当代马克思主义法律理论的研究面临着从批判性导向向建设性导向的话语转换的需要。而传统马克思主义法律理论对法律规范意义的一贯抛弃态度,是实现话语转换的困难所在。本文通过回溯马克思的实践思想,发现否弃法律的规范意义并非马克思思想的固有逻辑。而籍由马克思实践思想中所蕴涵着的实践的内在张力性框架,可以把法律的规范意义容纳进来,并在此基础上开启出马克思主义法律理论研究谋求自身内部话语转换的可能和契机。 相似文献

In the present paper properties of theoretical response functions in the duration reproduction task (drt) are studied. If the drt response is to be interpreted as the measure of a temporal duration elapsed in the past, the reproduction function (rf) must be additively measuring. The additivity property is defined for bivariate rfs, taking into account the delay between retention and reproduction. The requirement that an rf be additively measuring leads to a system of two functional equations, which are solved by (i) linear functions of time, or (ii) functions of the form yielded by the ‘dual klepsydra model’ of duration reproduction [Wackermann, J., & Ehm, W. (2006). The klepsydra model of internal time representation and time reproduction. Journal of Theoretical Biology, 239, 482-493]. Four online grocery‐shopping experiments and one field study using video‐tracking technology at a grocery store document how shoppers’ motivation evolves from the beginning to the end of their shopping trips. We uncover unique motivational patterns as shoppers achieve multiple subgoals (i.e., choose multiple grocery items) to complete their trips: a monotonic decrease in motivation for shoppers with a shopping list versus a curvilinear trend (i.e., decrease then increase) in motivation for shoppers without a list. In addition, we demonstrate how to reverse the observed patterns for shoppers with a list by changing their reference points for tracking progress. The discovery of the moderating role of shopping‐list usage adds to the bubbling dialogue in goal pursuit and shopper psychology research concerning how consumer motivation follows either a monotonic trend (e.g., a goal gradient effect) or a nonmonotonic trend (e.g., the stuck‐in‐the‐middle effect). Importantly, we demonstrate how the stuck‐in‐the‐middle theory, which applies to single‐goal pursuits, can apply more broadly to the domain of grocery shopping, which consists of the generation and completion of multiple subgoals. 相似文献

In this article we address, on the basis of various knowledge in ergonomics, work psychology and work demography, the stakes of a confrontation between two trends in progress: on one side the structural ageing of workforce, on the other side work intensification, and intensification of changes at work. Time perspective research assesses the degree to which thoughts and feelings about the past, present and future influence behaviour, and a balanced time perspective profile has been posited as being ideal. Although this area of research has seen a move towards person‐centred analyses, using either cluster analyses or a deviation from balanced time perspective (DBTP) approach, there are a number of theoretical and methodological issues that must be addressed. Using data from diverse samples in four countries, the present study used both cluster analyses and the DBTP approach to assess how cluster membership and DBTP scores related to a range of health and well‐being outcomes. As in previous studies, a balanced profile only emerged once in cluster analyses, and positive‐oriented profiles were associated with optimal outcomes. The study also found evidence of a relationship between DBTP scores and scores on well‐being indicators. However, results gained after manipulating the DBTP equation in two different ways again indicated that higher than expected positive past and present or past and future scores were responsible for the positive outcomes. As such, these findings raise concerns regarding the use of the DBTP construct within clinical settings. 相似文献

The purpose of this essay is to determine how we should construe the content of memories. First, I distinguish two features
of memory that a construal of mnemic content should respect. These are the ‘attribution of pastness’ feature (a subject is
inclined to believe of those events that she remembers that they happened in the past) and the ‘attribution of existence’
feature (a subject is inclined to believe that she existed at the time that those events that she remembers took place). Next,
I distinguish two kinds of theories of memory, which I call ‘perceptual’ and ‘self-based’ theories. I argue that those theories
that belong to the first kind but not the second one have trouble accommodating the attribution of existence. And theories
that belong to the second kind but not the first one leave the attribution of pastness unexplained. I then discuss two different
theories that are both perceptual and self-based, which I eventually reject. Finally, I propose a perceptual, self-based theory
that can account for both the attribution of pastness and the attribution of past existence. 相似文献

The Preschool Behavioral and Emotional Rating Scale (PreBERS) is a standardized, norm-referenced instrument that assesses
the emotional and behavioral strengths of preschool children. Two studies that investigated the test–retest and inter-rater
reliability of the PreBERS are reported. In the first study, teachers rated preschool children (N = 96) on two occasions with 1 month between ratings. Reliability coefficients for the four subscales and total score of the
PreBERS were all at or above 0.86. In the second study teachers and paraprofessionals rated the same preschool children (N = 88). All of the correlations were over 0.72. In both studies the magnitude of correlations were large indicating that the
PreBERS is a stable measure across time and raters. Based on the data the PreBERS appears to be a psychometrically sound instrument
appropriate for use with preschool children. Recommendations for use with preschool children as well as future research are

I would like to deal with a process that numbers are generated by the interaction between consciousness and memory, associated
with time with a finite width. It is pointed out that this process can be related with the emergence of preafference. It is
concluded that only humans can create numbers, whereas animals simply produce ‘random’ sequences of symbols because they lack
intentionality to search for an appropriate internal observation window that makes intention and memory compatible.

Perception is an intentional action through space in time by which the finite brain explores the infinite world. By acting,
the brain thrusts its body into the future space–time of the world while predicting the sensory consequences. Through perceiving
its actions and their results, it remembers its predictions, its actions, and their consequences. To perform these operations
the brain, through chaotic dynamics, constructs and uses finite perceptual matrices of space–time and infers causation. Perceived
time differs from world time in ways that are determined by the neural mechanisms of intentionality. In particular, perception
of the self in action, through the mechanism of preafference, gives structure and content to the concepts of continuity, contiguity,
duration, temporal order, cause, and effect. We expand our perceptual scales beyond kinesthesia by converting time into space
by use of clocks and calendars. Remembered time differs from perceived time in being dependent on awareness, which makes it
episodic, fragmentary, and subject to large variations in rates of time lapse in the flow of meanings. The attribution of
causal agency to objects and events in the world results from the experience of temporal sequencing in the action–perception
cycle: “I act” [cause] “I feel” [effect] during Piaget’s somatomotor phase in early human development.

In this essay, Perraudin sets out to contrast the competing philosophies of time and imagination of two major French thinkers
of the twentieth century: Henri Bergson (1859–1941) and Gaston Bachelard (1884–1962). Despite Bachelard’s polemical approach
vis-à-vis philosophical tradition in his works on epistemology and poetics, his accounts of time and imagination have been
shown by several critics to be significantly influenced and inspired by his predecessor. Perraudin nonetheless argues that
Bachelard’s critique of Bergson’s theory of continuous temporality opens the way—through the subtle dialectics of his “philosophy
of no”—to more prolific, and as yet untapped, therapeutic possibilities in our understanding of time and imagination than
Bergson’s accounts of continuum of the élan vital had managed to reveal.
