以卫生法制现代化构件为基本依据,在对卫生法制建设现状进行充分调研的基础上,系统分析和反映了浙江省卫生法制建设存在的主要问题,为浙江省科学制定和实施卫生法制建设规划与发展战略,切实推进卫生法制现代化进程提供决策依据。

跨文化的实证法学研究把文化心理学的理论突破和心理学的实证方法引入到对法学基本原理的研究之中。文化心理学研究中发现的东西方文化在价值定向、道德判断和思维方式等方面的差异能够给跨文化实证法学研究带来重要的启示。在对一些重要法律问题的认识上, 例如法律中的因果关系和责任的判定、合同形成以及纠纷调解等方面, 跨文化心理学研究已经发现了显著的跨文化差异, 这些差异可能会影响到不同文化背景的人对法的认识、法的建设以及法律的应用。我们认为跨文化的实证法学研究不仅可以为法学研究提供一条新的研究路径, 更主要的是还可以为中国法学研究的国际化和国际法律纠纷提供理论指导。

The Performance of Authenticity: Ordination and Profession in Pastoral Care

Quite a few pastors experience a feeling of inauthenticity when performing their duties. Trying to fulfill the wishes and needs of those of the congregation who ask for their help, they feel like an impostor. The discrepancy between act and experience causes a serious problem in identity. However when authenticity is not considered to be an individual experience and a personal dilemma but as a relational characteristic, the concept of play may be usefully engaged to explain the dramaturgical essence of pastoral performance. The success of pastoral performance depends on maintaining the right aesthetical distance in the drama enacted, so that some form of catharsis might be effected. That distance is found in introducing the concept of ordination where the relation between pastor and congregation is concerned, and it is to be found in the concept of profession where pastors perceive and evaluate their own role performance. Both ordination and profession act as distancing devices enabling the pastor to play the right role rightly. Acting as if, the pastor may be experienced as authentic, as a real pastor.

Solov'ëv turned out to be the thinkerwho was able to do these things. An amateur in juridicalquestions, remote from the enlightenment rationalizations ofpolitical liberalism, Solov'ëv set out to lay the basis forjuridical freedom in way that was unexpected philosophicallyand culturally.

     

Positive education of stoic warriors as reflective practitioners in the profession of arms

This paper traces connections between Stoicism and Positive Psychology for helping to inform and guide the education of warriors in the Profession of Arms. Peterson and Seligman advocate six core virtues and associated character strengths, which the authors illustrate from the practice of leadership education at the Squadron Officer School and The Air University. A synopsis of Costa and Kallick’s Habits of Mind is introduced to illustrate how awareness of the ways virtue and character strengths can guide the reflective warrior with wisdom and determined action. The authors also highlight insights from the work of Chris Argyris and Donald Schön on double-loop learning, reflective-thinking-in-action, and couple those insights with Dietrich Dörners’ emphasis on the advantages of simulations to offer experimentation by practitioners to better prepare them ‘think of, and then do, the right things at the right times and in the right way.’ Finally, a virtual world learning simulation developed by the authors to support student experimentation with double-loop learning on character strengths and habits of mind is described to illustrate the art-of-the-possible for the positive education of stoic warriors.
