The current study examined the relationship between juror cognitive processing (measured by need for cognition [NFC]), attorney credibility, evidence strength, and civil litigation verdicts (liability, likelihood of causation, and compensatory damages). Participants (N = 446) viewed a videotaped mock civil trial in which the credibility of the attorneys and the strength of the plaintiff's evidence were manipulated. Plaintiff attorney credibility, defense attorney credibility, and strength of evidence interacted with one another for liability verdicts. In the strong evidence condition, the likelihood of a liable verdict was higher for a credible plaintiff attorney than a non‐credible plaintiff attorney when facing a non‐credible defense attorney. In the ambiguous evidence condition, the likelihood of a liable verdict was higher for a credible plaintiff attorney than a non‐credible plaintiff attorney when facing a credible defense attorney. Plaintiff attorney credibility, however, was found to be more influential on jurors’ decision‐making than case evidence for likelihood of causation and compensatory damage award decisions. Participants’ NFC also interacted with plaintiff attorney credibility. High NFC jurors were more influenced by a credible plaintiff attorney than low NFC jurors. Although these findings are counter to common findings in the NFC literature, they conform to a body of literature that supports the notion that jurors view attorney credibility as a piece of case evidence and not a peripheral cue as is often assumed. Thus, the findings indicate that attorneys do matter to the outcomes of cases. Policy and practice implications for attorneys and the courts are discussed. 相似文献

It is common for politicians to refer to “our proud history of supporting refugees,” yet the historical record regarding responses to refugees is not straightforwardly positive. So how is history drawn upon in political debates regarding refugees? Applying discursive psychology, this article analyzes the use of history in five U.K. parliamentary debates that took place from September 2015 to January 2016 on the European refugee “crisis.” The analysis identifies six “functions” of the use of the history: resonance, continuity, reciprocity, posterity, responsibility, and redemption. It shows how references to historical events create narratives regarding the United Kingdom’s history of supporting refugees in order to construct the nation in particular ways, mobilize collective identities, and legitimize or criticize political actions. Specifically, references to the United Kingdom’s role in providing refuge to Jewish refugees fleeing Nazi Germany functions as a hegemonic narrative that reinforces the United Kingdom’s “heroic” position and constructs the Syrian conflict as involving an oppressive dictator and innocent refugees in need to help, thereby legitimizing support for Syrian refugees. The analysis demonstrates the flexibility of historical narratives, reformulates the distinction between “psychological” and “rhetorical” uses of historical analogies, and reflects on the social and political implications of such uses of history. 相似文献

This study examined the spatial and temporal limitations of the visual corrective process in the control of upper limb movements. Real-time calculation of kinematic data was used to trigger a prismatic displacement of the movement environment during manual aiming. Using an OptoTrak motion tracking system, a data acquisition unit, and a custom-made program, perturbations were triggered at peak acceleration, peak velocity, and the estimated time of peak deceleration. Movement outcome was significantly influenced only when the visual displacement occurred at peak acceleration. The results support models of visual control that posit that early visual information is required for accurate limb control. 相似文献

Many tasks have been used to probe human directional knowledge, but relatively little is known about the comparative merits of different means of indicating target azimuth. Few studies have compared action-based versus non-action-based judgments for targets encircling the observer. This comparison promises to illuminate not only the perception of azimuths in the front and rear hemispaces, but also the frames of reference underlying various azimuth judgments, and ultimately their neural underpinnings. We compared a response in which participants aimed a pointer at a nearby target, with verbal azimuth estimates. Target locations were distributed between 20 degrees and 340 degrees. Non-visual pointing responses exhibited large constant errors (up to -32 degrees) that tended to increase with target eccentricity. Pointing with eyes open also showed large errors (up to -21 degrees). In striking contrast, verbal reports were highly accurate, with constant errors rarely exceeding +/-5 degrees. Under our testing conditions, these results are not likely to stem from differences in perception-based versus action-based responses, but instead reflect the frames of reference underlying the pointing and verbal responses. When participants used the pointer to match the egocentric target azimuth rather than the exocentric target azimuth relative to the pointer, errors were reduced. 相似文献

Skousen's (1989, Analogical modeling of language, Kluwer Academic Publishers, Dordrecht) Analogical Model (AM) predicts behavior such as spelling pronunciation by comparing the characteristics of a test item (a given input word) to those of individual exemplars in a data set of previously encountered items. While AM and other exemplar-based models enjoy continuing success in their ability to predict what a participant's response to a given task will be, it does not yet include a widely tested mechanism for extending its predictions to other measures of interest in psycholinguistics such as response time (RT). This article reports the results of applying a formula derived in Estes (1959, in: Koch, Psychology: A study of a science, McGraw-Hill Book Co., Inc.) for approximating "mean predicted latency" in decision tasks to the alternative responses and their associated probabilities predicted by AM. Two studies investigated the psychometric properties of a self-report measure of commonly recognized forms of aggression (FOA) that could be used to efficiently gather aggression data in large samples. EFA and CFA in Study 1 suggested that a five-factor model (Physical, Property, Verbal, Relational, and Passive-Rational) best represented the data across high school and college students. However, factor analyses in Study 2 using an ethnically diverse university sample revealed a four-factor solution (combining Physical and Property items). As a confirmation of the construct validity of FOA, physical and property aggression were lower, and verbal and passive-rational aggression were higher in college versus high school students. Gender differences were observed across FOA subscales, except relational aggression. FOA subscales correlated as expected with other anger and personality scales. Overall, the data revealed adequate psychometric properties for the FOA and suggest that current category distinctions (e.g., direct-indirect) may not adequately account for different forms of aggression. Contending with negative intellectual stereotypes has been shown to depress the academic performance of targets of the stereotypes [Steele, C. M. (1997). A threat in the air: How stereotypes shape intellectual identity and performance. American Psychologist, 52, 613-629]. The present paper examines whether women’s mathematics performance is differentially affected by the concern of confirming that a negative stereotype is true of the self (self-threat), than by the concern of confirming that the stereotype is true of their gender (group-threat). In two studies we independently manipulated these different threats for women taking a mathematics test. Gender identification moderated the effect of group-threats on test performance; only women highly identified with their gender underperformed. The performance of less gender-identified women was unaffected by group-threats. In contrast, gender identification did not moderate the effect of self-threats—both high- and low-identified women underperformed. The results of these studies suggest that women’s math performance is differentially affected by the source of the threat. 相似文献

Most studies that examine the prediction of graduation status among teens have examined those who attend regular high schools. The present study reports the prediction of high school graduation status 5 years later among 646 youth who attended alternative (continuation) high schools at baseline. Those youth at baseline who: (a) reported less intention to use soft drugs (cigarettes, alcohol, or marijuana) during the next year; (b) suffered relatively few drug‐related consequences during the last year; (c) were relatively less likely to have carried a weapon (knife or gun) in the last year; (d) reported feeling relatively hopeful about the future; and (e) were older were more likely to self‐report having graduated continuation high school 5 years later. These results suggest that the consequences of drug use, not drug use per se, other illegal behavior, and a sense of well‐being are important predictors of graduation among groups of high‐risk teens. Problem behavior and resiliency theories are offered as potential explanations of these findings. 相似文献
