Previous research has shown that certain interviewer behaviors can evoke inaccurate answers by children. In the current study, we examined the effects of approving and disapproving statements on the accuracy of 3 children's answers to questions in an interview (Experiment 1). We then evaluated 3 questioning techniques that may be used by interviewers during a forensic interview in which a child provides eyewitness testimony (Experiment 2). All participants responded with more inaccurate answers when approving statements followed inaccurate information and disapproving statements followed accurate information in Experiment 1. During Experiment 2, 1 participant responded most inaccurately when she was requestioned after providing an initial answer, whereas the remaining 2 participants responded most inaccurately when the interviewer provided cowitness information and suggestive questions. 相似文献

Evidence about a suspect's behavioural similarity across a series of crimes has been presented in legal proceedings in at least three different countries. Its admission as expert evidence, whilst still rare, is becoming more common thus it is important for us to understand how such evidence is received by jurors and legal professionals. This article reports on a qualitative analysis of mock jurors' deliberations about expert linkage analysis evidence. Three groups of mock jurors (N = 20) were presented with the prosecution's linkage analysis evidence from the USA State v. Fortin I murder trial and expert evidence for the defence constructed for the purposes of the study. Each group was asked to deliberate and reach a verdict. Deliberations were video‐recorded and subject to thematic content analysis. The themes that emerged were varied. Analysis suggested that the mock jurors were cautious of the expert evidence of behavioural similarity. In some cases they were sceptical of the expert. They articulated a preference that expert opinion be supported using statistics. Additional themes included jurors having misconceptions concerning what is typical offender behaviour during rape which suggests there is a need for expert linkage analysis evidence regarding behavioural similarities and the relative frequencies of crime scene behaviours. Each year, numerous children testify in the United States in either criminal, civil, or juvenile court cases. Typically, children who testify are alleged victims of sexual or physical abuse or neglect, witnesses to violent crime, or subjects in custodial hearings in civil court. As more maltreatment cases are prosecuted and child custody is contested, an increasing number of children are being called as witnesses in court. Many of these children have already been traumatized by the experiences that led to their need to testify, and participation in the court process can have additional negative effects. This article describes the development and recent formative evaluation of a court preparation program that provides psychoeducation and utilizes components of evidence-based trauma treatment approaches, such as relaxation and in vivo exposure, to support child witnesses and reduce the risk of retraumatization. Children and adolescents participating in the program attend group sessions conducted by mental health clinicians and complete a court-related anxiety measure before and after each session. Results from 175 participants are reported. Findings indicated significant decreases in court-related anxiety with large program effects. Challenges encountered by the program and future directions are discussed. 相似文献

AbstractWhy do we trust TV news? What reasons might support a recipient’s assessment of the trustworthiness of this kind of information? This paper presents a veritistic analysis of the epistemic practice of news production and communication. The topic is approached by discussing a detailed case study, namely the characteristics of the most popular German news programme, called the ‘Tagesschau’. It will be shown that a veritistic analysis can indeed provide a recipient with relevant reasons to consider when pondering on the trustworthiness of sources of information. Moreover, it will turn out that these reasons are part of what recipients might gather from media literacy. 相似文献

Summary This paper studies some classic cases of the fallacy of begging the question based on appeals to testimony containing circular reasoning. For example, suppose agents a, b and c vouch for d’s credentials, and agents b, d, and e vouch for a’s credentials. Such a sequence of reasoning is circular because a is offering testimony for d but d is offering testimony for a. The paper formulates and evaluates restrictions on the use of testimonial evidence that might be used to deal with such problematic arguments. One is called the Non-repeater Rule: in an extended sequence of argumentation based on testimony, once a source x has been appealed to at any given point in the sequence, that same source x must never be appealed to again at any next point in the same sequence. 相似文献

There is a vast and growing literature in psychology demonstrating the general limits of human judgment and clinical inference. These findings clearly apply in the new specialty of clinical neuropsychology, and there is little empirical research to support the widespread belief that judgmental accuracy correlates substantially with experience, professional stature, or reputation as a neuropsychologist. However, the demand characteristics of expert testimony in the forensic arena may encourage individual neuropsychologists to state or intimate that they have unique or special expertise in understanding brain-behavior relationships, or in predicting outcomes following cerebral insult or injury. These claims will be increasingly difficult to substantiate as attorneys become more conversant with the literature on human judgment. 相似文献

The present study aims to investigate to which extent global cognition and verbal memory can estimate interrogative suggestibility (IS) in elderly people with subjective cognitive complaints (SCCs). We used the Gudjonsson Suggestibility Scale (GSS 2) subscales (i.e., Yield 1, Yield 2 and Shift) as measures of IS. Data from a sample of consecutive patients (N = 94) who referred to neuropsychology units for the first time were collected.Our results showed that verbal memory is a better predictor of IS than global cognition. Moreover, memory impairment led to significantly higher IS independently of global cognitive status. These findings suggest that the assessment of verbal memory allows to estimate individual levels of IS better than global cognition, even in elders with objective cognitive deficits. Implications for forensic assessment of senior witnesses are discussed. 相似文献

IntroductionEyewitness identification research has mainly examined the identification accuracy of a single perpetrator but many actual crimes involve not one but several perpetrators.ObjectiveThe aim of the study was to examine the identification accuracy if only one lineup for one of the two perpetrators is presented in a multiple perpetrator crime.MethodThe sample consisted of 180 participants who saw a theft video followed by distraction tasks. One group of participants saw lineups for both of the perpetrators (one target present and one target-absent) whereas the other saw only a single lineup (either target-present or target-absent) for one of the two perpetrators.ResultsParticipants who saw a single lineup did not make more inaccurate identification decisions then participants who saw two lineups. Decision accuracy in the first lineup was not associated with the decision accuracy in the second lineup.ConclusionThe results are discussed in terms of the number of perpetrators and line-up presentation types. 相似文献

This review of children's testimony focuses on research related to memory for past experiences. The aspects of the memory system that are involved in testimony are discussed and the development of autobiographical memory is examined. Relevant research findings are summarized in the context of an information-processing model of memory and the implications of this work for clinical practice are outlined. We conclude that (1) under certain conditions, even very young children can remember and report past experiences with some accuracy over very long periods of time; (2) substantial and significant developmental differences have been demonstrated in children's abilities to provide eyewitness testimony; (3) children can be influenced in a variety of ways to provide complete and elaborated reports of events that never occurred; and (4) even experts cannot always tell the difference between true and false reports. 相似文献
