Despite the recent focus on the problem of the recruitment and use of child soldiers, there is still no clarity on the criminal liability of child soldiers who participate in conflict. In this article, we analyze the criminal liability of child soldiers against the historical background child soldiers. This aritle reports on its prevalence, and discusses the international legal framework liability. We pose the question whether the dual status of child soldiers as victims and perpetrators negatively impacts their criminal liability and whether it may in fact hamper the attainment of justice.  相似文献

Research on moral judgement traditionally deals with scenarios involving trade-offs between saving lives and causing harm or death. In the field of moral psychology and philosophy, these specific scenarios are regularly used jointly, regardless of the severity of harm. We predicted that the confounding between distinct phrasings involving different degrees of harm will have an impact on the frequency of utilitarian judgements regardless of the mere moral value of the action (as usually investigated in the moral judgement field). In line with this prediction, a first experiment showed that utilitarian responses were less frequent for conflicting moral scenarios that involved death, as compared to scenarios that involved non-lethal harm. A second experiment showed that participants' utilitarian responses decreased as the severity of harm increased. Experimental studies on moral reasoning should take greater care to avoid potential confounds associated with this content factor.  相似文献

This study examined relationships between physical appearance concerns (fear of fat, body image disturbance; BIDQ), disgust, and anti-fat prejudice (dislike, blame), and tested whether disgust mediates relationships between physical appearance concerns and anti-fat prejudice. Participants (N = 1649; age = 28 years) provided demographic data and completed measures of anti-fat prejudice, tendency to feel disgust, and physical appearance concerns. Univariate, multivariate, and mediation analyses were conducted. Univariate and multivariate associations were found between fear of fat, BIDQ, disgust, and anti-fat prejudice for women. For women only, mediation analyses showed that disgust partially mediated relationships between physical appearance concerns and dislike of fat people. For men, univariate and multivariate relationships were found between fear of fat, and dislike and blame of fat people, but disgust was not related to anti-fat prejudice. Newer constructs centering on physical appearance concerns and disgust appear promising candidates for understanding anti-fat prejudice.  相似文献

Development of humanitarian moral identity may correspond with the growing self-importance of moral traits. This study considered the extent to which moral traits become explicit in novice and expert humanitarian moral identity narratives. Eighty humanitarian caregivers from L’Arche communities were given self-understanding interview prompts to assess temporal (i.e., past, present, and future) and relational expectations. Humanitarian responses were compared to four paragraphs comprised of moral traits (i.e., just, brave, caring, and religious) using a computational knowledge representation model known as latent semantic analysis (Landauer, T., McNamara, D., Dennis, S., & Kintsch, W. Consistent with predictions, humanitarian experts displayed more explicitly self-important moral traits than novices on future and romantic partner expectations. This paper examines four interpretations of the observation that humanitarian intervention might be used ‘selectively’ or ‘inconsistently’ in order to elucidate the normative commitments of the deliberative process in international relations. The paper argues that there are several types of concerns that are implicit in the accusation of inconsistency, and only some of them amount to objections to humanitarian intervention as a whole. The paradox of humanitarian intervention is that intervention is prohibited except where the intervention is humanitarian, yet humanitarian reasons never exist in isolation, and it is nearly impossible to determine the real reason for intervention (or any other collective action) in the international arena. The problems revealed by an examination of inconsistency in the example of humanitarian intervention turn out to be general problems with applying the norms of practical reasoning to moral questions dealing with collective agents.  相似文献

The United Nations' (UN) adoption of a Declaration on the Rights of Indigenous Peoples is intended to mark a fundamental ethical turn in the relationships between indigenous peoples and the community of sovereign states. This moment is the result of decades of discussion and negotiation, largely revolving around states' discomfort with notion of indigenous self-determination. Member states of the UN have feared that an ethic of indigenous self-determination would undermine the principles of state sovereignty on which the UN is itself grounded. However, such fears are the result of very poor understandings of the ethical principles under which the relations between indigenous peoples and nation-states already have been formed under centuries of European colonialism. The principle of self-determination embraced in this Declaration does not diverge from colonial norms; it entrenches these norms as international policy. Without doubt, indigenous peoples are more likely to benefit than suffer from states' observance of the Articles within this Declaration. Reducing the challenge of indigenous peoples' rights to the notion of self-determination set out in this document, though, misses an extraordinarily important opportunity to critically investigate the ethic of rights that has produced an opposition between nation-states and indigenous peoples to begin with. A true turn in the ethics of this relationship would see not simply the institution of a right to self-determination but, rather, indigenous peoples' right to first determine the nature of self for themselves.  相似文献

Aldershot: Ashgale Publishing.  [Google Scholar] refers to British internal politics to satisfy the influential church and other non-conformist libertarian community leaders, and above all ‘undermining Britain's competitors, such as Spain and Portugal, who were still reliant on slave labour to power their economies, as the principal motivation for calls to end the slave trade than any genuine humanitarian concerns of racial equality or global justice’. Drawing on an empirical exploration, this article seeks to draw a parallel between this politics of humanitarian intervention which characterised the abolition movement, albeit rarely recognised in the academic literature, and the British intervention to end the almost 11 year civil war in Sierra Leone. The article concludes with a discussion on the implications of this politics of humanitarian intervention in the reconstruction of post-conflict Sierra Leone.  相似文献

Thomas Nagel's conservative position of the political conception for world politics and his insightful ‘Minimum Humanitarian Morality’ (MHM) view on global justice are laudable. He admits that the path from anarchy to justice must go through injustice. But Nagel does not clearly identify the conditions under which we put up with global injustice. This paper reviews the conception of MHM through the lens of the institutional political economy. In my view, to recognize the degree of structural failure (weakness in governance) as well as the degree of transition failure (elite bargain or personalization of power being interlocked) in each state can give us a hint on how to conceptualize and apply Nagel's MHM. We also argue that the scope and degree of humanitarian aid may vary in accordance with the options to global justice open to each state.  相似文献

With data gathered from 47 university counseling centers in the United States, this study addresses both inter- and intra-group differences in symptomatology at intake among international students. In Study 1, symptomatology among international students was explored in comparison to US ethnic groups. In Study 2, intra-group differences in symptomatology among international students were examined. In Study 1, data consisted of 14,421 international, White American, African American, Asian American, and Latina/Latino American counseling center clients who completed the CCAPS-62 at intake. Partially supporting our hypothesis, results indicate significant findings among international students in the social anxiety and academic distress domains of the CCAPS-62. Contrary to our expectations, Asian American students reported significantly greater concerns across many domains when compared to other groups. In Study 2, international students (n = 607) were further divided into five continents of origin: Asia, Africa, North America, South America, and Europe. Results indicate that in multiple domains, international students from Asia and Africa reported significantly greater concerns than those from Europe, North America, or South America. Implications of findings for university counseling centers and universities at large are discussed.  相似文献

Two studies examined how adopting an impression formation or evaluative concern mindset affects individuals' own and their interaction partner's experience of potentially stressful social exchanges, such as first meeting situations and interethnic interaction. Our main hypothesis was that adopting an impression formation mindset would, by diverting individuals' focus away from themselves and toward others, reduce both their own and their partner's cognitive resource depletion and negative affect. Consistent with predictions, positive effects of impression formation were evident and were “contagious” in that they were evident across individuals who received the mindset instructions and their partners, who were unaware of the manipulation. The positive effects of impression formation instructions were generally evident both in comparison to evaluative concern instructions, which provided similar structure, and in comparison to no instructions at all. Thus, adopting an impression formation mindset seems an effective strategy for minimizing negative outcomes experienced in stressful social interactions.  相似文献
