This paper examines the representation of mental illness and mental disorder in the Washington Community Protection Act of 1990 (WCPA), the first package of sexual predator legislation passed in the United States. I focus on the public outcry over a violent crime committed by a repeat sexual offender, Earl Shriner, and show how the act was drafted in direct response to this outcry. Following his arrest, there was a public discussion of a) whether the state had a responsibility to cure individuals like Shriner before releasing them, and b) whether sex offenders could be cured at all. The WCPA was a landmark law because it shifted forensic psychology in the use of sexual criminals from an intervention model to a containment model, from a model that sought to separate out those sexual criminals who could be treated to a model that separated out sexual criminals because they could not be treated. I demonstrate here that this shift was made in response to the representation of Earl Shriner as a member of a group classified by legislators as having a coherent, recognizable and untreatable mental disorder that caused them to commit acts of sexual violence.  相似文献

The purpose of this paper is to investigate the consumer reaction during a product‐harm crisis by examining the interdependencies that exist among their ethical beliefs as consumers, their attributions of blame, their feelings of anger and finally their purchase intentions towards the affected company. To test the five research hypotheses, a questionnaire containing a hypothetical crisis scenario of a fictitious company was distributed to 277 consumers. Respondents were asked to read the scenario and answer questions regarding their attribution of responsibility to the company, their feelings of anger and their purchase intentions. In order to investigate consumers' ethical beliefs, a Consumer Ethics Scale was also included in the questionnaire. Structural equation modelling revealed a significant, positive correlation between attributions of blame, anger and ethical beliefs. Moreover, anger negatively affects purchase intentions, whereas the attribution of blame was not found to be significantly connected to purchase intentions. In spite of the rational connection between ethics and crisis, there is lack of research correlating these two concepts. Based on this gap in the literature, the current research attempts to connect ethical beliefs with consumer reactions and emotions during product‐harm crises. This special issue includes seven articles that make significant contribution to the literature pertaining to knowledge and public policy around Free, Libre and Open Source Software (FLOSS). Focusing on questions in two themes (i) motivation and organization and (ii) public policy, the articles in this volume develop new analytic models and report on new empirical findings, as an important step in bridging the wide gap that exists in public policy literature around FLOSS. Warning against rhetorical pitfalls that have been prevalent in FLOSS research, this introduction starts with a short history of FLOSS development, continues with a brief thematic literature review and review of the misconceptions surrounding FLOSS, and concludes with a first introduction of the articles that follow. He is part of the Dutch Institute of Government (NIG), the research school for public administration and political science. His research focuses on the organization of open source communities. He received two grants from the Netherlands Organization for Scientific Research (NWO) for research related to open source communities. The first grant was to study the interplay between intellectual property rights and open source communities. The results are published in Governing the Virtual Commons (Cambridge University Press, 2003). He has written numerous articles on open source, which have appeared in journals like Electronic Markets; Knowledge, Technology and Policy; and the International Journal of IT Standards & Standardisation Research. She received her Ph.D. in sociology from the University of York (UK) in 2004. Her Ph.D. research investigated the heterogeneity and contingency in the Free, Libre Open Source Software (FLOSS) social worlds, which is based on a constellation of hacking practices, from the sociological perspective. Her principal research interests center on FLOSS studies, Science and Technology Studies (STS), virtual communities and knowledge-sharing. Shay is also a fellow at The Information Society Project at the Yale Law School. Shay holds a B.Sc. in computer science and a B.A. in philosophy, magna cum laude, from Tel-Aviv University, and an M.A. from New York University where his interdisciplinary research thesis focused on the political economy of free and open source software and file sharing networks. Shay is an entrepreneur that co-founded two software start-up companies, and was involved for several years in cutting edge software research, combining open source and proprietary software.  相似文献

The anecdote of Zhuangzi and Hui Shi's brief discussion on a bridge above the Hao river gives us a nice piece of reasoning in ancient Chinese texts that may serve as a platform for a productive philosophical exchange between the East and the West. The present study examines Hansen's inferential analysis of Zhuangzi and Hui Shi's discussion in this spirit. It is argued that Hansen's analysis founders. To do justice to both Hui Shi and Zhuangzi, the present study proposes that we apply the logic developed in the later Mohist text, the Lesser Pick, to an analysis of their discussion. The re-analysis shows that the intricate dialectic of the reasoning in which Zhuangzi and Hui Shi engage, neatly accords with the pattern of discourse expounded in the Lesser Pick, and gives us global insight into Zhuangzi's final statement in the anecdote, which is notoriously recondite, or confusing.  相似文献

The relationship between loyalty to rules and the creativity that attempts to improve those same rules was examined among Norwegian army officers deployed in international operations. Today's army officers are faced with rapidly changing work conditions and unpredictable enemies, both of which challenge and outdate rules and routines. They thus may experience that they are either guided by too few or inadequate rules, or by many rules that need to be constantly updated. Assuming that following rules is advantageous to officers, then, contrary to classical theory, it was hypothesized that officers scoring both low and high on loyalty to rules would score high on creativity. Hierarchical regression analyses revealed a significant U‐shaped relationship between loyalty to rules and creativity.  相似文献
