试论现代法制环境下的行政调解

现代法制环境下行政调解仍然具有强大的吸引力。在中国由于行政调解具有强烈的公权力干预色彩,因此很容易导致非自愿与“廉价正义”。现代法制环境下的行政调解,必须发挥行政机关管理与救济的功能,正视行政机关在处理纠纷中的地位,通过促成纠纷各方合意的形成,达成彻底解决争端的目的。     

A parameter analysis method for the weight‐set to satisfy preference orders of alternatives in additive multi‐criteria value models

In the context of the additive multi‐criteria value model, this paper investigates how the set of criteria weights (weight‐set hereafter) can be determined according to the preference orders of alternatives given by the decision maker. A construction method is proposed for the weight‐set for different intervals of β, where β is a differential amount of value between the preference information on two alternatives. The results of this paper are important for sensitivity analysis in multi‐criteria decision making (MCDM) problems and multi‐criteria group decision analysis. Emotion Dysregulation and Affective Intensity Mediate the Relationship Between Childhood Abuse and Suicide‐Related Behaviors Among Women with Bulimia Nervosa

Self‐harm and suicide attempts occur at elevated rates among individuals with bulimia nervosa, particularly among those who have experienced childhood abuse. This study investigated the potential mediating roles of emotion dysregulation and affective intensity in the relationship between these variables in 125 women with bulimia nervosa. Analyses revealed that emotion dysregulation mediated the relationship between sexual and emotional abuse with both self‐harm and suicide attempts. Negative affective intensity mediated the relationship between abuse and suicide attempts. The findings may advance the understanding of mechanisms underlying suicide‐related behaviors in women with bulimia nervosa who experienced abuse and suggest potential clinical targets.     

亚里士多德的形式-质料关系与功能性质料和构成性质料的区分——论J.惠廷对形质关系的调和解释

对于亚里士多德的形式-质料关系似乎存在着两种相矛盾的解释.一种解释认为质料的存在独立于形式,二者的关系是偶然的,这主要体现在运动理论中;另一种认为质料的存在依赖于形式,二者的关系是必然的,这主要体现在身体与灵魂的关系中.亚里士多德是否持有两种相矛盾的质形论呢?或者这两种看似矛盾的理论是否可以调和?J.惠廷提供了一种调和解释,她认为功能性质料和构成性质料的区分可以解决这个矛盾.然而,这种调和解释是不成功的,不仅因为她的几个重要的预设都不成立,更是因为根本不存在需要调和的矛盾.亚里士多德的质形关系只有一种,而矛盾的产生则源于我们对于质料概念的误解.
