This study investigated the impact of personal and organizational factors and performance appraisal methods on 53 Age Discrimination in Employment Act (ADEA) federal court cases. Discriminant analysis suggested that the employer was most likely to be the successful party when the employee was younger, particularly between 40-49 years old. Appraisal system characteristics which in previous studies were found to be significantly related to case outcome, were not reported in these case decisions. Traditional legal case analysis was used to explore the relationship of performance appraisal methods and the personnel action giving rise to the complaint. 相似文献

Many metaphysicians tell us that our world is one in which persisting objects are four‐dimensionally extended in time, and persist by being partially present at each moment at which they exist. Many normative theorists tell us that at least some of our core normative practices are justified only if the relation that holds between a person at one time, and that person at another time, is the relation of strict identity. If these metaphysicians are right about the nature of our world, and these normative theorists are right about what justifies our normative practices, then we should be error theorists about the justification of at least some of our core normative practices and in turn, arguably we should eliminate those practices for which justification is lacking. This paper offers a way of resolving the tension between these two views that does not lead into the grips of error theory. It is a way that is amenable to “exceptionists” about persons: those who think there is something special about persons and the first‐person perspective; that personhood cannot be explained naturalistically, and the first‐person perspective is naturalistically irreducible. The conclusion is thus a conditional: given that one is an exceptionist, an attractive way to resolve this tension is to embrace the view that persons are sui generis ontological kinds. 相似文献

The authors explore counseling persons infected with HIV and AIDS, within the specific themes of rejection, powerlessness, and death. These themes have been chosen because they are common concerns of people with HIV and AIDS. Selected quotations from 14 interviews with persons diagnosed with HIV/AIDS are used to clarify these concerns. Specific counseling recommendations are provided to make counseling an effective, compassionate endeavor with this population. We examined the perception of deserved outcomes associated with religious fundamentalism (RF). Interviews with videotaped targets varied in target's religiosity, responsibility, and outcome valence (good/bad). Participants either low (LF) or high (HF) on RF formulated an impression of how deserving a target was for a situational outcome. Participants low in RF held targets to be less deserving of a bad outcome than a good one; the HF group showed this to a lesser degree. HFs believed the target was more deserving of a bad outcome than did LFs, even when the target was not responsible for the outcome. Religious fundamentalism is related to attributing greater deservingness of bad outcomes, possibly because of a greater belief in a just world. 相似文献
