非法人体试验行为具有严重的社会危害性,而现行刑法又无法全面进行规制,致使该行为得不到公正的处理,影响了刑法预防犯罪目标的实现。根据犯罪化所应当具备的社会危害性、刑法谦让性原则等条件以及国际立法经验,建议刑法修正后增加非法人体试验罪,并参照非法行医罪的法定刑进行刑罚设置。 相似文献

This study investigates how neighborhood deterioration is associated with stress and depressive symptoms and the mediating
effects of perceived neighborhood social conditions. Data come from a community survey of 801 respondents geocoded and linked
to a systematic on-site assessment of the physical characteristics of nearly all residential and commercial structures around
respondents’ homes. Structural equation models controlling for demographic effects indicate that the association between neighborhood
deterioration and well-being appear to be mediated through social contact, social capital, and perceptions of crime, but not
through neighborhood satisfaction. Specifically, residential deterioration was mediated by social contact, then, social capital
and fear of crime. Commercial deterioration, on the other hand, was mediated only through fear of crime. Additionally, data
indicate that the functional definition of a “neighborhood” depends on the characteristics measured. These findings suggest
that upstream interventions designed to improve neighborhood conditions as well as proximal interventions focused on social
relationships, may promote well-being.

This study examined the patterns of drug use and criminal activities among Latino arrestees. The findings indicate that while the prevalence of drug use at time of arrest, and in the prior 12 months were significantly lower for Latinos compared to Whites and Blacks, drug use still is of concern for this ethnic group. Almost 50% of Latinos reported drug use in the last year, and more importantly, they were more likely to report using dangerous drugs such as cocaine, heroin, and PCP than any other ethnic group. These findings are even more alarming considering that, for the most part, Latino drug users were treatment-naive, and that less than half perceived a need for drug treatment. Regarding criminal activities, Latinos were less likely to have a history of prior arrests and to have been arrested in the year prior to the interview than any other ethnic group. Interestingly, those immigrants who have resided in the U.S. for less than 1 year were significantly more likely to have been charged with drug-related crimes. U.S. born Latinos were more likely to have been arrested for property crimes, while Central American immigrants were more likely than any other Latino group to have been arrested for violent and domestic violence crimes. Social disorganization at the neighborhood and community levels has been consistently linked to various forms of criminal activity. However, a very much smaller body of literature addresses the effects of crime on community organizations. In some studies, crime appears to energize communities while in others, crime leads to withdrawal from community life. Using department of health crime victimization data and interviews with 2,985 low-income inner city residents living in 487 multi-family dwellings, a multi-level model examined the relationships among crime victimization, social organization, and participation in neighborhood organizations. Social organization at the individual and building levels was measured using recent formulations of social capital theory. Findings regarding crime suggested more signs of a chilling effect on participation than of an energizing effect, especially at the building level. Social capital at the building level was more strongly and consistently related to participation in community organizations than was crime. 相似文献

The effects and side-effects of a victim assistance project aimed at victims of burglary are experimentally evaluated. Key features of the programme included the provision of burglary prevention information by police officers during a personal interaction with the victim through a positive and limitative communication strategy. Results suggest that important programme goals (for example, stronger satisfaction with police performance, a more internal risk orientation concerning victimization, stronger preventive intentions) were met. One of the positive effects for which experimental support was found was an improvement in police-victim relations. As regards side-effects the programme led neither to response generalization, nor to increased fear of crime outside the home. However, the side-effects of increased fear in the home did occur in female victims and victims with an external risk-orientation. The implications for future victim assistance projects in this domain are finally discussed. 相似文献

Guns figure prominently in American culture. There is, however, considerable variability in attitudes toward guns. The beliefs and feelings that comprise attitudes toward guns may well be important moderators of numerous social behaviors. For this reason, a three-dimensional attitudes scale was constructed. The first factor consists of an abstract set of beliefs concerning the right of the American public to own or not own guns. The second and third factors tap more concrete beliefs about the consequences of gun ownership. Specifically, the second factor assesses the degree to which people believe gun ownership affords protection against crime. The third factor measures the degree to which people believe guns stimulate crime. Discriminant validity of the subscales is shown by the pattern of correlations obtained with the three dimensions and various other social and personality measures. Regression analyses indicate that the subscales are uniquely predicted by different social variables. Discussion centers on the usefulness of such a measure for future research on aggression, social policy, and attitude change. 相似文献

This paper explores the ways in which national governments address the social inclusion of disadvantaged and disenfranchised groups in official strategy documents of the state. Data for this study come from a corpus of four key government strategy papers concerning Roma inclusion published by the Romanian Government between 2001 and 2015. This paper specifically looks at the ways in which strategy documents frame the problem of “crime” in the context of Roma inclusion. Texts were analysed using a critical frame analysis approach complemented by insights from discursive research. The findings highlight that although generally government policy on the Roma adopts and promotes a progressive/liberal agenda that aligns with EU strategic goals, pronounced ambivalence towards Roma people and subtle forms of racism are still present and persist. 相似文献

This research paper presents an examination of the journey to and from crime for auto‐theft offenders in the UK. For 852 offences, ‘wheel’ distances are calculated for triangles formed by offenders' home location, theft location, and vehicle disposal location. The study demonstrates typical isosceles mobility triangles; distances travelled to and from home locations are roughly equal, whereas distances between theft and disposal points were shorter. Distances travelled by offenders under 17 years old and offences involving drug and drink were shown to be shorter than comparison groups. In “Is Penalty Enhancement a Sound Idea?” Claudia Card calls into question hate crime legislation, querying whether hatred makes a crime worse, whether hatred of the sort pertinent to hate crimes is worse than a more personal hatred, and whether the message sent by hate crime legislation is the intended message. This essay questions her assumption that penalty enhancement for hate crimes is warranted only if the crimes are worse than otherwise similar crimes that do not count as hate crimes. Instead, it may be the case that it is the proper business of the state to take a particular interest in such crimes, in part because they enact not just any hatred but civic hatred. And if hate crimes are understood as enacting civic hatred, hate crime legislation can indeed serve to counter a message that very much needs to be countered. 相似文献

This article examines whether shared religious beliefs and religious social relationships (Durkheim) and belief in a personal, moral God (Stark) negatively affect attitudes toward the acceptability of white‐collar crime. In addition, using a large cross‐national sample and estimating multilevel models, we test whether effects are conditional on modernization and religious contexts characterized by belief in an impersonal or amoral God. Shared religious beliefs and the importance of God in one's life are negatively related to the acceptability of white‐collar crime. These effects, however, weaken in religious contexts characterized by belief in an impersonal or amoral God as do the effects of religious social relationships and belonging to a religious organization; modernization, on the other hand, does not have a moderating effect. In short, religious belief is associated with lower acceptance of white‐collar crime and certain types of religious contexts condition this relationship. 相似文献
