司法论证充分性辨析

司法论证充分性问题是一个和法学理论与司法实践都密切相关的问题,各种关于法律论证的争议是和规则治理与纠纷解决两种司法职能的互相冲撞息息相关的。什么样的法律论证才是最合适的,在法律资源有限的情况下,如何运用有限的资源达到司法实践的目的,是各国法制建设的一个永恒话题。文章试图以我国的司法情景为例,从理性思考与现实实践两个层面,展示法官在裁决中所运用的具有地方性知识性质的辅助资源具有实践合理性,说明司法论证应该也必须追求其充分性。     

31例眼睑恶性肿瘤切除后Ⅰ期修复的总结

眼睑恶性肿瘤切除术后,眼睑修复时机的选择,对保持眼睑功能和美容的效果起着十分重要的作用,术式的选择是决定手术成功关键。采用眼睑全层缺损行异体巩膜片移植,替代睑板、滑行球结膜瓣前徙替代睑结膜的眼睑再造术,对31例眼睑恶性肿瘤切除,同时进行眼睑再造术。术后无排斥反应,眼睑闭合良好,外形满意。结论认为,较大范围的眼睑恶性肿瘤切除的患者,采用异体巩膜片移植、滑行结膜瓣前徙眼睑再造术能达到保持眼睑功能和美容的效果,是理想的眼睑恶性肿瘤切除后Ⅰ期修复临床决策。     

Prediction of goal orientation and perceived competence on intensity and direction of precompetitive anxiety among adolescent handball players

This study explored the main and interactive effects of goal orientations and perceived competence on intensity and direction of the symptoms of precompetitive cognitive and somatic anxiety. 109 handball players from 16 high school teams (M = 16.2 yr., SD = 1.5) participated. All were asked to complete the Task and Ego Orientation in Sport Questionnaire, Perceived Competence Questionnaire, and a modified version of the Competitive State Anxiety Inventory-2. Using separated multiple hierarchical regression analyses, direction of the symptoms of precompetitive somatic anxiety was predicted by perceived competence and interaction of ego orientation x perceived competence. Perceived competence and the interaction of ego orientation x task orientation x perceived competence were significant predictors of direction of the symptoms of precompetitive cognitive anxiety. The results suggest that perceptions of competence and task orientation moderate the relationship between ego orientation and direction of the symptoms of precompetitive anxiety.     

Reliability and validity of Job Content Questionnaire in Chinese petrochemical employees

To evaluate psychometric properties the Chinese (mainland) version of the 30-item Job Content Questionnaire was administered to 889 employees in 4 industries of PetroChina. A retest at 3 months with 296 randomly chosen employees showed reliabilities ranged from .76 to .93. Cronbach coefficients alpha for the 8 dimensions ranged from .43 to .88, indicating that the Job Insecurity subscale had low internal consistency. Exploratory factor analysis showed 8 meaningful factors corresponding to the 8 theoretical dimensions of this questionnaire. This version has variable a but suitable retest to be a reliable and valid measure of job strain, applicable to the Chinese industrial working population of PetroChina.     

Mediating effect of cooperative norm in predicting organizational citizenship behaviors from procedural justice climate

Although the relationships between procedural justice climate and organizational citizenship behaviors have been examined in recent years, little research has explored the mechanism by which procedural justice climate shapes individual employee prosocial behaviors in the workplace. The purpose of this study was to examine the mediating role of a group-level cooperative norm on the relationships between the group-level procedural justice climate and individual-level organizational citizenship behaviors. The survey involved 45 work groups in four different industry fields in Taiwan, including manufacturing, technology, banking, and insurance, and each of the groups was composed of one supervisor and three subordinates. Cross-level analyses using hierarchical linear modeling (HLM) indicated that the cooperative norm fully mediated the relationship between procedural justice climate and individual helping behaviors. Procedural justice climate indirectly affects individual helping behaviors through their effects on the cooperative norm.
