This essay presents a dialogical framework for treating philosophical disagreements as persuasion dialogues with analogical argumentation, with the aim of recasting philosophical disputes as disagreements over analogies. This has two benefits: (1) it allows us to temporarily bypass conflicting metaphysical intuitions by focusing on paradigmatic examples, (dis)similarities, and the plausibility of conclusions for or against a given point of view; and (2) it can reveal new avenues of argumentation regarding a given issue. This approach to philosophical disagreements is illustrated by studying the role of argumentation by analogy in disputes over Lockean justifications of intellectual property rights, and disagreements over whether artificial agents should be treated as moral agents. Finally, a nonexhaustive list of possible global and local points of contention over analogical arguments is identified in order to highlight potential avenues of argumentation in disagreements over analogies. 相似文献

Is there a duty to respond to objections in order to present a good argument? Ralph Johnson argues that there is such a duty, which he refers to as the “dialectical tier“ of an argument. I deny the (alleged) duty primarily on grounds that it would exert too great a demand on arguers, harming argumentation practices. Parallelism is present everywhere in the early Moist texts: at the syntactic level, at the semantic level, between sentences, between sets of sentences, between argumentative structures. The present article gives many examples of the phenomenon: parallelism of insistence, insistence from top to bottom, insistence from bottom to top, parallelism with symmetry, parallelism involving negation, subcontraries and negation at deeper levels, parallelism of the argumentative structures. Logic is particularly applied to the study of parallelism involving negation. From the point of view of argumentation, it is shown that many of those constructions have an important role in supporting arguments such as: arguments of generalization, a fortiori arguments, arguments of exemplarity, consequentialist arguments, arguments by comparison. This study draws the attention to the importance of argumentation in the study of Moism and gives a new light on the argument by parallelism (mou 侔) in the “Xiaoqu”: It is a natural extension of what we call “parallelism involving negation,” already very common in the early Moist texts. 相似文献

judge wants to make an exception to a legal rule for the concrete case tries to meet the dialectical reasonableness norm by
seeing to it that his standpoint is sufficiently defended according to the requirements of the burden of proof of a judge
in a rational critical discussion and how he tries at the same time to be rhetorically convincing for the legal audience by
presenting the decision as a choice that is in line with the argumentation schemes and starting points that can be considered
as accepted by the legal community in the US and by the US community as a whole.

This essay introduces the five articles that follow, whose aim is to show how altruism emerges out of spiritual transformation and is integral to healing process in four kinds of ritual healing systems—popular, folk, an indigenous religious healing tradition, and complementary and alternative medicine represented by consciousness transformation movements. In this introduction I situate these largely marginalized religious and spiritual practices within the context of the religion‐science discourse, which has focused for the most part on the relationship between the established, mainstream religions and the dominant biomedical system. Antecedents of two of these types of religious practices, Spiritism and consciousness transformation movements, were part of the development of the psychological sciences in the nineteenth century but lost ground in the twentieth. Despite discrimination and persistent negative attitudes on the part of the established religions and biomedicine, these healing traditions have not only survived through the twentieth century but appear to have gained both followers and interest in the twenty‐first. In future decades, at least for complementary and alternative medical practices and perhaps also for spirit healing centers, there may be a reversal in status through greater acceptance of their unique combination of scientific and religious perspectives. 相似文献

In this paper it is shown is that although poisoning the well has generally been treated as a species of ad hominem fallacy, when you try to analyze the fallacy using ad hominem schemes, even by supplementing with related schemes like argument from position to know, the analysis ultimately fails. The main argument of the paper is taken up with proving this negative claim by applying these schemes to examples of arguments associated with the fallacy of poisoning the well. Although there is a positive finding in this quest, in that poisoning the well is shown to be based on and associated with these forms of argument in interesting ways, the paper in the end is led to the conclusion that the fallacy is irreducibly dialectical. Poisoning the well is thus analyzed as a tactic to silence an opponent violating her right to put forward arguments on an issue both parties have agreed to discuss at the confrontation stage of a critical discussion. It is concluded that it is a special form of strategic attack used by one party in the argumentation stage of a critical discussion to improperly shut down the capability of the other party for putting forward arguments of the kind needed to properly move the discussion forward. 相似文献

As an introduction to the special issue on Perspectives on Strategic Maneuvering, this article provides a synthetic recapitulation
of the various steps that were taken in developing the pragma-dialectical theory of strategic maneuvering. First, the concept
of strategic maneuvering is described as a means to reconcile the simultaneous pursuit of dialectical and rhetorical aims.
Second, strategic maneuvering is related to the various kinds of argumentative activity types in which it takes place. Third,
the concept of dialectical profiles is discussed and the parameters that are pertinent to distinguishing between different
types of strategic maneuvering. Fourth, the fallacies are viewed as derailment of strategic maneuvering. Fifth, as a case
in point, strategic maneuvering with inconsistency is examined.

It is argued that, beyond the argument, a critique is concerned with the position of the proponent relatively to the reality the argument is about.
