People involved in criminal proceedings (e.g. police officers, district attorneys, judges, and jury members) may run the risk of developing confirmation bias, or tunnel vision. That is, these parties may readily become convinced that the suspect is guilty, and may then no longer be open to alternative scenarios in which the suspect is actually innocent. This may be reflected in a preference for guilt‐confirming investigation endeavours, as opposed to investigations that are aimed at confirming, or even excluding, alternative scenarios. In three studies, participants read a case file, and were subsequently instructed to select additional police investigations. Some of these additional endeavours were guilt‐confirming (i.e. incriminating), whereas others were disconfirming (i.e. exonerating). Results suggest that additional investigation search was guided by an initial assessment of the suspect's guilt (Study 1). Furthermore, participants' tendency to select incriminating investigations increased with increased crime severity, and with the strength of the evidence present in the case file. Finally, the selection of incriminating investigations was associated with conviction rates (Study 3). However, in general, participants did not favour incriminating endeavours. That is, in the three studies, the percentages of selected incriminating endeavours did hardly or not exceed 50%. Copyright © 2010 John Wiley & Sons, Ltd.  相似文献

Fraud examiners from global auditing firms and local law firms are in the business of private policing by conducting internal investigations in private and public organisations when there is suspicion of financial crime. The business is often characterised by secrecy, and reports of investigations are often difficult or impossible to disclose. Since 2012, we have successfully retrieved 63 fraud examination reports in Scandinavia. Based on these reports, this article presents a statistical analysis of fraud examination performance. Performance was measured in terms of the extent of successful reconstruction of past events and the extent of justification of conclusions from the examinations. We identified three statistically significant determinants of fraud examination performance: the seriousness of the consequences, the relative seriousness of the consequences and the conclusions, and the seriousness of the conclusions.  相似文献

ABSTRACT

The prevalence of trauma and its negative impact on humankind has created a burgeoning awareness of the need for systems that are trauma-informed across the lifespan. A collaborative project with the National Partnership to End Interpersonal Violence (NPEIV) sought out research as a call-to-action to mitigate the impact of trauma. The following is an introduction to a special double-issue focused on theoretical and applied approaches to using trauma-informed care in multi-disciplinary, mental and physical health, criminal justice, school-based, and community settings. Consideration is given to essential issues such as resilience, self-care, and cultural awareness.  相似文献

In philosophy and in religious ethics, accounts of mercy are typically developed in relation to justice. The essays in this focus issue each insist on an integral connection between mercy and justice, yet each reconfigures that relationship by arguing that mercy is best understood as a normative response to others in their need. Defining mercy as our response to others’ need highlights the value of mercy as an effective public virtue, grounded in realism about the human condition and focused on reparative and restorative action.  相似文献

Currently, promising new tools are under development that will enable crime scene investigators to analyze fingerprints or DNA‐traces at the crime scene. While these technologies could help to find a perpetrator early in the investigation, they may also strengthen confirmation bias when an incorrect scenario directs the investigation this early. In this study, 40 experienced Crime scene investigators (CSIs) investigated a mock crime scene to study the influence of rapid identification technologies on the investigation. This initial study shows that receiving identification information during the investigation results in more accurate scenarios. CSIs in general are not as much reconstructing the event that took place, but rather have a “who done it routine.” Their focus is on finding perpetrator traces with the risk of missing important information at the start of the investigation. Furthermore, identification information was mostly integrated in their final scenarios when the results of the analysis matched their expectations. CSIs have the tendency to look for confirmation, but the technology has no influence on this tendency. CSIs should be made aware of the risks of this strategy as important offender information could be missed or innocent people could be wrongfully accused.  相似文献

This essay argues that the criminal justice system in the United States is flawed because it focuses principally on punishment of illegal actions without considering offenders as persons in their entirety. It considers the role that constructive shame and mercy can play in addressing this flaw. ABSTRACT

This article provides a rationale for trauma-informed care (TIC) in correctional services, and challenges readers to think about offending behavior through the lens of trauma. Based on interdisciplinary research and cross-theoretical literature, TIC can help in our quest to develop relevant and successful programs, practices, and policies, and the best methods for delivering them. Using Substance Abuse and Mental Health Services Administration (SAMHSA)’s core principles of TIC, this article will make suggestions for the implementation of trauma-informed service delivery and practices across correctional settings. The authors translate trauma-informed concepts into practice behaviors through the acronym SHARE (safety, hope, autonomy, respect, empathy), which honors the principles of TIC recommended by SAMHSA and the principles of effective correctional rehabilitation. TIC in corrections may help improve the desired outcomes of successful re-entry and reduced recidivism.  相似文献

A number of females, commonly recognized as 11 victims, were murdered in separate events in Whitechapel, London between 1888 and 1891. An evaluation of the murders revealed that six of those murders were linked by a number of distinct, personal signature characteristics, including picquerism, overkill, incapacitation, domination and control, open and displayed, unusual body position, sexual degradation, mutilation, organ harvesting, specific areas of attack, preplanning and organization, and a combination of signature features. The signature characteristics observed in these infamous Jack the Ripper murders were compared to a 1981–1995 cohort of 3359 homicide cases from Washington State's HITS database. The analysis revealed that the signature displayed in six of the Whitechapel murders was extremely rare. There were only six records of female victims, one a prostitute, with probed, explored, or mutilated body cavities. There were only two cases, both females who were not prostitutes, where the body was left in an unusual position and body cavities were explored, probed, or mutilated.
