Legal positivism’s multi-faceted insistence on the separability of law and morality includes an insistence on the thoroughly conventional status of legal norms as legal norms. Yet the positivist affirmation of the conventionality of law may initially seem at odds with the mind-independence of the existence and contents and implications of legal norms. Mind-independence, a central aspect of legal objectivity, has been seen by some theorists as incompatible with the mind-dependence of conventions. Such a perception of incompatibility has led some anti-positivist theorists to reject the notion of law’s conventionality, and has led some positivist theorists to query law’s mind-independence. What will be contended here is that both camps are mistaken.

Organisms’ environments are thought to play a fundamental role in determining their fitness and hence in natural selection. Existing intuitive conceptions of environment are sufficient for biological practice. I argue, however, that attempts to produce a general characterization of fitness and natural selection are incomplete without the help of general conceptions of what conditions are included in the environment. Thus there is a “problem of the reference environment”—more particularly, problems of specifying principles which pick out those environmental conditions which determine fitness. I distinguish various reference environment problems and propose solutions to some of them. While there has been a limited amount of work on problems concerning what I call “subenvironments”, there appears to be no earlier work on problems of what I call the “whole environment”. The first solution I propose for a whole environment problem specifies the overall environment for natural selection on a set of biological types present in a population over a specified period of time. The second specifies an environment relevant to extinction of types in a population; this kind of environment is especially relevant to certain kinds of long-term evolution.  相似文献

This paper investigates the classification of shapes into broad natural categories such as animal or leaf. We asked whether such coarse classifications can be achieved by a simple statistical classification of the shape skeleton. We surveyed databases of natural shapes, extracting shape skeletons and tabulating their parameters within each class, seeking shape statistics that effectively discriminated the classes. We conducted two experiments in which human subjects were asked to classify novel shapes into the same natural classes. We compared subjects’ classifications to those of a naive Bayesian classifier based on the natural shape statistics, and found good agreement. We conclude that human superordinate shape classifications can be well understood as involving a simple statistical classification of the shape skeleton that has been “tuned” to the natural statistics of shape.  相似文献

This paper reviews the psychological investigation of reasoning with conditionals, putting an emphasis on recent work. In the first part, a few methodological remarks are presented. In the second part, the main theories of deductive reasoning (mental rules, mental models, and the probabilistic approach) are considered in turn; their content is summarised and the semantics they assume for if and the way they explain formal conditional reasoning are discussed, in particular in the light of experimental work on the probability of conditionals. The last part presents the recent shift of interest towards the study of conditional reasoning in context, that is, with large knowledge bases and uncertain premises.  相似文献

This study explored pathways through which hurricane-related stressors affected the psychological functioning of elementary school aged children who survived Hurricane Katrina. Participants included 184 mothers from the New Orleans area who completed assessments one year pre-disaster (Time 1), and one and three years post-disaster (Time 2 and Time 3, respectively). Mothers rated their children's behavior problems at Time 3 only (n = 251 children; 53.0% male; mean age: 10.19 years, SD = 1.68 years). A path analytic model indicated that hurricane-related stressors were associated with increased maternal psychological distress and school mobility in the first post-disaster year, which were associated with higher child internalizing and externalizing symptoms three years post-disaster. Mediation analysis indicated that hurricane-related stressors were associated with child symptoms indirectly, through their impact on maternal psychological distress. Findings underscore the importance of interventions that boost maternal and child mental health and support children through post-disaster school transitions.  相似文献

The new Copenhagen School of Deep Incarnation posits that, in Jesus Christ, God has become incarnate and therefore present “in, with, and under” all physical and biological processes. This claim raises the issue of “compatibilism,” according to which divine action and creaturely action are compatible, and “incompatibilism,” according to which divine action must be absent to allow for free creaturely action. Niels Henrik Gregersen, representing the Copenhagen School, affirms both compatibilism at the quantum level of physical activity and incompatibilism at the level of nature's self‐organization. A well-established principle of language is that there is a preference for closely related words to be close together in the sentence. This can be expressed as a preference for dependency length minimization (DLM). In this study, we explore quantitatively the degree to which natural languages reflect DLM. We extract the dependencies from natural language text and reorder the words in such a way as to minimize dependency length. Comparing the original text with these optimal linearizations (and also with random linearizations) reveals the degree to which natural language minimizes dependency length. Tests on English data show that English shows a strong effect of DLM, with dependency length much closer to optimal than to random; the optimal English grammar also has many specific features in common with English. In German, too, dependency length is significantly less than random, but the effect is much weaker than in English. We conclude by speculating about some possible reasons for this difference between English and German.  相似文献

We consider connections between number sense—the ability to judge number—and the interpretation of natural language quantifiers. In particular, we present empirical evidence concerning the neuroanatomical underpinnings of number sense and quantifier interpretation. We show, further, that impairment of number sense in patients can result in the impairment of the ability to interpret sentences containing quantifiers. This result demonstrates that number sense supports some aspects of the language faculty.

What makes two images look similar? Here we test the hypothesis that perceived similarity of artwork is related to basic image statistics to which the early visual system is attuned. In two experiments, we employ multidimensional scaling (MDS) analysis of paired-image similarity ratings from observers for paintings. Two sets of images, classified as “landscapes” and “portraits/still-life”, are tested separately. For the landscapes, we find that one of the first two MDS scales of similarity is strongly correlated with a basic greyscale image statistic, whereas the other dimension can be accounted for by a semantic variable (representation of people). For portrait/still-life, the first two MDS scales of similarity are most highly correlated with semantic variables. Linear combinations of statistical and nonstatistical features achieve improved predictive values for the first two MDS scales for both sets. The statistics that play the largest role in shaping similarity judgements in our tests are the activity fraction measure of sparseness and the log-log slope of the spatial frequency amplitude spectrum. We discuss these results in the context of scene perception and in terms of efficient coding of statistical regularities in scenes.  相似文献

Representational momentum (RM) refers to the tendency of participants to “remember” the stopping point of an event as being farther along in the direction of movement than it was in reality (Freyd & Finke, 1984). Our aim was twofold: (1) Test for the impact of domain-specific expertise (here, automobile driving) on RM, using films of road scenes, and (2) find out whether the improved anticipation ability that comes with greater expertise is transferred to scenes from domains that are far-removed from the person's domain of expertise. Two experiments were conducted in which experienced and inexperienced automobile drivers performed a movement-anticipation task on realistic road scenes (Experiment 1), with stimuli that were very different from those found in their domain of expertise (Experiment 2). These studies pointed out some properties of representational momentum, and showed that RM is dependent upon knowledge acquired by participants in specific domains. Our research also showed that expertise in automobile driving can modulate RM in road-scene perception (i.e., the cognitive characteristics of the observer can modulate the magnitude of the RM effect) but that expertise in automobile driving is not transferred to dissimilar domains.  相似文献
