This paper considers a guardianship model for the legal representation of future generations. According to this model, national and international courts should be given the competence to appoint guardians for future generations, if agents who care about the welfare of posterity apply for the creation of a guardianship in relation to a dispute that can be resolved by the application of law. This reform would grant guardians of future people legal standing or locus standi before courts, that is, the right to bring an action before a court of law for adjudication. Although the guardianship model faces several difficult theoretical and practical problems pertaining to the representation of different near and distant future generations, it is argued that this model – and certain other legal norms intended to protect future basic needs – can be justified on the basis of the principle of liberty.  相似文献

In this essay I argue that Mozi’s philosophy is anything but utilitarianism by way of analysing four ethical theories. Utilitarianism is an ethics in which the moral subject is an atomic individual human being, and its concern is how to fulfill the interests of the individual self and the social majority. Confucian ethics is centered on the notion of the family and its basic question is that of priority in the relationship between the small self and the enlarged or collective self. Opposite to these two moral theories is Mozi’s ethics: The interests that Mozi is primarily concerned with are not the interests of my individual self or my collective self, but the interests of the other. The fulfillment of the material needs of the other is my moral obligation. The arguments are centered on the three basic concepts, “the I,” “the we,” and “the other.” The significance of Mozi’s thought in modern or postmodern context lies in its striking resemblance to the philosophy of a contemporary western philosopher, Levinas. Abstract. The concept of contingency serves to bridge the doctrine of creation and natural science in Wolfhart Pannenberg's theology. My paper first analyzes the relation of creatio ex nihilo and creatio continua. Next I suggest three categories of contingency: global, local, and nomological. Under each category I assess Pannenberg's use of physics, cosmology, and philosophy of science. Although I agree with Pannenberg's emphasis on continuous creation and on the role of science in renewing the doctrine of creation, I argue for a shift in the discussion from Pannenberg's topics to others, such as the anthropic principle, quantum physics, and thermodynamics.  相似文献

Abstract. John D. Barrow and Frank J. Tipler's recently published Anthropic Cosmological Principle is an encyclopedic defense of melioristic evolutionary cosmology. They review the history of the idea from ancient times to the present, and defend both a "weak" version, and two "strong" versions of the anthropic principle. I argue the weak version of the anthropic principle is true and important, but that neither of the two strong versions are well grounded in fact. Their "final" anthropic principle is a revision of Teilhard de Chardin's evolutionary cosmology. They rectify Teilhard's factual errors but commit even more serious psychological and religious errors of their own.  相似文献

A component method is presented maximizing Stewart and Love's redundancy index. Relationships with multiple correlation and principal component analysis are pointed out and a rotational procedure for obtaining bi-orthogonal variates is given. An elaborate example comparing canonical correlation analysis and redundancy analysis on artificial data is presented.A Fortran IV program for the method of redundancy analysis described in this paper can be obtained from the author upon request.  相似文献

Three experiments examined an application of the matching law to the area of reinforcement relativity. In Experiment I, rats ran in a wheel and drank a sucrose solution. Equations derived from the matching law made fairly accurate predictions of the amounts of time spent running and drinking when licks and wheel revolutions had to occur in fixed proportions. In Experiment II, rats were required to spend four times as much time drinking as running, but the absolute durations of the cycles of drinking and running were varied. Except for the shortest cycle size tested, durations were close to those predicted. Experiments III investigated a tendency for obtained durations of running and drinking to be slightly longer than predicted. Simply shortening the periods when these behaviors were available increased their values. It was concluded that the matching law equations provided reasonably accurate predictions in some experiments, but changes in motivation set the limits of such accuracy.  相似文献

Towards a reconstruction of philosophical hermeneutics. Following Nietzsche, Heidegger and, on the other hand, Cassirer and Wittgenstein, a philosophy of interpretation, i.e. a relativism of world-views, is at present increasing in continental as well as in analytical philosophy. From the basis of a critical fallibilism the shortcomings of the new epistemological antirealism are pointed out in general, and, hence, consequences are drawn for the more specialized case of metahermeneutics (hermeneutics being defined as a sort of pragmatical semiotics). A combination of realistic and antirealistic elements is recommended as unevitable. According to this, firstly, the key-concepts of hermeneutics must be differentiated, and, secondly, a fundamental set of criteria can be established that bridges the gap between metahermeneutics and hermeneutical practice.

The dominance principle states that one should prefer the option with consequences that are at least as good as those of other options for any state of the world. When applied to judged prices of gambles, the dominance principle requires that increasing one or more outcomes of a gamble should increase the judged price of the gamble, with everything else held constant. Previous research has uncovered systematic violations of the dominance principle: people assign higher prices to a gamble with a large probability of winning an amount, Y, otherwise zero, than they do to a superior gamble with the same chance of winning Y, otherwise winning a small amount, X! These violations can be explained by a configural-weight theory in which two-outcome gambles are represented with two sets of decision weights; one set for outcomes having values of zero and another set for lower-valued outcomes that have nonzero values. The present paper investigates whether dominance violations are limited to two-outcome gambles. Results show that people violate the dominance principle with three-outcome gambles even with financial incentives. Furthermore, results could be predicted from the configural-weight theory. The data do not support the view that configural weighting is caused by a shift in strategy that would apply only to two-outcome gambles.  相似文献

Abstract. Central to the work of Arthur Peacocke on science and religion is the intention to develop a reasonable faith within an intelligible framework of meaning. Showing the inadequacy of reductionism is necessary for this purpose. Knowledge of God is related to what science can tell us about creation. From an evolutionary framework, characterized as a delicate balance that issued in humans, and manifested through contingency and chance, God's actions are expressed as exploring the potentialities of creation. The creation is understood to be in God, but God is more than the world, as in panentheism. God suffers with the creation in love, and the focus of human meaning is expressed in Jesus Christ, the Incarnation, the sacrament of God.  相似文献
