Research on risk assessment in sentencing has focused heavily on the role of judges. Ignoring the role of other courtroom actors in the sentencing process, however, leaves unexamined the potentially significant effects on judicial decision making of arguments made by prosecutors and defense attorneys at sentencing hearings. Unduly focusing on judges also overlooks the vast majority of sentences arrived at through negotiated guilty pleas. We explored the extent to which considerations of risk are made among prosecutors and defense attorneys when advocating for given sentences in open court or during plea negotiations. We surveyed all prosecutors and defense attorneys in 14 judicial circuits in Virginia and found that most prosecutors and defense attorneys at least “sometimes” explicitly invoked actuarial risk estimates both at sentencing hearings and during plea negotiations. However, defense attorneys were much more likely than prosecutors to be averse to the use of risk assessment in either form of case disposition. 相似文献

The perceived importance of victim and defendant race/ethnicity and medical evidence in child sexual abuse cases has been recognized separately in the literature. However, few studies have considered these factors simultaneously. Within a sample of 880 college students, an interaction effect was tested between the presence of medical evidence and the race/ethnicity of a juvenile defendant and victim using child sexual abuse case vignettes. The main effects of medical evidence and the race of the defendant were observed. Medical evidence and race of victim influenced victim believability such that medical evidence was more impactful for cases with African American victims. Further, there were interactions between the race of the defendant and the race of the victim in adult versus juvenile court decisions, sex offender registration and notification requirements, and length of sex offender registration and notification. Interracial sexual offending was associated with substantially higher punishment than intraracial sexual offending. Accordingly, several important implications for court-level decision-making processes are explored. 相似文献

The purpose of this study was to investigate longitudinal changes in master’s-level counselor trainees’ (N = 78) self-perceptions of their multicultural counseling competence over the course of their counseling program. Multilevel modeling results indicated an increase in scores across 3 time points. Ubiquitous mobile technology is part of contemporary life, bringing with it the potential for distraction and reduction in performance associated with multitasking. The predisposition toward dysfunctional multitasking may be shaped in part by beliefs that individuals hold about memory and attention. The issue is particularly pressing for college students, given established links between distraction, multitasking, and learning. This project assessed the impact of an online learning module on beliefs about attention, memory, and learning in college students. It also contrasted these beliefs in a college and non-college community sample. Significant reductions in counterproductive beliefs were associated with completing the module; counterproductive beliefs were also no more prevalent in the college vs. the non-college sample. Our findings suggest that brief online modules are a practical way to address counterproductive beliefs related to multitasking with technology, and add to the literature on metacognition, attention, and multitasking in college and non-college populations. 相似文献

The isolated elements and variability effects of cognitive load theory were used to alter the element interactivity of Chinese characters when instructing novice learners (72 overseas students at a Chinese university) in writing characters using worked examples-practice procedures. A group of characters with more than eight strokes was disassembled into three individual components. Students were required to trace examples and practice writing of either similar sequences of isolated components followed by integrated components of full characters (Isolated–Integrated sequences); variable sequences of isolated followed by integrated components (Variability–Integrated sequences); or conventional Integrated–Integrated sequences of full characters. It was hypothesized that the fully integrated stroke-movements form of example-practice sequences would result in less learning due to a greater cognitive load. The results demonstrated that the participants in both the Isolated–Integrated and Variable–Integrated groups performed significantly better than the Integrated–Integrated group with the Variable–Integrated group outperforming the Isolated–Integrated group. 相似文献

People's risky decisions are susceptible to the social context in which they take place. Across three experiments using different paradigms, we investigated the influence of three social factors upon participants' decisions: the recipient of the decision-making outcome (self, other, or joint), the nature of the relationship with the other agent (friend, stranger, or teammate), and the type of information that participants received about others' preferences: none at all, general information about how previous participants had decided, or information about a specific partner's preference. We found that participants' decisions about risk did not differ according to whether the outcome at stake was their own, another agent's, or a joint outcome, nor according to the type of information available. Participants did, however, adjust their preferences for risky options in light of social information. 相似文献

AbstractFaith significantly affects the educational experience in graduate studies of religion and theology. This study explored the roles of graduate theological students’ religious faith and degree program affiliation in their information behaviors, particularly their degree-related research behaviors at Claremont School of Theology. The purpose was to explore problems in information action inherent to the dichotomy between academic study of theology that leads to Master of Arts (MA) degree and professional study of theology that leads to Master of Divinity (MDiv) degree. The research design incorporated interviews of MA and MDiv students regarding the roles of their religious faith, degree program affiliation and interpersonal information sources in their research processes. Data were collected, coded and analyzed as a lens into the social network of the theological research community. The study found that information behavior does relate to degree program affiliations and students’ religious faith. Degree program affiliation and religious faith background are relevant to graduate theological research processes and may be useful to consider in research consultations and bibliographic instruction in graduate theological education. 相似文献

A number of factors affect the success, or otherwise, of any technological innovation. In this paper, we consider factors that affect the success of innovations in the context of forest machinery manufacturing (FMM). We report the results of a study that seeks to determine the relative importance of 19 different factors affecting the success of innovations in the FMM sector. The first stage of the study makes use of the analytic hierarchy process to determine the relative importance (weights) of these factors, based on the responses of 15 decision makers (DMs) employed by different FMM companies. The study then considers three different ways of weighting the responses of DMs, based on different assumptions about how the responses of outliers—those DMs whose views differ significantly from the majority—should be handled. The first method assumes that the responses of all DMs are of equal value. The second assumes that the influence of outliers' responses should be reduced and makes use of a Euclidean distance metric to determine the weight that should be ascribed to each DM's responses. The third assumes that the influence of outliers' responses should be increased and makes use of hierarchical clustering techniques. Although the weight assignment methods were based on very different assumptions about how to treat the views of outliers, they produced similar rankings of factors. Results showed that for FMM companies, customer satisfaction, proportion of total sales by new products, influence on the overall profit of the company, and growth of demand for the company products were the most important factors for measuring the success of innovations. 相似文献

This study evaluated the effectiveness of using a university‐based pyramidal approach (i.e., train the trainer) to teach four pre‐service teachers to train another person. These pre‐service teachers were taught to use behavioral skills training (BST) techniques to train other professionals to use an evidence‐based practice. Transfer to a generalization trainee was probed and three participants maintenance of BST fidelity was probed one year later, after the participants had begun teaching. Results indicate that the participants quickly acquired and maintained a high degree of fidelity with BST. Implications for research and practice are discussed. 相似文献
