Why is Law a Normative Discipline? on Hans Kelsen’s ‘Normology’

What does it mean to claim of law that it is a normative discipline? Can the answer be so simple that one need merely refer to law’s normative object of study and the conclusions that the legal participant must allegedly draw from this? What, in any case, is a ‘normative discipline’? The essay attempts to address these questions by analysing Hans Kelsen’s ‘normological’ theory of law through his work on sovereignty and especially by focusing on the normative character of Kelsen’s epistemological claims regarding law. A theoretical critique of Kelsen is offered through Edmund Husserl’s phenomenological account of logic as a normative discipline.     

Pluralism, scientific knowledge, and the fallacy of overriding values

The paper examines one implication of pluralism, the view that all values are conditional and none are overriding. This implication is that since scientific knowledge is one of the conditional values, there are circumstances in which the pursuit of even the most basic scientific knowledge is legitimately curtailed. These circumstances occur when the pursuit of scientific knowledge conflicts with moral and political values which, in that context, are more important than it. The argument focuses on the case for and against space exploration in search of intelligent extraterrestrial life. The widely held supposition that search for pure scientific knowledge cannot be reasonably curtailed is identified as the fallacy of overriding values.     

Understanding the shear band interaction in metallic glass

Qualitative and quantitative models were proposed to understand the shear band (SB) interaction scenario found in the compressive tests on specimen with two symmetrical semi-circular notches. The so-called ‘work-hardening’ behavior could be ascribed as the stress interaction which was caused by stress fields around the SB tips. Besides, the SB bending was observed along propagation orientation. The quantitative analysis based on traditional shear deformation mechanism could reasonably account for how the SB was bent. It is anticipated that the present work could provide a pathway to understand the deep SB deformation mechanism of metallic glass.

Positive relationship between passive muscle stiffness and rapid force production

We aimed to examine the relationship among the muscle shear modulus at rest, maximal joint torque, and rate of torque development (RTD). Twenty-seven participants (28 ± 5 years, 13 women) were recruited in the study. The cross-sectional area (CSA) of the medial gastrocnemius (MG) muscle belly and shear modulus at an ankle joint angle of 0° were calculated using magnetic resonance imaging and ultrasound shear wave elastography, respectively. Subsequently, participants performed maximal isometric plantar flexion at 0° ankle joint angle [maximal voluntary contraction (MVC) test] as fast and hard as possible (RTD test). RTD was calculated from the time–torque curve over time intervals of 0–30, 0–50, 0–100, 0–150, and 0–200 ms from the onset of plantar flexion during the RTD test and was normalized by MVC torque to exclude muscle strength. MG CSA correlated significantly with MVC torque (r = 0.572), whereas MG shear modulus did not. In contrast, MG shear modulus correlated significantly with normalized RTD at all time intervals (r = 0.460–0.496). These results suggest that passive muscle stiffness is not associated with muscle force; however, higher passive muscle stiffness at a given joint angle may contribute to rapid force production.     

Extraordinary plastic behaviour of the γ′ precipitate in a directionally solidified nickel-based superalloy

The deformation behaviour of the γ′ precipitate in a directionally solidified nickel-based superalloy is investigated using microscopic observations after tensile testing at room temperature. It is found that coarse γ′ precipitates (604 nm) are sheared by strongly coupled dislocations, and some γ′ precipitates are elongated to approximately 3–6 times of their original lengths. It reveals that, at room temperature, the γ′ precipitate within the experimental superalloy has a significant plastic deformation capacity in comparison with Ni₃Al bulk alloys. Based on the experimental observations, the extraordinary plastic behaviour of the γ′ precipitate is analysed.     

Rapid word identification in pure alexia is lexical but not semantic

Following the notion that patients with pure alexia have access to two distinct reading strategies-letter-by-letter reading and semantic reading-a training program was devised to facilitate reading via semantics in a patient with pure alexia. Training utilized brief stimulus presentations and required category judgments rather than explicit word identification. The training was successful for trained words, but generalized poorly to untrained words. Additional studies involving oral reading of nouns and of functors also resulted in improved reading of trained words. Pseudowords could not be trained to criterion. The results suggest that improved reading can be achieved in pure alexia by pairing rapidly presented words with feedback. Focusing on semantic processing is not essential to this process. It is proposed that the training strengthens connections between the output of visual processing and preexisting orthographic representations.
