鼓起源于上古时代,秦汉以前鼓作为重要的器具广泛应用在祭祀、军事、役事、金奏场合之中,凸显中华民族的文化内涵。成书于西汉中后期的《黄帝内经》集合了古代先贤生活、医疗的实践经验,虽主要内容以医理为主,然蕴含丰富的古代科学与哲学思想,汇集了中华民族的文明智慧。《黄帝内经》中出现“鼓”字43次,共涉及20个篇章。以《黄帝内经》“鼓”为切入点,系统梳理分析其内涵,包含病名、病机、表现、诊断、疗效五个部分。旨在深刻体会经文中以“鼓”为喻体,将其形、音、态、质等特性与部分医理相比拟,加深对经旨的理解与感悟。

为病患代购管制药品的案件在刑法上往往面临情与法的冲突。司法机关不愿意、却不得不定罪,只能在量刑时突破法律框架,尽量从轻。在刑法的实质解释下,为病患代购管制药品不成立贩卖毒品罪、非法经营罪或妨害药品管理罪,应处无罪。在刑事个案中,“情理”虽不能直接介入,但对刑法体系的适用具有批判功能。当“法理”分析的结论与公众的法直觉相违背时,应当检讨“法理”之适用过程是否出错,使刑事个案体现刑法正义,实现情与法的统一。

综合认知模型(Integrative Cognitive Model, ICM)整合多个相关理论, 探讨在敌意情境下不同特质愤怒水平的个体反应性攻击行为出现差异的内部认知机制, 构建了敌意解释、反思注意和努力控制三个核心认知加工过程之间的关系模型。该模型具有结构清晰、易于操控等特点, 对该领域的实证研究与理论探索具有启发意义, 并有巨大的应用价值。该理论仍缺乏囊括更多因素的综合实证研究支持, 以及有关的神经生理研究和心理干预探索, 这将是未来研究的重要方向。  相似文献

本研究分别在短时(60ms)和长时(无时间限制)条件下呈现匹配的正性和中性面孔,要求高、低社交焦虑被试选择更具威胁性的面孔,以验证两者对正性刺激是否存在主观解释偏差,并考察该偏差产生于认知加工的哪一阶段。结果发现,长时条件下,高焦虑组选择正性面孔的比例显著高于低焦虑组;短时条件下无显著差异。提示高社交焦虑个体对正性刺激存在主观、外显的解释偏差,他们更倾向于对正性刺激做出消极解释,并且这种偏差产生于认知加工的后期。  相似文献

本文包括长时记忆视优效应的三项实验。实验一使用汉语为学习材料,北京人与广东人为被试;实验二使用英语为学习材料、美国人与中国人为被试;实验三使用日语为学习材料、日本人为被试。三项实验都有视觉、听觉两种呈现方式。三项实验的结果都有利于证明频率差异假设,即如果在书面言语中经验某字词的频率高于在口语中经验该字词的频率,则该字词的视觉呈现优于听觉呈现。  相似文献

There are several branches of ethics. Clinical ethics, the one closest to medical decisionmaking, can be seen as a branch of medicine itself. In this view, clinical ethics is a unitary hermeneutics. Its rule is a guideline for unifying other theories of ethics in conjunction with the clinical context. Put another way, clinical ethics interprets the clinical situation in light of a balance of other values that, while guiding the decisionmaking process, also contributes to the very weighting of those values. The case itself originates ideas, not only about which value ought to predominate in its resolution, but also provides the origin of clinical rules that can be used in other cases. These are interpretive rules. Some examples of these rules are presented as well.  相似文献

This paper argues against particularism about social criticism of the form presented by Walzer. I contend that while limitation of the scope of criticism depends on the existence of our shared meanings, which are not shared by them, shared meaning itself depends on society. So, an account of society showing that societies are not discrete and mutually inaccessible refutes particularism. I argue for such an account. I deal with the objection that the focus of particularism is culture, not society, and conclude that the conditions of possibility of shared meaning have anti-particularist consequences. This paper answers the question how pragmatic argumentation which occurs in a legal context, can be analyzed and evaluated adequately. First, the author surveys various ideas taken from argumentation theory and legal theory on the analysis and evaluation of pragmatic argumentation. Then, on the basis of these ideas, she develops a pragma-dialectical instrument for analyzing and evaluating pragmatic argumentation in a legal context. Finally she demonstrates how this instrument can be used by giving an exemplary analysis and evaluation of pragmatic argumentation in a decision of the Dutch Supreme Court.  相似文献

In this article I show how the concept of intertextuality as developed by Mikhail Bakhtin, Julia Kristeva and Jacques Derrida can be applied to the political theory of constitutionalism. Such an approach carries with it the valuable democratic idea that all texts in society, including the political constitution, are in a dynamic relationship and reflect social pluralism. By analyzing and comparing intertextual theories, I develop the idea of the constitution as an open and emancipatory interpretative and textual category. I show how intertextual theorizing contributes significantly to the democratization of a modern liberal constitutional order, offering distinct strategies for progressive political and social transformation.  相似文献

This paper traces the similarities between the cluster of influences that informed my own training and practice as a British developmental Jungian analyst and those that led to the creation of intersubjective and relational analysis in America. Having outlined five main themes of relational analysis, I show how these were anticipated by several trends in British analysis, especially the work of R.D. Laing and the theory of couple interaction developed by the Institute of Marital Studies at the Tavistock Centre in London. I then show the parallels between relational thinking and Jung's approach to clinical practice and discuss some of the dilemmas around the analyst's subjectivity and personal participation in the analytic relationship that are common to both traditions. My aim is to show that a relational approach to the practice of Jungian analysis is both ‘traditional’ and ‘radical’, being rooted in the traditions of the past while opening up pathways towards future development and clinical innovation.  相似文献
