Justification,excuse, and proof beyond reasonable doubt

The law requires criminal guilt to be proved beyond a reasonable doubt. There are two different approaches to construing this legal rule. On an epistemic approach, the rule is construed in terms of justified belief or knowledge; on a probabilistic approach, the rule is construed in terms of satisfying a probabilistic threshold. An epistemic construction of the rule has this advantage over a probabilistic construction: the former can while the latter cannot excuse the state from blame for a false conviction. This claim rests on an understanding of legal rules, legal justification for a finding of guilt and the central purpose of a criminal trial.     

恐惧管理理论的争议及其对死亡心理研究的启示

死亡心理是人类面临死亡及相关事件时所产生的认知、情感和行为意向的复杂心理状态。目前, 研究死亡心理较为全面和科学的理论是恐惧管理理论(Terror Management Theory, 简称TMT)。但该理论存在以下争议: (1)在死亡的基本认知方面, 恐惧管理理论呈现出不一致的研究结果, 如死亡是否与不确定性无关, 死亡是否导致恐惧情绪, 寻求个体生存是否为人类的核心议题; (2)在社会文化层面, 恐惧管理理论提出者的文化背景对待死亡的普遍态度是呈否认的, 但是跨文化的研究显示其他文化背景对待死亡的态度却呈现出接纳或蔑视; (3)在恐惧管理理论的研究结果方面, 呈现出较多的矛盾性, 表明研究中有重要的调节因子未被涉及。基于此, 死亡心理可能的研究方向拟从认知、行为和社会三个层面进行梳理。未来死亡心理研究需秉承科学与文化并重的原则, 并结合死亡心理的内容与过程, 关注群体面对死亡时的心理规律, 开展死亡心理影响下的身心健康干预研究。     

Gain or non‐loss: The message matching effect of regulatory focus on moral judgements of other‐orientation lies

Previous studies found that individuals with promotion focus are more likely to be persuaded by messages framed in terms of gain‐related words; individuals with prevention focus are more likely to be persuaded by messages framed in terms of loss‐related words. This is known as the message matching effect of regulatory focus. The present study extended this effect into the field of moral judgement of other‐orientation lies. Two experiments were conducted, revealing that (a) individuals with promotion focus judged gain‐framed other‐orientation lies to be more moral, while individuals with prevention focus judged non‐loss‐framed other‐orientation lies to be more moral; and (b) the subjective processing fluency had a partial mediating role in the message matching effect. Theoretical implications and future research directions were discussed.     

Missio Dei Trinitatis and Missio Ecclesiae: A Public Theological Perspective

In this article I address the mission of the triune God (missio Dei trinitatis) and the mission of the church (missio ecclesiae) that participates in the mission of God the Trinity, particularly from the perspective of public theology. First, I investigate that the concept of the missio Dei trinitatis so expanded our understanding of mission that the church‐centred view of mission was replaced by the public mission taking place in the midst of the world. Second, from the public theological perspective I argue for the need of the diakonia mission in order to realize the reign of God in the world. Third, I insist that the mission of the church participating in the mission of the triune God ought to appropriate the post‐colonial hermeneutics of suspicion and develop a post‐post‐colonial public mission theology for the sake of a mature democratic civil society. Fourth, I suggest that the mission of the church participating in God's mission should develop a transcultural‐indigenous public hermeneutics of mission in such a way as to encourage different stories through transcultural‐indigenous interpretations of the biblical narrative.     

The Impact of Specific Psychotherapist Beliefs Regarding Managed Care on Prospective Psychotherapy Clients

The purpose of this study was to investigate the separate impact of each of thirteen therapist beliefs that, presented collectively, were previously found to have a significantly negative impact on prospective clients' attitudes toward managed care psychotherapy (Pomerantz, 2000). Participants in this study initially completed a brief questionnaire measuring their willingness to enter psychotherapy and their expectations regarding psychotherapy under managed care. Participants subsequently completed the same brief questionnaire again after being instructed to imagine seeing a hypothetical psychologist and being presented with the psychologist's supposed beliefs regarding managed care (which were actually derived from survey data by Murphy et al., 1998). Results suggest that almost every discrete therapist belief had a significantly negative impact on participants' attitudes toward managed care psychotherapy. Several specific therapist beliefs produced particularly salient negative effects. Implications regarding ethics and informed consent are discussed.
