This paper defends the heretical view that sometimes we ought to assign legal liability based on statistical evidence alone. Recent literature focuses on potential unfairness to the defending party if we rely on bare statistics. Here, I show that capitulating in response to ‘epistemic gaps’—cases where there is a group of potential harmers but an absence of individuating evidence—can amount to a serious injustice against the party who has been harmed. Drawing on prominent civil law litigation involving pharmaceutical and industrial negligence, the overall aim is to illustrate moral pitfalls stemming from the popular idea that it is never appropriate to rely on bare statistics when settling a legal dispute.  相似文献

The effects of a video vignette on the treatment acceptability ratings of four behavioral interventions were evaluated. Two interventions involved positive reinforcement (DRO and DRI) and two negative consequences (contingent physical restraint and contingent electric shock). Eighty-five individuals involved in programs for individuals with developmental disabilities were randomly assigned into two groups. The experimental group (n=41) viewed a video vignette of an extremely aggressive individual whereas the control group (n=44) did not. Acceptability ratings prior to the video showed no differences between the experimental and control groups except for the physical restraint intervention. The experimental group’s post video ratings indicated significant acceptability increases for electric shock and significant decreases for DRO. There also was a significant group by testing effect with the means for the experimental group rising whereas the control group means were stable. This paper examines refugee students' experiences in the Austrian mainstream school system. It highlights four areas: school connectedness, social exclusion, support systems and friendships. In the study, 55 refugee students between 8 and 21 years old enrolled in primary and secondary education participated in a semi-structured interview. Data were analysed with directed qualitative content analysis, whereby codes were created deductively and inductively. Students stressed the importance of schooling in order to prosper in the future, particularly through language acquisition. Peers and bilingual teachers played an important role in their efforts to learn German and develop feelings of belonging in the school system. While language acquisition was important for the students, they indicated that other support measures (i.e., remedial education) were largely absent. Further, half of the students reported bullying experiences (verbal, social and physical) associated with their refugee status, language proficiency and religious affiliation. This study has implications for school professionals. The scope of support refugee students receive at school must be broadened, forced migration should be addressed in school in order to counteract negative effects of bullying students receive due to their refugee status and school connectedness can be promoted by hiring staff from diverse cultural backgrounds.  相似文献

Research on the relationship of implicit motives and effective leadership emphasises the importance of a socialised need for power, whereas high levels of the need for affiliation are assumed to thwart a leader’s success. In our study, we experimentally analysed the impact of leaders’ socialised need for power and their need for affiliation on perceptions of transformational leadership and various success indicators. Using paper-people vignettes, we contrasted leaders characterised by either motive with those concerned with personalised power or achievement. Results based on N?=?80 employees show that leaders high in socialised power were rated more successful and elicited more identification and organisational citizenship behaviour (OCB) in followers, and that in most cases this effect was mediated by perceptions of transformational leadership. For all outcomes but OCB, findings remained unchanged when affiliation-motivated leaders were considered. Exploratory analyses contrasting socialised power-motivated and affiliation-motivated leaders show that with regard to attitudinal outcomes affiliation-motivated leaders were, on average, as effective as socialised power-motivated ones.
