Over the last years several European patents were opposed for protecting technology violating the morality requirement under Article 53(a) EPC. Attempts have been made by the Appeal Boards of the European Patent Office (EPO), as well as by amendments introduced into the Implementing Regulations of the European Patent Convention (EPC), to address this sensitive patentability requirement more precisely. The most recent hot topic coming up in this context is the patentability of stem cells. It is to be expected that this discussion will still go on in the field of biotechnological inventions for the next several years. An earlier version of this paper was presented at an international conference, “The Ethics of Intellectual Property Rights and Patents,” held in Warsaw, Poland on 23–24 April, 2004.  相似文献

Habermas proposes a new solution to the problematic relation between republican values and democracy. He asserts that a new model of social cohesion is needed and he suggests that the sense of community in a democratic society should be founded exclusively on the acceptance and support of a system of constitutionally established rules which are the logical result of the historical evolution of constitution-making. He argues that an account of the constitutional process which led to the formation of the modern republican state should provide the criteria for a rational set of norms which will exclude nationalism from the political arena. Are there distinctly European values in bioethics, and if there are, what are they? Some Continental philosophers have argued that the principles of dignity, precaution, and solidarity reflect the European ethos better than the liberal concepts of autonomy, harm, and justice. These principles, so the argument goes, elevate prudence over hedonism, communality over individualism, and moral sense over pragmatism. Contrary to what their proponents often believe, however, dignity, precaution, and solidarity can be interpreted in many ways, and it is not clear which reading would, or should, be favored by popular opinion. It is therefore dangerous to think that any one understanding of "European", or any other, values could be legitimately imposed on those who have different ideas about morality in health care and related fields. Bioethical principles should be employed to promote discussion, not to suppress it.  相似文献

This overview of the contributions to the special edition illustrates something of how the collection of papers reflects the marginal nature of therapeutic communities, and makes parallels as to how they are forever struggling to survive, yet generate a passion of ideas and intellectual resilience that no project-managed health service can extinguish. It briefly describes the theoretical and geographical terrain covered, and signals how the cross-disciplinary incorporation of congruent ideas can be added to the traditional bedrock of therapeutic community practice. It ends by stating the context of the new, and seemingly successful, organization which assembled these contributions into its inaugural conference – and suggests that the journey could, and ultimate should, go further.  相似文献

This article analyzes the polemic on the concept of al-walā? wa-al-barā? (commonly translated as “loyalty and disavowal”). While existing academic literature focuses on the usages of this concept by jihad activists, the article centers on the role “loyalty and disavowal” plays in debates between contemporary salafī and wasa?ī jurists and theologians, specifically in their conflicting agendas for Muslims living as minorities. Salafīs, relying on several qur'anic verses and Prophetic traditions, promote an understanding of “loyalty and disavowal” that requires Muslims to refrain from befriending or loving non-Muslims, or imitating their beliefs and customs. Relying on counter-verses and traditions, in particular Q 60.8, wasa?īs have interpreted the concept of “loyalty and disavowal” more narrowly, arguing that it applies only to non-Muslims who fight against Muslims; as part of their integration-oriented doctrine for Muslims in the West, they have in recent years dedicated considerable efforts to refuting the salafī interpretation of al-walā? wa-al-barā?. The article examines the juristic methodologies utilized in the debate, and how it has affected religious decisions (fatwās) on Islamic life in Western societies.  相似文献

Religion is a major driving force in the Dutch political system and as European integration has progressed, it is often argued that these national practices affect how national representatives act in the European Parliament (EP). Our aim in this study is to determine to what extent the religious divide impacts upon the work of Dutch MEPs in the European political arena. On the basis of the RelEP survey and interviews, we argue that religious or secular views are very salient to Dutch MEPs, but that their impact is largely indirect. Moreover, we find that Dutch MEPs actively use the EP and its committee system in an attempt to redefine the relationship between church and state in the Netherlands. And finally, we argue that the European arena offers new opportunities for mobilisation among those promoting secularist interests.  相似文献

Italy is a predominantly Catholic country that developed historically on the basis of a strong, dominant religion and weak state institutions. Yet, openly clerical parties, direct advocates of the interests of the Catholic Church, have nowadays virtually disappeared and the relevance of the religious cleavage is decreasing, in favour of a more indirect support for these interests, mainly among moderate and conservative forces. Although the overall level of secularisation in Italy has increased, the degree of religiosity of Italian society remains one of the highest of the 27 member-states of the European Union (EU) and polarisation over religious issues in domestic politics remains high, particularly regarding moral values and family matters. In our study we explore the role of religion within the Italian political sphere with regard to the functioning of political representation, by taking into account the sub-national, national and European levels of government. We focus on the attitudes and behaviours of Italian political elites at the EU level. We hypothesise a strong influence of religion on the articulation between national and European politics. Our findings consistently show that the degree of religiosity of the Italian delegation to the European Parliament (EP) is high. However, the impact of such a high degree of religiosity among the members of the EP (MEPs) on their political activities appears less direct than one might predict, while the degree of political secularism is higher among Italian MEPs than among their national or regional counterparts. When we discuss a case study, namely the accession of Turkey to the EU, our data show that the religious attitudes of Italian MEPs play a crucial role in their stance on Turkish accession. The picture that emerges is thus nuanced. Religion significantly impacts on Italian MEPs’ ideological, political and moral attitudes, but plays a smaller role in their activities; while their left-right collocation emerges as the most relevant predictor, despite a number of exceptions.  相似文献

This study aims to investigate the relationship between several job design variables and innovative work behaviour (IWB). Guided by the Job Demands Resources model, the aim was to evaluate the relationship between work demands (time constraints), resources (autonomy and social support), and other work factors (task monotony, complexity, and dealing with unforeseen circumstances) with idea generation and idea implementation behaviours in a sample of 12,924 participants from the 27 European Union member states in 2010. We also wished to investigate if individual IWB, at the country level, is associated with country innovative performance (an aggregate of process/product and marketing/organizational innovation). We employed a multilevel generalized structural equation model to test our hypotheses. In our final model autonomy, manager encouragement and dealing with unforeseen problems showed the highest positive relationship with idea generation and idea implementation. Conversely, monotonous tasks and working at high speed were negatively related to IWB. Furthermore, we have found strong indications that country-level IWB positively relates to the odds of a country scoring higher on the aforementioned innovation indicators. Between-country unexplained variance in IWB was reduced from 17.1% in our initial model, to 1.9% in our final iteration. Limitations, implications and suggestions for future research are discussed.  相似文献

Abstract

Cross-border mobility is one of the most important factors that are assumed to strengthen young people’s commitment as European citizens. However, the existing empirical evidence does not provide consistent support. In this paper, we tested the hypothesis that cross-border mobility is associated with a stronger European identification, more positive attitudes toward the EU, and with specific visions of the EU, and that these factors, in turn, have a positive effect on engagement at EU level. Data were collected as part of the multinational research project CATCH-EyoU. Analyses were performed controlling for gender, income, country, and migrant status. Results mostly confirmed the hypotheses among both adolescents and young adults, and for both short-term and long-term mobility. EU level participation and EU voting intentions appeared to be influenced by partly different factors. The implications of the findings, both at theoretical level and for the development of international mobility programs, are discussed.  相似文献

Abstract

European Union countries are participatory and representative democracies. Therefore, active citizenship in the EU and trust in EU institutions are paramount for the continuation and the strengthening of the EU project. Young Europeans who hold the future in their hands need to be actively engaged not only in the social and political life within their national communities, but also in the wider European community. The papers in this special issue examine whether and how European youth identify with the EU, trust EU institutions and engage in EU issues, and which societal and proximal-level contexts and/or individual-level attributes promote or hinder young people’s active citizenship in European context. They are based on results from the Horizon 2020 CATCH-EyoU project, standing for Constructing AcTive CitizensHip with European Youth: Policies, Practices, Challenges and Solutions. Scientists represent different disciplines (Psychology, Political Science, Sociology, Media and Communications, Education) and from eight European countries (Sweden, Estonia, U.K., Germany, Czech Republic, Greece, Portugal, Italy). Together, the papers contribute to the development of a new, cutting-edge conceptualization of youth active citizenship in the EU, and to a better understanding of the factors promoting or inhibiting young EU citizens’ engagement, participation and active citizenship at the European level.  相似文献
