequences for human rights education, and the particular role of military enforcement of human rights are discussed. 相似文献

Abstract: I argue here that Beth Singer's analysis of rights as operative social norms allows us to make sense of the personal and political complexities of the abortion debate. In particular, I argue that it is only by means of Singer's analysis that we, as feminists, can reconcile our conviction that Carol Gilligan's celebration of empathy and partiality gestures toward something definitive of our moral experience with the need to avail ourselves of the politically efficacious language of rights. 相似文献
