This essay discusses the most recent manifestations of the debate of the law and literature movement. The essay traces the evolution of the Law and Literature schools and identifies some of their adherents and conclusions, shows how these schools have influenced the conceptual development and teaching of American law, presents connections between the Critical Legal Studies and Law and Economics movements in the U.S., and raises questions about the Law and Literature movement. 相似文献

The historical development of the four main theories which have attempted to explain the relationship between cognitive style and ideological content—i.e., authoritarianism, extremism theory, context theory, and value pluralism theory—is analyzed from a rhetorical perspective. The discussion focuses on the manner in which the tensions between theoretical universalism and political critique have been "resolved" by theorists working in different historico-political contexts. While both these scientific and political values have been of central concern in theorizing the link between cognitive style and content, they are deeply incompatible because it is not possible to establish a fixed relationship between a personality dimension and the changing beliefs associated with different ideologies across time and place. This has prompted theorists aiming for universalistic accounts to define ideological orientation in terms of psychological processes rather than content, which, in turn, has compromised the critical potential of their theory. The paper concludes that the historical development of the literature may be understood in terms of dilemmatic counter-themes which, under different political circumstances, have been resolved in novel ways. 相似文献

Abstract. What is the relationship between natural science, social science, and religion? The dominant paradigm in contemporary social science is scientism, the attempt to apply the methods of natural science to the study of society. However, scientism is problematic: it rests on a conception of natural science that cannot be sustained. Natural scientific understanding emerges from an instrumental and objectifying relation to the world; it is oriented toward control and manipulation of the physical world. Social-scientific understanding, by contrast, must begin with a practical and meaningful relation to the world: it is oriented toward the mediation of values and objective possibilities in the social world. Social science is therefore a form of practical reason based on objective claims. But while social-scientific understanding starts with interpretation, its possibilities by no means end there. In particular, by developing abstract and objectified models of society as a system, social science opens existing social organization to critical reflection. Religion, by contrast, is a form of speculative reason about ultimate values, based on subjective claims of religious experience. Social science nevertheless shares with religion an orientation toward values and concern with the “good life.” 相似文献

This article combines an appreciation of several themes in Josh Reeves's Against Methodology in Science and Religion: Recent Debates on Rationality and Theology while arguing in favor of critical realism. The author holds that critical realism manages to combine the objective truth reached through inference and especially cognitive acts of judgment as well as the various, contingent historical contexts that also define where science is practiced. Reeves advocates a historical perspective, but this article claims that in order for critical realism to be credible, a philosophical perspective must be maintained. 相似文献

A model of inductive inquiry is defined within a first-order context. Intuitively, the model pictures inquiry as a game between Nature and a scientist. To begin the game, a nonlogical vocabulary is agreed upon by the two players along with a partition of a class of structures for that vocabulary. Next, Nature secretly chooses one structure (the real world) from some cell of the partition. She then presents the scientist with a sequence of atomic facts about the chosen structure. With each new datum the scientist announces a guess about the cell to which the chosen structure belongs. To succeed in his inquiry, the scientist's successive conjectures must be correct all but finitely often, that is, the conjectures must converge in the limit to the correct cell. A special kind of scientist selects his hypotheses on the basis of a belief revision operator. We show that reliance on belief revision allows scientists to solve a wide class of problems. 相似文献

Pragmatism and critical realism are different vocabularies for talking about the cognitive value of religion and science. Each can be, and has been, used to make the case for cognitive parity between religious and scientific discourse. Critical realism presupposes a particular form of cognitive psychology that entails general skepticism about the external world and forecloses scientific inquiry in the name of a preconceived idea of what the nature of human cognition must be. Thus, of the two, pragmatism is the better vocabulary for fostering mutual understanding between religion and science. 相似文献

In this paper I trace the dialogical and narrative dimensions of the philosophical tradition and explore how they are reconfigured in the notion of community of philosophical inquiry (CPI), the mainstay of the collection of novels and discussion plans known as Philosophy for Children. After considering the ontology and epistemology of dialogue, I argue that narrative has replaced exposition in our understanding of philosophical discourse and that CPI represents a narrative context in which truth comes to represent the best story, in a discursive location in which there are always multiple stories. Finally, I raise the issue of children's philosophical voice. Can children philosophize, and if they can, do they do so in a voice different from adults'? If so, what are the distinctive features of that voice? I assert that it is children's historical marginalization in the Western construction of rationality that now – as that rationality undergoes its crisis – makes of them, like women and other “natives,” privileged strangers to the tradition, who are, through CPI, enabled to enter it through dialogue and narrative. 相似文献

This paper consists of an introduction to the life and work of Iring Fetscher by the interviewer, followed by a conversation with Fetscher, and notes. In the interview, Fetscher discusses his relationship to Marxism, Hegelianism, Lukács, and the Frankfurt School, as well as his critique of Althusser. The contribution of Fetscher, an extremely well-known German specialist on Soviet and Marxist thought, is here discussed in greater detail than anywhere else to date in the English-language scholarly literature. 相似文献
