In Chandler v. Florida (1981), the U.S. Supreme Court ruled that the presence of television cameras in the courtroom does not violate a defendant's constitutional right to a fair trial. Since then, several states have expanded their TV coverage rights, and the controversy has intensified. The present study tested opponents' argument that TV cameras distract jurors, thereby reducing their reliance on evidence in the decision-making process. Fifty-one community adults watched a 95-min videotape of a civil trial in the presence or absence of a camera. No effects were obtained on verdicts, awards, or a series of self-report measures. The camera did impair subjects' recall of the evidence, but this effect was dually limited—(a) consistent with an adaptation hypothesis, an initially strong distractive effect gradually diminished, resulting in a net post-trial loss of information that was not statistically significant, and (b) consistent with an individual differences hypothesis, the camera impaired the recall of subjects who were low but not high in dispositional public self-consciousness. These findings were discussed in terms of their practical implications for courtroom management and their contribution to the self-awareness literature.  相似文献

We examined whether observers' beliefs about deception were affected by a speaker's language proficiency. Laypersons (N = 105) and police officers (N = 75) indicated which nonverbal and verbal behaviors were predictive of native versus non-native speakers' deception. In addition, they provided their beliefs about these speakers' interrogation experiences. Participants believed that native and non-native speakers would exhibit the same cues to deception. However, they did predict that non-native speakers would likely face several challenges during interrogations (e.g., longer interrogations and difficulties understanding the interrogator's questions). Police officers and laypersons also differed in their beliefs about cues to deception and interrogation experiences.  相似文献

As illustrated by the mistaken, high-profile fingerprint identification of Brandon Mayfield in the Madrid Bomber case, and consistent with a recent critique by the National Academy of Sciences (2009), it is clear that the forensic sciences are subject to contextual bias and fraught with error. In this article, we describe classic psychological research on primacy, expectancy effects, and observer effects, all of which indicate that context can taint people's perceptions, judgments, and behaviors. Then we describe recent studies indicating that confessions and other types of information can set into motion forensic confirmation biases that corrupt lay witness perceptions and memories as well as the judgments of experts in various domains of forensic science. Finally, we propose best practices that would reduce bias in the forensic laboratory as well as its influence in the courts.  相似文献

We tested whether counterfactuals are made spontaneously outside of the laboratory by coding sportscasters’ online verbalizations during 1998 and 1999 Major League Baseball (MLB) playoff broadcasts, and we assessed whether naturally occurring game features relating to closeness (score closeness, series closeness, game end, and playoff end) delineated some conditions under which counterfactuals were more likely. Sportscasters made counterfactuals quite frequently during these MLB playoff games. In addition, sportscasters uttered greater numbers of counterfactuals as games progressed from early to late innings, which was particularly true when scores were close. Counterfactuals were also uttered in greater numbers with closer scores when series were tied than when one team had a lead. Results are discussed in terms of spontaneous counterfactuals, closeness as an antecedent, and the ecological validity of such thoughts.  相似文献

Two experiments were conducted to examine the effect of the mental retardation (MR) label on impression formation among retarded and nonretarded children and adolescents. The first experiment, conducted with nonretarded children in a mainstreamed school, indicated that they have pessimistic expectations of retarded children with regard to cognitive and ability-related behaviorsand, to a lesser extent, social behaviors (i.e., getting married). However, their reactions were not as pessimistic nor as “patronizing” as were those demonstrated by college students in previous research. In the second experiment, mentally retarded adolescents indicated that they also have negative behavioral expectations of retarded children, however, their self expectations were negative only for social behaviors. The results suggest that, among retarded persons, the expectations associated with the MR label are negative for social behavior, but apparently less pessimistic for cognitive and ability related tasks.  相似文献

Basic psychology research suggests the possibility that confessions-a potent form of incrimination-may taint other evidence, thereby creating an appearance of corroboration. To determine if this laboratory-based phenomenon is supported in the high-stakes world of actual cases, we conducted an archival analysis of DNA exoneration cases from the Innocence Project case files. Results were consistent with the corruption hypothesis: Multiple evidence errors were significantly more likely to exist in false-confession cases than in eyewitness cases; in order of frequency, false confessions were accompanied by invalid or improper forensic science, eyewitness identifications, and snitches and informants; and in cases containing multiple errors, confessions were most likely to have been obtained first. We believe that these findings underestimate the problem and have important implications for the law concerning pretrial corroboration requirements and the principle of "harmless error" on appeal.  相似文献

Confession evidence is highly incriminating in court. We examined the interaction between chronotype and time of day on the confession decisions of 60 participants using an experimental paradigm. Pre-identified morning- and evening-type people were randomly assigned to participate in morning or evening sessions. Results supported an interactional asynchrony hypothesis that individuals are more likely to confess during “off-peak” periods (i.e., evening-types in the morning and morning-types in the evening). This interaction was obtained for both high- and low-seriousness transgressions. These results suggest that chronotype asynchrony constitutes a significant risk factor for false confessions and the wrongful convictions that often follow.  相似文献
