Usually, rhetoric is supposed to provide a model of law which describes legal interactions as volitive, arbitrary, and void of any system. 由计算机从题库中自动生成的试卷能否保持难度的相对稳定?根据IRT进行的等值误差范围有多大?为了回答这些问题,本文以共同组等值作为标准,对基于IRT之上的共同题等值误差进行了试验检验。试验中,采取一定措施保证了考生的动机水平。结果显示,IRT等值的校正方向都是正确的。在4个分测验中有3个分测验的的等值校正效果较理想,1个分测验的等值校正效果不够理想。计算机自动生成的试卷与原有人工命制的试卷在得分方面比较一致,分数相关达到0.931,获得证书的情况也是比较一致的。 相似文献

Zhuzi (Zhu Xi), Zhang Nanxuan and Lü Donglai continued a discussion begun by Hu Wufeng and his disciples on the subject of “knowing the form of benevolence,” and “seeking for a true mind in an absent one.” One result of their discussion was to make people realize that innately good knowledge and ability are not only manifested in loving one’s parents and respecting one’s elders, but also in the simple acts of drinking when thirsty and eating when hungry. This generated the idea of “manifestation range of innately good knowledge and ability.” However, another conclusion of this discussion claimed that if the desire to drink and eat or the king of Qi’s grudging an ox are included in this range, there would be a danger of viewing innately good knowledge and ability merely as inborn human nature or instinct. This discussion reveals an unsteady relationship between innately good knowledge and ability and the feeling of commiseration, which are sometimes united and sometimes separate. 相似文献

Abstract: Ian Hacking proposes that ways of talking about autistic experience can shape, or even transform, what it is like to be autistic. I explore the grounds for two nonexclusive interpretations of this thesis. The informative interpretation holds that, because nonautistics cannot read mental states into autistic behaviour as they normally do with one another, autistic self-narratives give nonautistics unique insights into what it is like to be autistic. This in turn affects how nonautistics interact with autistic individuals, enriching their social environment in various ways. The more radical, transformative interpretation holds that autistic experience is itself moulded under the influence of developing a language-game for talking about autistic experience. Beginning from the Enlightenment view that beauty or art is "useless," the attempts to explain how aesthetic experience and judgment are possible presented by Moritz Schlick and Li Zehou are examined, compared and contrasted. The paper treats three main subjects, the anthropological origins of beauty, the origins of aesthetic judgments and the problem of the purpose or function of beauty or aesthetic experience. In the first--the historical-causal roots of beauty--the problem discussed is how to account for aesthetics in light of the practical needs and pursuits of human beings. For Schlick, the problem is couched in terms of how aesthetic experience can be made consistent with natural selection. The second main subject-the philosophical roots of beauty-is a discussion of the origin in the sense of justification of aesthetic judgments. And the third examines the problem of assigning some purpose to aesthetic feelings and attitudes. An apparent contrast is made, and perhaps resolved, between the respective views of Schlick and Li. 相似文献

This paper replies to Himmelreich's ‘The Paraphrase Argument Against Collective Actions’ [2017], which presents three putative counterexamples to the multiple agents analysis of plural action sentences. The paper shows that the argument from the first example, the discursive dilemma, fails because it relies crucially on a simplification of the target analysis, and that the others don't bear on the question because they turn out on examination to be about individual rather than group action sentences. 相似文献

Nowadays, managing change in complex services requires that middle management re-designs its objects and professional practices, in order to cope with new needs. It seems therefore crucial to activate training settings that allow managers to: (1) develop research and analytical skills on their own work practices and professional objects; (2) face and manage conflict, related to every change, that represents an opportunity to reflect and review one's own practices; and (3) build new and shared repertories of managerial practices, able to support a better form of living and working together within the management community. Moving from these hypotheses, inside the setting of a training intervention conducted in an educational service, the article discusses a specific tool used to generate opportunity of exchange, and reflection, within a challenging framework of change. 相似文献
