This article demonstrates that our more sophisticated theories of law lead us to a point where we are no longer able to distinguish
law from culture, or society, or the market, or politics or anything of the sort. Not only are the various terms inextricably
intertwined (something that other thinkers have observed) but we are no longer in a position to articulate any relations between
these various terms at all. It is with this latter realization that the dedifferentiation problem kicks in. Because the various
terms cannot be disentangled, we find ourselves in the odd position where there is nothing of any positive character to be
said about their relations. Each is already the other and, thus, they can have no relation. This is rather bad news for the
ways in which we have traditionally conceived theories of law—indeed any theory that gets off the ground by distinguishing
law from a discrete something else (which, on first glance, would seem to include all legal theory).

A number of people have suggested that there is a link between information integration and consciousness, and a number of algorithms for calculating information integration have been put forward. The most recent of these is Balduzzi and Tononi’s state-based Φ algorithm, which has factorial dependencies that severely limit the number of neurons that can be analyzed. To address this issue an alternative state-based measure known as liveliness has been developed, which uses the causal relationships between neurons to identify the areas of maximum information integration. This paper outlines the state-based Φ and liveliness algorithms and sets out a number of test networks that were used to compare their accuracy and performance. The results show that liveliness is a reasonable approximation to state-based Φ for some network topologies, and it has a much more scalable performance than state-based Φ. 相似文献

Contingency is an important cue to causation. Research shows that people unequally weight the cells of a 2 × 2 contingency table as follows: cause-present/effect-present (A) > cause-present/effect-absent (B) > cause-absent/effect-present (C) > cause-absent/effect-absent (D). Although some models of causal judgement can accommodate that fact, most of them assume that the weighting of information is invariant as a function of whether one is assessing a hypothesized generative versus preventive relationship. An experiment was conducted that tested the hypothesis-independence assumption against the predictions of a novel weighted-positive-test-strategy account, which predicts hypothesis dependence in cell weighting. Supporting that account, judgements of hypothesized generative causes showed the standard A > B > C > D inequality, but judgements of hypothesized preventive causes showed the predicted B > A > D > C inequality. The findings reveal that cell weighting in causal judgement is both unequal and hypothesis dependent. 相似文献

equations approaches to causation face deep problems. The most philosophically interesting of these consists in their failure
to incorporate a distinction between default states of an object or system, and deviations therefrom. Exploring this problem,
and how to fix it, helps to illuminate the central role this distinction plays in our causal thinking.

Cultural disparity – the variation across cultural traits such as knowledge, skill, and belief – is a complex phenomenon, studied by a number of researchers with an expanding empirical toolkit. While there is a growing consensus as to the processes that generate cultural variation and change, general explanatory frameworks require additional tools for identifying, organizing, and relating the complex causes that underpin the production of cultural disparity. Here I develop a case study in the cognitive science of religion and demonstrate how concepts and distinctions drawn from work on contrastive explanation and manipulationist accounts of causation provide such tools for distinguishing explanatory levels, organizing causal narratives, and accounting for cross-cultural patterns. 相似文献

Ordinary people often make moral judgments that are consistent with philosophical principles and legal distinctions. For example, they judge killing as worse than letting die, and harm caused as a necessary means to a greater good as worse than harm caused as a side‐effect ( Cushman, Young, & Hauser, 2006 ). Are these patterns of judgment produced by mechanisms specific to the moral domain, or do they derive from other psychological domains? We show that the action/omission and means/side‐effect distinctions affect nonmoral representations and provide evidence that their role in moral judgment is mediated by these nonmoral psychological representations. Specifically, the action/omission distinction affects moral judgment primarily via causal attribution, while the means/side‐effect distinction affects moral judgment via intentional attribution. We suggest that many of the specific patterns evident in our moral judgments in fact derive from nonmoral psychological mechanisms, and especially from the processes of causal and intentional attribution. 相似文献

If someone brings about an outcome without intending to, is she causally and morally responsible for it? What if she acts intentionally, but as the result of manipulation by another agent? Previous research has shown that an agent's mental states can affect attributions of causal and moral responsibility to that agent , but little is known about what effect one agent's mental states can have on attributions to another agent. In Experiment 1, we replicate findings that manipulation lowers attributions of responsibility to manipulated agents. Experiments 2–7 isolate which features of manipulation drive this effect, a crucial issue for both philosophical debates about free will and attributions of responsibility in situations involving social influence more generally. Our results suggest that “bypassing” a manipulated agent's mental states generates the greatest reduction in responsibility, and we explain our results in terms of the effects that one agent's mental states can have on the counterfactual relations between another agent and an outcome. 相似文献

This paper presents an attempt to integrate theories of causal processes—of the kind developed by Wesley Salmon and Phil Dowe—into
a theory of causal models using Bayesian networks. We suggest that arcs in causal models must correspond to possible causal
processes. Moreover, we suggest that when processes are rendered physically impossible by what occurs on distinct paths, the
original model must be restricted by removing the relevant arc. These two techniques suffice to explain cases of late pre?mption
and other cases that have proved problematic for causal models.

In light of the latest proposals of regularity theories, the paper at hand therefore reassesses the criticism raised against regularity accounts since the INUS theory of causation of Mackie (The cement of the universe. A study of causation. Oxford: Clarendon Press, 1974). It is shown that most of these objections target strikingly over-simplified regularity theoretic sketches. By outlining ways to refute these objections it is argued that the prevalent conviction as to the overall failure of regularity theories has been hasty. 相似文献
