Burden of proof     
This paper presents an analysis of the concept of burden of proof in argument. Relationship of burden of proof to three traditional informal fallacies is considered: (i) argumentum ad hominem, (ii) petitio principii, and (iii) argumentum ad ignorantiam. Other topics discussed include persuasive dialoque, pragmatic reasoning, legal burden of proof, plausible reasoning in regulated disputes, rules of dialogue, and the value of reasoned dialogue.  相似文献

This paper is concerned with the processing of informal arguments, that is, arguments involving probable truth. A model of informal argument processing is presented that is based upon Hample's (1977) expansion of Toulmin's (1958) model of argument structure. The model postulates that a claim activates an attitude, the two components forming a complex that in turn activates reasons. Furthermore, the model holds occurrence of the reason, or possibly the claim and the reason, activates values. Three experiments are described that provide support for the model.This research was supported by the Mellon Foundation and by the Office of Educational Research and Improvement of the Department of Education via an award for the Center for the Study of Learning to the Learning Research and Development Center. Existing religious economy models maintain that as religious regulation increases, levels of interreligious competition decrease. But new understandings of the market dynamics of religious oligopolies necessitate new understandings of religious competitiveness. A relational model of competitiveness using the case of evangelical Christianity in Buddhist‐majority Sri Lanka is proposed. In Sri Lanka the informal religious economy is defined by competitiveness among evangelical Christian groups and, although not recognized by the state, is closely regulated. The focus in this article is on the scalar determinations of evangelical competitiveness, patterns of secrecy and subterfuge, the formation of strategic extra‐group networks that enable competitiveness, and outcomes of a relational model. Three insights are offered that can be used as a starting point for further work on religious oligopolies, informal economies, and relational understandings of religious competition.  相似文献

Although research has found a positive relationship between various forms of adolescent religious involvement and educational outcomes, little research has examined connections to educational attainment. Using a nationally representative sample of youth (the National Longitudinal Study of Adolescent Health—Add Health), we examine the extent to which adolescent religiosity facilitates educational attainment (i.e., high school completion and college enrollment) and whether informal mentorships formed during adolescence with religious and nonreligious adults can help explain the link between adolescent religious involvement and educational attainment. The findings confirm that, like academic outcomes, religious youth are more likely to complete high school and enroll in college even when controlling for other individual and interpersonal factors that affect educational attainment. Furthermore, informal mentorships, particularly those with adults who have official religious positions (e.g., priest, minister, rabbi) play an important role in college enrollment.  相似文献

Problems with regard to the analysis of argumentative partly discourse arise from definitorial disconformity. In this article, Informal argument is taken as the primary definition to study the basic structure of argument from a fragment of an Agatha Christie novel. Bilmes' account of the notions of Formulation (F) and Decision (D+/D-) are adapted to describe the relations of opposition which are displayed in informal argument. The minimal structure of argument is represented by the formula F/D-/D-, in which F is a speaker's personal composition of a fact, the first D- is the disconfirming uptake of it by another speaker and the second D- is the completing disconfirming uptake by the initial speaker. Some of the speaker's possibilities to initiate an argument by expressing a Formulation are explored, as well as the social and cultural norms which play a role in argument-initiation and the concepts of win and loss.  相似文献

This article shows that there are square circles (or equivalently, round squares) in the sense that there are mathematical objects that are at the same time both perfectly circular and perfectly square. The philosophical significance of this is discussed, especially in view of philosophy's widespread use of “square circle” as a typical example of an impossibility. In particular, the focus is on what the existence of square circles means for the possibility of conceptual analysis, and more generally what we can learn about the nature of non‐formal concepts and their use in philosophy.  相似文献

This essay explores the role of informal logicand its application in the context of currentdebates regarding evidence-based medicine. This aim is achieved through a discussion ofthe goals and objectives of evidence-basedmedicine and a review of the criticisms raisedagainst evidence-based medicine. Thecontributions to informal logic by StephenToulmin and Douglas Walton are explicated andtheir relevance for evidence-based medicine isdiscussed in relation to a common clinicalscenario: hypertension management. This essayconcludes with a discussion on the relationshipbetween clinical reasoning, rationality, andevidence. It is argued that informal logic hasthe virtue of bringing explicitness to the roleof evidence in clinical reasoning, and bringssensitivity to understanding the role ofdialogical context in the need for evidence inclinical decision making.  相似文献

Fallacies     
Fallacies are things people commit, and when they commit them they do something wrong. What kind of activities are people engaged in when they commit fallacies, and in what way are they doing something wrong? Many different things are called fallacies. The diversity of the use of the concept of a fallacy suggests that we are dealing with a family of cases not related by a common essence. However, we suggest a simple account of the nature of fallacies which encompasses them all, viz., the term “fallacy” is our most general term for criticizing any general procedure used for the fixation of beliefs that has an unacceptably high tendency to generate false or unfounded beliefs, relative to that method of fixing beliefs. Very different sorts of things called fallacies are examined in the light of this account, e.g., denying the antecedent, circular arguments, so-called informal fallacies, and propositions said to be fallacies. We do not provide a theory of fallacies. Still, on our account pretty much all of those things that have been called fallacies are fallacies, and they have been called fallacies for pretty much the same reasons.  相似文献

The changing aims of psychoanalysis are discussed with reference to Money-Kyrle's paper on the subject. The theory of dammed-up libido, the theory of moral conflict and the theory of misrepresentations and perversion of reality which he described, all imply different aims. It is argued that, in addition, the theory of projective identification leads to a radical change in the aim of treatment which can now be formulated in terms of helping the patient regain lost parts of the self.  相似文献
