The idea of “just war” is not alien to Chinese thought. The term “yi zhan” (usually translated as “just war” or “righteous war” in English) is used in Mencius, was renewed by Mao Zedong, and is still being used in China today (zhengyi zhanzheng). The best place to start exploring this Chinese idea is in the enormous Art of War corpus in premodern China, of which the Seven Military Classics is the best representative. This set of treatises served as the military bible in imperial China from 1078 CE. Ideas analogous to ius ad bellum and ius in bello can be found in these texts. These norms are present in these military texts, elaborated in subsequent commentaries, understood as a matter of fact in Chinese political history, and recently and briefly acknowledged by a few Chinese military scholars in the mainland and in Taiwan. This Chinese just war ethics has its distinctiveness vis‐à‐vis James Turner Johnson's articulation of the Western classic view. It differs from Johnson's claims that military lethal violence is intrinsically morally neutral and that last resort is not a primary consideration in deciding for war. Contemporary Chinese People's Liberation Army (PLA) military publications show that the PLA understands the general idea of just war, but they acknowledge only the ad bellum part, not the in bello components. 相似文献

Focusing on the thought of Mencius and Xunzi, this essay reconstructs and examines the classical Confucian position on the legitimate use of military force. It begins by sketching historically important political concepts, such as types of political leaders, politics of the kingly way versus politics of the hegemonic way, and the controversial role of lords‐protector. It then moves on to explore Confucian criteria for justifying resort to the use of force, giving special attention to undertaking punitive expeditions to interdict and punish aggression and tyranny. Following this discussion, the essay then attends to important Confucian moral constraints on how military force is properly employed, including prohibitions on attacking the defenseless, indiscriminate slaughter of enemy forces, destruction of civilian infrastructure, prisoner abuse, and non‐consensual annexation of territory. The essay concludes by first discussing an illustrative case from Mencius and then comparing its reconstruction of the Confucian position to those offered by other scholars. 相似文献

Many contemporary scholars debate whether war should be conceived as a relative evil or a morally neutral act. The works of Augustine may offer new ways of thinking through the categories of this debate. In an early period, Augustine develops the distinction between evil done and evil suffered. Augustine's early treatments of war locate the saint as detached sage doing only good, and immune from evil suffered. In a middle period, he develops a richer picture of the evil suffered on the occasion of the loss of historical goods but fails to develop the implications of this picture as concerns war. Finally, without abandoning emphasis on the avoidance of doing evil, Augustine comes to highlight how evil suffered in war prevents us from speaking simply of good wars. Augustine's ability to hold together senses of evil and their moral significance provides a useful avenue for new thought on this issue. 相似文献

ABSTRACTThe word ‘hägring’ (in English. ‘mirage’) can be understood in different ways: as an unrealistic hope or wish that cannot be achieved (wishful thinking); as an image in a mirror of something that is not there, but in another place, and as a sign of something that has not yet become visible, for instance, the first rays of sunlight on the horizon before the sun has risen. These meanings represent different ways in which presence and absence interplay, and are all illustrated in Kjell Westö’s impressive novel from 2013 for which he received the Nordic Literature Prize in 2014.The action of the novel takes place during eight months in Helsinki from March to November 1938 and unravels how the past and present are woven together on a historical, societal and individual level. The present article will try to illustrate this. 相似文献
