We theorize that the reported association between economic indicators and the incidence of civil commitment for mental illness may result, at least in part, from reduced tolerance in the community for impaired behavior among minorities. Earlier work suggests that economically induced intolerance will be focused primarily on minority males. Based on this literature, we hypothesize that the median level of functioning among African-American males subjected to civil commitment will vary positively with earlier changes in the unemployment rate. The test applies Box-Jenkins methods to 156 months (August 1985-July 1998) of data from California. Consistent with theory, results support the hypothesis.  相似文献

本论文以833名公务员为对象,通过构建公务员绩效评估公平性问卷,对公务员绩效评估公平性的结构进行了探讨。探索性因素分析表明,公务员绩效评估公平性的结构主要包括评估系统公平、评估者公平、信息公平和人际公平等四个维度;验证性因素分析表明问卷,具有较好的构思效度和建构信度,其问卷可以作为测量公务员绩效评估公平性的工具。  相似文献

In this paper, I compare the extent of Anglo-American judicial engagement in response to civil disobedience with that of the French judiciary. I begin by examining what the civil disobedient can realistically expect to achieve in a court of law. I shall argue that his priority should be to require the judge, acting as a mouthpiece for the law, to respond to his complaints. To do this, the civil disobedient must be able to deny liability for the offence he has allegedly committed by urging a different interpretation of the law on the basis of an alternative -- but plausible -- reading of constitutional or human rights. If the civil disobedient can do this, he can claim a victory of sorts, even if his claims are ultimately unsuccessful. But legal culture can present a further barrier. Judges have different roles in different jurisdictions and therein lie further difficulties for the French civil disobedient.  相似文献

A concept of civil society that stresses civil society's role in working with the state to achieve more inclusive, democratic polities provides the context for examining the implications for transnational civil society. In particular, the author examines how this perspective emphasizes the importance of the paradox that civil society cannot be understood independently of a relationship to a state. After explaining the nature of this paradox, the author discusses the various ways this paradox affects the potential for transnational civil society to contribute to more inclusionary democracies that reflect new processes in the social construction of citizenship.  相似文献

Although the recent collapse and dissolution of the Soviet Union has significantly reduced the near-term probability of nuclear disaster, it constitutes wishful thinking to imagine that meaningful and effective global governance is possible in today's world. The term “global governance” suggests and implies a degree of order and control in the international community far beyond that which presently exists, and that in fact could only be achieved by means of a global government. The global governance myth has emerged to help people cope with the uncongenial and presumably unavoidable reality that we are living in a world in which global government is impossible, and in which therefore the international condition is most accurately described as “international anarchy.” A dysfunctional myth is a belief that not only is false, but that discourages and deters thought and action toward overcoming uncongenial realities which are not, in fact, unavoidable. Global governance, in all likelihood, falls into the category of dysfunctional myth.  相似文献

The argument of this article is that what I term generic globalization has created unprecedented opportunities for advances in human rights universally, but that the dominant actually existing historical form of globalization – capitalist globalization – undermines these opportunities. Substantively, I argue that taking the globalization of human rights seriously means eliminating the ideological distinction that exists between civil and political rights on the one hand, and economic and social rights on the other. Doing this systematically undermines the three central claims of capitalist globalization – namely, that globalizing corporations are the most efficient and equitable form of production, distribution and exchange; that the transnational capitalist class organizes communities and the global order in the best interests of everyone; and that the culture-ideology of consumerism will satisfy our real needs.  相似文献

Two studies examined mock juror verdicts for veterans with PTSD in the criminal justice system. Mock jurors demonstrated a leniency toward treatment bias for veterans with PTSD who committed a violent crime, compared to a nonviolent crime. This leniency toward treatment bias occurred only when alternative verdict options, beyond guilty or not guilty, were available. In fact, a guilt bias was demonstrated by mock jurors when the only verdict options were guilty or not guilty, and a bias toward treatment was demonstrated when curative alternative verdicts were available. Implications for efforts to address the growing national problem of veterans with PTSD in the criminal justice system are discussed.  相似文献

Why and how do nations turn to religion to justify claims for statehood? This article addresses this question in both theory and practice, showing that religion plays multiple legitimating roles that shift dynamically according to the success they yield for national movements. I posit four legitimating models: (1) nationalism instead of religion (“secular nationalism”), (2) nationalism as a religion (“civil religion”), (3) religion as a resource for nationalism (“auxiliary religion”), and (4) religion as a source of nationalism (“chosen people”). Empirically, I analyze the roles of religion in Zionist efforts to legitimate a Jewish state in Palestine. I argue that Zionism has responded to persistent delegitimation by expanding the role of religion in its political legitimation. The right of self‐determination, which stands at the core of the “secular Zionism” legitimation, has given way to leveraging Judaism, which in turn has been eclipsed by constructing a Zionist civil religion and a “chosen people” justification.  相似文献

The chance objection to incompatibilist accounts of free action maintains that undetermined actions are not under the agent's control. Some attempts to circumvent this objection locate chance in events posterior to the action. Indeterministic-causation theories locate chance in events prior to the action. However, neither type of response gives an account of free action which avoids the chance objection. Chance must be located at the act of will if actions are to be both undetermined and under the agent's control. This dissolves the apparent paradox of Frankfurt-type cases as well as the chance objection to incompatibilist free will.  相似文献
