Abstract

According to derailment theory, tactics girls and women use to survive a history of abuse, strategies shaped by their abuse, and societal reactions to it estrange them from non-deviant social networks and situations and increase the likelihood of criminal offending and the application of criminal labels. This process is self-reinforcing, with interactions of substance abuse, sexual deviance, criminal offending, and social control constraining choices through alienation and stigmatization. In short, a dynamic of cumulative disadvantage is set in place that puts some women at greater risk for involvement with the legal system. Empirical evaluation of this theory suggests that alienation from and marginal positions in pro-social networks have parallels in anti-social networks sufficient to decrease the likelihood of criminal offending and contact with crime control agencies.  相似文献

This article examines a process of behavioral analysis, referred to as linkage analysis, used in identifying sexual offenses that have been committed by the same offender. This type of analysis examines behavior that is contained in three distinct components of a crime, i.e., the modus operandi (MO) or the “how to” of a crime; the ritual or fantasy-based behaviors for a particular type or series of sexual crimes; the signature or unique combination of behaviors, which suggests that a series of crimes has been perpetrated by the same offender. Linkage analysis involves five assessment procedures: (1) gathering detailed, varied, and multisource documentation; (2) reviewing the documentation and identifying significant features of each crime individually across the series; (3) classifying the significant features of the crime as either MO and/or ritualistic constructs; (4) comparing the combination of MO and ritualistic features across the crimes to determine if a signature exists; (5) compiling a written analysis that details the conclusions derived from the available information. Results of this type of analysis can be used for investigative purposes and, in some instances, can help to inform the decision-making of the courts.  相似文献

Six 4- to 5-yr-old subjects were exposed to five sessions in which an adult model used passive sentences to describe a set of modeling stimuli. Probe stimuli, which the subjects were asked to describe without benefit of modeling and without selective reinforcement were interspersed among modeling stimuli. A matched group of control subjects received probletrials but no modeling trials. Both groups of subjects were subsequently tested on their ability to comprehend active and passive sentence forms. Every subject in the experimental group produced passive sentences on probe trials even though there was considerable variability in the number of passives produced. No control subject produced passives. The modeling procedure increased the comprehension scores of the experimental group above those of the control group though the scores of both groups were above chance. The results were contrasted with earlier studies in which modeling was ineffective in producing passive usage and in which comprehension of the passive was not demonstrated by even older children.  相似文献

A follow-up study was conducted on the aggressive and delinquent behavior of an original sample of 220 pupils of two age groups. The subjects were 7 and 9 years old in 1978 when they were interviewed for the first time. The present paper focuses on predictors of the subjects' aggressive and criminal behavior in adolescence and in young adulthood. Four different groups of variables were chosen as possible predictive factors: 1) parental aggression, punitivity, and attitudes of rejection toward the child, 2) previous acts of aggression by the subjects, 3) the viewing of violence on television during childhood, and 4) aggressive, indifferent, and delinquent behavior in adolescence. Physical aggression in adolescence and the number of arrests and traffic violations in young adulthood were used as dependent variables. The analyses established that for the male subjects, the best predictor of physical aggression in adolescence was previous aggression, whereas for the female subjects the best predictor of physical aggression in adolescence was previous viewing of violence on television. The number of arrests in young adulthood was best predicted for the male subjects on the basis of previous aggression and viewing of violence on television. The best predictors of the number of arrests in young adulthood for the female subjects were, apart from previous aggression and viewing of violence on television, also aggressive and delinquent behavior in adolescence as well as parental aggression, punitivity, and attitudes of rejection. The results emphasize the importance of the atmosphere of socialization in childhood and previous aggressive behavior as significant predictors of physical aggression in adolescence and criminal behavior in young adulthood. © 1996 Wiley-Liss, Inc.  相似文献

Outlaw Motorcycle Gangs (OMCGs) in Australia are subject to over 30 pieces of legislation restricting the movement and association of members. The justification for these acts is the presumption that the OMCG are criminal organizsations. This presumption has not been proven empirically by government agencies nor tested by academic research partly due to the difficulty in obtaining sufficient information. This paper tests the presumption by analyzing the data contained in the Queensland Police Service’s application to the Supreme Court to list the Finks MC, Gold Coast, as a criminal organization.  相似文献

The present study aimed to identify organizational climate dimensions that are salient for police investigation performance and to explicate the mechanisms of the relationship between organizational climate and investigation performance. We conducted 38 semistructured interviews with participants at three job levels of police investigative work (chiefs of police, n  = 11, senior investigating officers, n  = 14, detectives, n  = 13) in 11 Norwegian police districts. We analyzed the interview data by using a model of organizational climate based on the competing values framework (Quinn & Rohrbaugh, 1983). Two types of climate, human relations climate and rational goal climate, were perceived to enhance investigation performance. The findings indicate that a human relations climate enhances investigation performance by developing collective human capital and by supporting internal and external cooperation and coordination of resources. Moreover, the findings suggest that a rational goal climate increases investigation performance by encouraging planning, goal setting, and task focus.  相似文献

The author attempts to develop a concept of psychic trauma which would comply with the nucleus of this Freudian notion, that is, an excess of excitations that cannot be processed by the mental apparatus, but which would also consider the functions and the crucial role of objects in the constitution of the psychism and in traumatic conditions, as well as taking into account the methodological positioning according to which the analytical relationship is the sole possible locus of observation, inference and intervention by the psychoanalyst. He considers as a basic or minimal traumatic psychoanalytical situation that in which a magnitude or quality of emotions exceeds the capacity for containment of the psychoanalytical pair, to the point of generating a period or area of dementalisation in the psyche of one or both of the participants, of requiring analytical work on the matter and promoting a signifi cant positive or negative change in the relationship. Availing himself of Bion's theory about the alpha function and the metapsychological conceptions of Freud and Green concerning psychic representations, he presents two theoretical formulations relating to this traumatic situation, utilising them according to the ‘altered focus’ model proposed by Bion. He presents three clinical examples to illustrate the concept and the relevant theoretical formulations.  相似文献

Genocidalism     
This is an attempt to develop a more complete understanding of ``genocidalism of commission,' or the genocidal use of ``genocide,' defined stipulatively as ``the energetic attributions of ``genocide' in less than clear cases without considering available and convincing opposing evidence and argumentation.' Genocidalism is a widespread phenomenon regarding the discourse on international affairs in the advanced, liberal societies of the West, embedding a ``normative divide' between the ways of attending to domestic (national) concerns and ways of attending to international issues. I argue that genocidalism is morally wrong, explore its likely causes, and suggest possible ways of getting rid of this hateful practice. Drawing upon anthropological, legal and forensic publications, an interview with a South African Zulu traditional healer and direct information gained during homicide investigations, the nature of Muti murder is discussed. Muti murder is defined as a murder in which body parts are removed from a live victim for the sole purpose of using the victim's body parts medicinally. These body parts are then often mixed with other ingredients or used alone to make a medicine called muti. Muti is a Zulu (umuthi) word meaning medicine. The victim usually dies as a result of blood loss from the wounds. While muti murders have occurred throughout history in South African culture, little is known about them and little research exists on the phenomenon. The term muti murder has been used interchangeably with the term ritual or sacrificial murder, often adding to confusion in terminology and definitions regarding these types of cases. This paper provides an overview of muti murder, explains the context in which these types of murder occur, defines the offenders and victims involved, and provides guidelines for investigating these types of murders.
