Spinoza conceived human freedom as a matter solely of rationality, but an understanding of the role emotion plays in moral virtue can lead one toward viewing emotionality as also essential to human freedom. A large part of human freedom consists in our tendency to give intrinsic importance to people or things outside ourselves and take them into our lives; this sense of importance, in rich and various ways, brings emotion into the center of our lives and our freedom as individuals.  相似文献

This paper examines whether non-human animals have a moral right not to be experimented upon. It adopts a Razian conception of rights, whereby an individual possesses a right if an interest of that individual is sufficient to impose a duty on another. To ascertain whether animals have a right not to be experimented on, three interests are examined which might found such a right: the interest in not suffering, the interest in staying alive, and the interest in being free. It is argued that while the first two of these interests are sufficient to ground animal rights against being killed and made to suffer by experiments, the interest in freedom does not ground a general animal right not to be used in experimentation. Public Space     
“Public space” is the space where individuals see and are seen by others as they engage in public affairs. Hannah Arendt links this space with “public freedom.” The being of such freedom, she asserts, depends on its appearing. It consists of “deeds and words which are meant to appear, whose very existence hinges on appearance.” Such appearance, however, requires the public space. Reflecting on Arendt’s remarks, a number of questions arise: What does the dependence of freedom on public space tell us about the nature of freedom? How does public freedom relate to the freedom of a private individual? Does the latter also depend on its appearing? Which is generatively prior: freedom or public space, i.e., the actions that publicly manifest freedom or the space required for their appearance? How does public power shape this space? In this article, I approach these questions through a phenomenological study of public space.  相似文献

Robert Lane is a seasoned critic of American consumer society. His latest book summarizes many of the arguments brought up earlier and contributes new data about developments in income, companionship and happiness in the USA between 1972 and 1994. Lane notes a considerable rise in incomes over these years and claims that companionship and happiness have declined. He attributes this decline to market forces that emphasize money at the expense of intimate bonds, resulting in a weakened capacity to deal with stress.This review challenges two of the book's hypotheses. First, it shows that happiness did not decline in the USA in these years, but was actually quite stable. Second, it mitigates the assertion that companionship has dwindled and notes that money making and companionship are not necessarily antithetical.Still, Lane could be right. Possibly market forces did depress happiness and possibly that loss was offset by improvements in other fields, like increased freedom or better health care, such as better treatment for mental problems. If so, Lane's message is that Americans could have been happier than they ultimately were.  相似文献

Recent years have seen growing interest in the judicialization of religious freedom (JRF). In this article, I identify two distinct meanings of JRF, which are often conflated but which need to be kept separate. I then argue for a stronger institutionalist approach to JRF. An institutionalist approach focuses our attention on both the rules internal to courts, and the relationship of courts to administrative agencies, legislatures, and other governing bodies. I argue that there is room to strengthen our analyses of JRF by paying greater attention to these institutional dynamics. I demonstrate this by highlighting two overlooked features of courts—interpretive rules and access rules—that are particularly important for governing JRF; and by developing a framework that relates the courts to other institutional venues and political actors. In so doing, I identify a number of promising directions for future research into the causes and consequences of JRF.  相似文献

NGO-based and rigorously monitored development programmes are bringing about important and positive socio-economic changes in the developing world. However, there are numerous instances of the employment of aggressive and grueling monitoring techniques which objectify the subject of development, the primary stakeholder, claiming development results as the successful achievement of goals of the donor or implementing organization. It is in this context that one can speak of an ethic of monitoring development programmes. The paper argues that such an ethic can be positively based on principles like empowering people through development work without hurting their sense of self-worth, the principle of trust and partnership and, negatively, never striving to objectify any person or people for the achievement of some objective, even if this objective is in itself honourable and desirable. The paper contends that if development is freeing the subject, the central player, to exercise their capability to live their life to the fullest, then development monitoring and development work in general has to enhance freedom, autonomy and openness.  相似文献

Nudging interventions are broadly defined as a rearrangement of a choice context that gently suggests a specific choice. Their increasing popularity has attracted attention and discussion from researchers, policy makers, and practitioners alike. After some applications to domains such as health, environmental issues, and retirement savings, the next step in nudging is to understand the psychological boundary conditions when applied to varied domains of daily life. It is yet unclear for example to what extent nudging interventions can be transparent without losing effectiveness, or how permanent the effects are. These unresolved questions may have contributed to heated political and scientific discussions, on for example the ethics of using nudges in the public health domain, due to the missing scientific evidence. Indeed, this popularity may have led to forget how nudging harnesses insights from decades of research in psychology to change people's behavior. The aim of this paper is to shift the focus back to the psychological premises nudges were built upon. It summarizes several outstanding questions that future research in the psychology of nudging should address. Advancing research in nudging will help to improve our understanding of applied nudging interventions and provide clarity to debates such as ethical appropriateness, effectiveness, and public approval.  相似文献

This paper explores the rationale for violence and coercion aimed at preventing abortion conceived as the killing of an innocent person. Some important arguments for personhood at conception are examined, and in the light of the examination the paper considers whether they warrant concluding that a free and democratic society should pass laws recognizing personhood at conception. The wider concern is what principles such a society should use as a basis for legal coercion and what principles conscientious individuals should use insofar as they judge that self-defense or, especially, protection of the innocent, requires violence.  相似文献
