Legal Audiences     
This paper approaches legal argumentation from a rhetorical perspective. It discusses the nature of the audiences that are (and should be) targeted by judges in the legal process. Judicial opinions reach diverse groups of people with very different attitudes and expectations: other judges, lawyers, litigants, concerned citizens, etc. One important way in which these groups differ is that some of them are more likely to be persuaded by legalistic, precedent or statute-based arguments, while others expect judges to decide on grounds of justice or equity. So, judges face the challenge of determining whether they should select particular groups for special attention, or whether they have alternative rhetorical means to approach the problem of audience diversity. One strategy that is likely to be recommended by rhetorical scholars is that judges should not try to accommodate the various preferences of their actual readership, but that they should rather invoke an idealized audience or some version of Chaïm Perelman’s universal audience. However, the paper tries to show that the universal audience is of limited value for a discussion about how judges ought to proceed in the face of audience diversity. In particular, the idea of a universal audience does not help judges to make the choice between a legalistic or an equity-based approach to legal decision-making. By showing that this is so, the paper also raises doubts about the common thought that to invoke the universal audience in law is to appeal to natural law (as distinct from written, positive law).  相似文献

The present study examined the validity of a self-report parenting instrument for use with Mexican adolescents. The 13-item measure was adapted from the Mexican Parenting Questionnaire. The sample included 1123 adolescents (M age?=?15.07, SD?=?1.52) from Puebla, Mexico. Adolescents self-reported on six subscales of parenting (i.e., affection, verbal guidance, monitoring, communication, physical punishment and verbal punishment), as well as on measures of school grades, life satisfaction, familism, depressive and anxiety symptoms. Using confirmatory factor analyses, the original constructs were found to be a good fit with the data. Most subscales consisted of moderate levels of internal consistency and predicted several measures of adolescent adjustment in expected directions. Girls were more likely to report higher levels of monitoring, affection, and communication than boys. Adolescents who were younger and who reported lower school grades were more likely to report greater levels of physical punishment. Familism was positively associated with five of the six parenting dimensions (i.e., affection, verbal guidance, monitoring, physical punishment, and communication). Findings advance understanding on families and adolescent well-being in Mexico and may inform culturally competent services for clinicians who work with Mexican families.  相似文献

This article urges counseling psychology researchers to recognize and report how missing data are handled, because consumers of research cannot accurately interpret findings without knowing the amount and pattern of missing data or the strategies that were used to handle those data. Patterns of missing data are reviewed, and some of the common strategies for dealing with them are described. The authors provide an illustration in which data were simulated and evaluate 3 methods of handling missing data: mean substitution, multiple imputation, and full information maximum likelihood. Results suggest that mean substitution is a poor method for handling missing data, whereas both multiple imputation and full information maximum likelihood are recommended alternatives to this approach. The authors suggest that researchers fully consider and report the amount and pattern of missing data and the strategy for handling those data in counseling psychology research and that editors advise researchers of this expectation.  相似文献

Cognitive style is a well-established theoretical construct but there is considerable ambiguity in the way it has been used and uncertainty regarding the nature of its role in suicide. There is no evidence that specific cognitive dispositions prime people for suicide but there are indications that suicide is associated with a constriction in cognitive style. This constriction leads to decrements in problem-solving and information processing that can be addressed in therapeutic contexts. To help a suicidal person become a better problem-solver is not a trivial task but the evidence suggests that enriching cognitive styles through the development of thinking skills is possible when the therapy session is construed as a learning collaboration.  相似文献

The author has noted some inefficiencies in the operation of the DF32 hardware/software disk system on the PDP-8. While such inefficiencies are not significant when the disk is used only as a store for programs which are called into core from the keyboard, they become important when the disk is used as a real-time backup for core. This paper isolates some of the problems, gives rules for avoiding them, and then describes how the system software was modified to obey these rules. The speed of the modified system is noticeable even when SAVEing and CALLing programs from the keyboard; successive blocks can be transferred between disk and core in one-fifth the previously required time.  相似文献

It is noted that the average inter-item correlation, which represents the internal consistency of a test, yields a unique estimate of test reliability. A close approximation to this average is given by a formula which requires the correlation of each item with the total score and the standard deviation of each item. The Social Phobia Safety Behaviours Scale (SPSBS) is a measure designed to identify and assess safety behavior use. The current study is the first to evaluate the psychometric properties of the English SPSBS. Using four samples (N?=?725), the component structure, validity, and ability of the SPSBS to function as a state measure were examined. The results of the principal component analyses suggest that the SPSBS is a two-component measure, consisting of an inhibitory behavior component and a management of physical symptoms component, and the scale has good internal consistency. The SPSBS also showed good concurrent validity in both clinical and nonclinical samples. Moreover, there was evidence to suggest that the SPSBS is an accurate measure of situational use of safety behaviors as compared to observers’ ratings. The results of this investigation show that the SPSBS is a useful tool for the identification and measurement of safety behaviors.  相似文献
