This paper offers a critical analysis of two central issues in Luigi Ferrajoli’s Principia iuris, and more generally of his theory of rights. One is the way in which ‘expectations’ play a crucial role in his deontic theory
by establishing the logical basis for his guarantee-based conception of law and rights. The axiomatic way in which Ferrajoli
arrives at his conception of fundamental rights is questioned, for it fails to give a full account of the nature of subjective
rights. The other issues discussed here is Ferrajoli’s own defence of the universality of fundamental rights, and how this
is made to depend on a ‘normative technique’ that one can associate with legal discourse and modern law in Western societies.
This, however, poses the problem of how this formal universalism can be reconciled with the intercultural dialogue that Ferrajoli

Within the framework of knowledge space theory, a probabilistic skill multimap model for assessing learning processes is proposed.
The learning process of a student is modeled as a function of the interaction between his competence state and the effect
of a learning object on specific skills. Model parameters are initial probabilities of the skills, effects of learning objects
on gaining and losing the skills, careless error, and lucky guess probabilities of the problems. A simulation study assessed
model identifiability and goodness-of-recovery under several conditions. Practical implications of using the model are discussed,
and the MATLAB code for simulating, estimating and testing it is available in the Psychonomic Society supplemental archive. 相似文献

There is surmounting evidence in the literature demonstrating that social pain (e.g. rejection, humiliation, and isolation) and physical pain (e.g. injury or assault) overlap in personal experiences. The present investigation focuses on second‐hand perceptions of social and physical pain. We argue that judgments of others' pain may vary as a function of group membership. By integrating research on intergroup bias in pain judgment with intergroup attributions of humanity, we predicted that observers tend to underestimate social pain more than physical pain in out‐groups compared with in‐groups. Across two studies that considered different scenarios, we found that Italian participants attributed less severe social pain when considering an out‐group (Chinese and Ecuadorian) than an in‐group member. No such effect was found for physical pain. Overall, the current work suggests an additional way through which people preserve a privileged human status to in‐group members while denying out‐group members' humanness. Although Latinas have consistently reported higher rates of suicidal behavior for the past 20 years (CDC, 1996), there is a dearth of information regarding their help‐seeking attitudes and behaviors when dealing with distress and suicide. Associations between adolescents' ideation and help‐seeking from adults were different for non‐Hispanic Whites and Latinos from 14 high schools (N = 4,983). Among females, ideators and Latinas reported lower levels of help‐seeking attitudes than nonideators and non‐Hispanic Whites. Males showed interaction effects of ideation by race/ethnicity on help‐seeking. Within sex by race/ethnicity, differences showed that while non‐Hispanic White students reported consistent differences between suicidal ideation and no reported suicidal ideation, Latinos were more similar between these groups, particularly with having support from friends and family to seek help from adults. Research should clarify how culture contributes to decreased help‐seeking norms among those with suicidal ideation. 相似文献

ABSTRACT When two motions appear to be causally related, the spatiotemporal features of motions are sometimes distorted in order to increase the consistency with causal impressions. Here, in four experiments, we tested if varying the speed of an object A could affect the judged speed of an object B that appeared to be causally related to A. Participants were presented with classic launching stimuli (Experiment 1), a variant of launching stimuli in which A could move with uniformly accelerated or decelerated motion (Experiment 2), non-launching stimuli that elicited a causal impression (Experiment 3), and stimuli showing a three-object launching event (Experiment 4). Main results showed that the judged speed of B was systematically biased towards the speed of A, and moreover that the judged speed of B depended on the average speed of A, rather than on the speed of A at the moment of collision as it would be predicted by Newtonian mechanics. The results are consistent with the hypothesis that internal representations of causal events based on property transmission (for instance, impetus) can affect judgments of the low-level properties of causal scenarios. 相似文献

AbstractThe concepts of borders, tensegrity and goal-oriented meaningful conduct are used to study the conditions in which affects and conducts can (or cannot) emerge in urban spaces. We assume psychological phenomena are liminal and emerge in the border zones between different individual and collective states. The main focus of the study is the process of affective meaning-making that takes place at specific locations (the border zones) in urban living. Through an example of autoethnography, we try to understand how the symbolic space is used in everyday life to produce, maintain and demolish signs that self-regulate and hetero-regulate complex atmospheres, affects and conducts. 相似文献
