Responsibility, blameworthiness in particular, has been characterized in a number of ways in a literature in which participants appear to be talking about the same thing much of the time. More specifically, blameworthiness has been characterized in terms of what sorts of responses are fair, appropriate, and deserved in a basic way, where the responses in question range over blame, sanctions, alterations to interpersonal relationships, and the reactive attitudes, such as resentment and indignation. In this paper, I explore the relationships between three particular theses: (i) the claim that one is blameworthy to the extent that it is fair to impose sanctions, (ii) the claim that one is blameworthy to the extent that one deserves sanctions, and (iii) the claim that one is blameworthy to the extent that it is appropriate to respond with reactive attitudes. Appealing to the way in which luck in the outcome of an action can justifiably affect the degree of sanctions received, I argue that (i) is false and that fairness and desert come apart. I then argue that the relationship between the reactive attitudes and sanction is not as straightforward as has sometimes been assumed, but that (ii) and (iii) might both be true and closely linked. I conclude by exploring various claims about desert, including ones that link it to the intrinsic goodness of receiving what is deserved and to the permissibility or rightness of inflicting suffering.  相似文献

Situationism is, roughly, the thesis that normatively irrelevant environmental factors have a great impact on our behaviour without our being aware of this influence. Surprisingly, there has been little work done on the connection between situationism and moral luck. Given that it is often a matter of luck what situations we find ourselves in, and that we are greatly influenced by the circumstances we face, it seems also to be a matter of luck whether we are blameworthy or praiseworthy for our actions in those circumstances. We argue that such situationist moral luck, as a variety of circumstantial moral luck, exemplifies a distinct and interesting type of moral luck. Further, there is a case to be made that situationist moral luck is perhaps more worrying than some other well-discussed cases of (supposed) moral luck.  相似文献

The effects of military culture on causal attributions in a physical training environment were examined. The participants were male Australian Defense Force (ADF) members: 49 physical training instructors (mean age = 32.21 years) and 63 physical training participants (mean age = 34.22 years). Participants filled out a questionnaire describing 3 injury scenarios, each with a different severity of injury. The participants assigned causal attributes on 4 dimensions: lack of ability, environmental condition, lack of effort, and bad luck. There were main effects for scenario (low, moderate, and high severity of injury) and group (physical training instructors and injured trainee). Military culture may therefore encourage attributions that are internal and unstable. The results demonstrate the significant effect of military context on “normal” attribution biases. Therefore when seeking explanation of causation, there is a need to be aware of the tendency for those involved to distort attributions and how these distortions may be affected by a military context.  相似文献

Belief in moral luck is represented in judgements that offenders should be held accountable for intent to cause harm as well as whether or not harm occurred. Scores on a measure of moral luck beliefs predicted judgements of offenders who varied in intent and the outcomes of their actions, although judgements overall were not consistent with abstract beliefs in moral luck. Prompting participants to consider alternative outcomes, particularly worse outcomes, reduced moral luck beliefs. Findings suggest that some people believe that offenders should be punished based on the outcome of their actions. Furthermore, prompting counterfactuals decreased judgements consistent with moral luck beliefs. The results have implications for theories of moral judgement as well as legal decision making.  相似文献

In this article it is argued that the standard theoretical account of risk in the contemporary literature, which is cast along probabilistic lines, is flawed, in that it is unable to account for a particular kind of risk. In its place a modal account of risk is offered. Two applications of the modal account of risk are then explored. First, to epistemology, via the defence of an anti‐risk condition on knowledge in place of the normal anti‐luck condition. Second, to legal theory, where it is shown that this account of risk can cast light on the debate regarding the extent to which a criminal justice system can countenance the possibility of wrongful convictions.  相似文献

This essay aims to reorient current theorizing about luck as an aid to our discerning this concept's true philosophical significance. After introducing the literature's leading theories of luck, it presents and defends counterexamples to each of them. It then argues that recent luck theorists’ main target of analysis—the concept of an event's being lucky for a subject—is parasitic on the more fundamental notion of an event's being a stroke of luck for a subject, which thesis serves as at least a partial diagnosis of the leading theories’ failure. Next, it develops an analysis of strokes of luck that utilizes insights from the recent luck literature. Finally, having set out a comprehensive new analysis of luck—the Enriched Strokes Account of lucky events—the essay revisits the initial counterexamples to the literature's leading theories and argues that the Enriched Strokes Account properly handles all of them.  相似文献

Reactions featuring appeals to agent causation receive special attention. Because the problem is focused on decision making, the control that agents have over what they decide is a central topic. Moral luck, until recently, has been understood either explicitly or implicitly through using a lack of control account of luck. For example, a case of resultant moral luck is a case where an agent is morally blameworthy or more morally blameworthy or praiseworthy for an outcome despite that outcome being significantly beyond that agent's control (Nagel 1993). Due to a shift in understanding the concept of luck itself in terms of modal robustness, however, other accounts of moral luck have surfaced. Both Duncan Pritchard (2006) and Julia Driver (2013) have offered an alternative way of understanding moral luck by employing versions of a modal account of luck. There are good reasons for pursuing a theory of knowledge by way of understanding the connection between knowledge and luck. Not surprisingly, then, there has been a burgeoning of interest in “luck theories” of knowledge as well as in theories of luck in general. Unfortunately, “luck” proves to be as recalcitrant an analysandum as “knows.” While it is well worth pursuing a general theory of luck despite these difficulties, our theory of knowledge might be made more manageable if we could find a more restricted notion that captured the core phenomena of luck that are relevant to whether or not someone knows. This essay makes the attempt to delineate such a notion, called “mere coincidence.”  相似文献
