This integrative review seeks to consider the evidence on how crime victims’ rights are served within South Africa’s criminal justice system. Victims view criminal proceeding as the means through which justice for the harms they suffered can be obtained. Such aspirations are often misplaced since criminal proceedings are a legal process between the state and accused with the sole purpose of determining guilt or innocence. As such, the concerns of victims are secondary. Victim’s rights in South Africa was only truly acknowledged during the Truth and Reconciliation Commission (TRC) in 1995. South Africa’s victim empowerment policy is underpinned by restorative justice principles. Contradictory to legal procedures, restorative justice is not offender-driven, but aims to elevate the role of crime victims in the criminal justice system.  相似文献

ABSTRACT

Although criminologists have long recognized the role that peers play in crime, the specific mechanisms responsible for this relationship have been difficult to isolate. Drawing from the perspectives of differential coercion and social support and differential association, we examine how one type of coercion among friends – conflict – moderates the peer deviance/crime relationship. Using dyadic data, greater levels of conflict are related to higher levels of deviance and conflict weakens the peer deviance–crime relationship. Overall, conflict plays a dual role by relating to higher amounts of deviance while jointly reducing the influence of peer deviance on crime.  相似文献

In Germany, criminology has become established primarily in law faculties; however, it must currently face cutback tendencies which have to be attributed, among others, to the minority position of criminologists in the respective faculties. These tendencies must be countered with regard to the importance of criminology as a science which deals with central social problems. Criminology must become embedded in jurisprudence and in the psychological, psychiatric and social sciences. Interdisciplinary criminological research centers could be established. A close cooperation between criminology and forensic psychiatry is recommended in many areas.  相似文献

ABSTRACT

Environment crime has received considerable attention from criminologists in recent years. Not only have scholars examined the social, political, cultural, and situational factors that influence environment crime, but researchers have also explored the potential overlap of environment crime with other criminal activities, including transnational organized crime and corruption. One line of inquiry, however, that has received little attention is the intersection between environment crime and labor trafficking. The present study assesses the convergence of labor trafficking and the illegal fishing industry through the theoretical lens of crime symbiosis and the CAPTURED framework. Comprehensive research into criminal careers along with the growing consensus around the Five Factor Model (FFM) of personality traits have re-established personality measures as important predictors of criminal activity. A number of studies of specialist groups have concluded that agreeableness, conscientiousness, neuroticism and extraversion are linked to crime. Data were drawn from the National Child Development Study. Experiencing a criminal justice sanction in mid-adulthood was regressed on FFM traits, Agreeableness, Extraversion, Conscientiousness, Intellect and Emotional Stability (Neuroticism), as well as socio-economic variables linked by criminologists to crime. Results indicated that significant predictors in this representative sample of 7205 adults, were four of the five personality traits (but not Intellect), gender, experience of school problems, but none of the socio-economic measures. This is consistent with the evidence that social class has only a minor role in predicting criminality, contrary to previous assumptions.  相似文献

This current study assessed the value of the Interpersonal Model in differentiating serial homicide offences in South Africa, notably in terms of how the offender may display behavioural patterns that are indicative of them dealing with the victim as a Person, an Object, or a Vehicle. The sample consisted of 302 offences committed by 33 offenders that occurred from 1953 to 2007 in South Africa. Multidimensional scaling analysis was used to test the Interpersonal Model and results indicated that crime themes did not directly correspond to the threefold model. Instead, two crime scene types were present: Victim as Object (where the focus was on tangible gains, interaction with the victim throughout the phases of the crime was limited, and victims included men and live women) and Victim as Vehicle (where the victim might be construed as a conduit through whom the offender could realise their specific psychological needs, the interaction was extensive, and victims tended to be vulnerable). South African serial homicides did not appear to have a specific sub‐theme of Victim as Person, suggesting that the themes engaged in centred more on instrumentally focused actions but in qualitatively different ways. However, victim types were integral to the overall behavioural model. Using the Victim as Object/Vehicle dichotomy, 85.7% of the offences could be seen to engage dominantly in one of the two patterns at the crime scene. This not only supported the results of a twofold model, but having these many offenders showing a dominant crime scene type also shows that the model is an excellent representation of serial homicide offending in South Africa. This study explored integration and social identity of foreign African nationals in the South African workplace. The study also explored the implications of the Employment Equity Act of 2006 as interpreted by foreign African nationals within the contexts of integration and social identity. The study interviewed eight men and two women working in South Africa. The average age of the participants was 37 years. Data on integration and social identity of African professionals working in South Africa were collected through interviews and the data were analysed qualitatively. The findings of the study were that the South African labour legislation on employment equity was perceived as discriminatory to foreign African nationals. The professional foreign African workers perceived less xenophobia and racism directed at them that could be experienced by others in nonprofessional positions.  相似文献

There is an abundance of literature on serial homicide from a Western perspective that outlines operational definitions, types of offenders and how they prey upon their victims. However, currently, there is a lack of studies that compare serial homicide in different countries. The current study aims to give an overview of the demographics of serial homicide offenders and victims in South Africa and compare these to the demographics of offenders and victims from other currently available empirical studies of other countries. The sample consisted of 33 out of the total 54 solved series in South Africa between 1936–2007, which includes a total of 33 offenders, 302 victims, and 254 crime scenes. Results of the sample as a whole showed that South African serial homicide offenders are similar to offenders in other countries in terms of their actions at the crime scene and victim choice, with some notable exceptions. Additional analysis looked at the offender's consistency of targeting certain types of victims across their homicide series in comparison with the patterns of serial homicide offenders in other countries. This article explores the role of informal governance and institutions in the self-settlement strategies of Somalis in South Africa. Based on 3 years of ethnographic fieldwork with Somalis in Johannesburg, this article argues that informal governance operated though kin, clan and social networks, and personal, localised relationship with state authorities and community leaders are instrumental in governing settlement. Moreover, this form of governance is located within the multiple systems of Somali social order.  相似文献

We examined the value correlates of different social identities among two groups of South Africans, those identifying themselves as white Afrikaners or as black South Africans. Respondents indicated the importance of their membership of different groups and also completed indices of National strength and order, and International harmony and equality. Multiple regression analyses showed that the social identities associated with both values for self‐identified Afrikaners were mainly linked with ethnic language (Afrikaans) and religion. Among self‐identified black South Africans, however, the social identities were more encompassing, including the notion of global citizen and South African. The findings are discussed in the light of ongoing political and social change in South Africa and the nature of changing identities, as well as the role of cultural symbols in facilitating in‐group identification among white Afrikaners.  相似文献

There is increasing interest, both internationally and in South Africa, in strengthening the relationship between psychoanalytic practice and research. This paper reports on a psychoanalytically oriented doctoral programme offered at the University of the Witwatersrand in South Africa. The programme is described in relation to the broader context of the historical relationship of psychoanalysis to the university as well as to the specific context of the history of psychoanalysis in South Africa. Key challenges of the programme, specifically concerning research tensions and methodological and theoretical tolerance, are subsequently explored. The way in which these challenges manifested within a group context illustrates their potential for conflict as well as productive debate. The paper reflects on how this specific programme illuminates and extends some of the broader debates in the field of psychoanalysis.  相似文献

A great deal of effort has gone into developing capacity in the sphere of human research protection programmes in South Africa and Africa over the last decade or more, by several international organisations. However the promotion of the broader agenda of research integrity or ‘RCR’ (Responsible Conduct of Research) has lagged behind. From a global perspective South Africa and other African countries are actively involved in research endeavours and collaborations across a very broad spectrum of scientific fields. For this research to fulfil its potential social value it must be reliable and trustworthy and hence it is essential that research institutions and universities take the promotion of research integrity seriously. The purpose of this paper is to consider the role of an institutional office of research integrity within the context of academic research particularly in South Africa but also in Africa. I will reflect on my own experience over a period of five years as a research integrity officer at a South African academic institution to highlight concerns in five domains; the promotion of an ethic of responsibility in opposition to compliance and bureaucracy, collaboration ethics and collegiality especially in the context of North-South collaborations, authorship and publication ethics, the problem of plagiarism and the utility of policy and procedure. I will suggest that the establishment of such an office can be of great value in the promotion of a broad culture of research ethics and responsible research conduct. The possible role and scope of function of an institutional office of research integrity will be briefly outlined.  相似文献

This study investigated the lived experience of substance abusers in the South African context. Participants were 10 individuals attending a drug treatment centre in Durban, South Africa. Data were collected using open-ended interviews with data being analysed using thematic analysis. Findings suggest that normative social influences and levels of social support play an important role in shaping, maintaining, and determining the trajectory of drug usage.  相似文献

The development of community psychology is of vital importance in South Africa because of the historical context, questions about the relevance of mainstream western psychology and the current social change in the country in the post-apartheid era. Accordingly successful community psychology practices for a South Africa in transition need greater dissemination for access and utilization in the communities. This article draws on the community work conducted at the Itsoseng Clinic to show how and why community psychology could be made more relevant to the new South Africa. The Itsoseng Clinic is a psychology clinic that is situated in the township of Mamelodi. The clinic provides several services including counselling, psychometric assessment, psycho educational workshops, and HIV/AIDS pre and post-test counselling. The clients and community that the clinic serves are of low socio-economic status and struggle with a lack of material and personnel resources. The individuals working within the Itsoseng Clinic represent a diversity that is in itself a valuable resource for supporting the core activities of the clinic. This article explores various themes that were identified within the research study such as, making community, entering the ecology of life, closing the divide and bridging the boundaries.  相似文献

Abstract

South Africa's 1996 Constitution promises a measure of ‘social citizenship’ alongside formal political and legal equality. South Africa's public welfare and social policies may be less effective in ensuring social citizenship, through reducing insecurity and inequality, than those of the more established democracies, but they are far more effective than those of other ‘developing’ countries. The origins of social citizenship in South Africa lie in the early and mid-1940s, when the state first assumed responsibility for the welfare, broadly understood, of all South Africans. The most significant achievement was the introduction of a universal old-age pension system. The importance of these initiatives has been largely overlooked. This has been in part because later scholars largely ignored the heterogeneity of liberal thought in South Africa in the mid-twentieth century, as followers of the ‘New Liberalism’ broke with the classical liberalism of John Stuart Mill and argued for a range of state interventions in social and economic life. In South Africa, as elsewhere, the Second World War provided a context in which revised liberal thought gave rise to major policy reforms, some of which were to survive even the election of a National Party government in 1948.  相似文献

This study explored stereotype constructions people may impute on to others in the context of a contagious disease epidemic. Participants were 30 undergraduate students from a large university in Johannesburg, South Africa. They completed the open-ended Build-A-Character Questionnaire, which described the “typical” person in South Africa who they currently believed to be at particular risk of HIV infection. The data were thematically analysed and interpreted. Seven themes resulted, based on the stereotyping of marginalised groups in South Africa considered as being at higher risk for HIV due to historical disadvantage: blacks, women, and the poor. A social cognitive framework explains these stereotypes as they apply to perceived out-groups, and they carry risk to undermine public health interventions regarding the HIV pandemic in South Africa across population segments.  相似文献

Culture is increasingly recognised among traffic psychologists to be a factor influencing driving behaviour. This study examines whether a cultural background characterised by rapid social change and high levels of violence and aggression, as in the South African context, has any discernible influences on driving standards or the behaviour of individual drivers. The experiences and attitudes of young drivers in South Africa are compared with a group of young drivers from Sweden, a country whose society has exhibited high levels of stability and where road user behaviour is renowned for its restraint and compliance with regulations.The two cohorts provide information about their exposure to traffic injuries, their attitudes to other drivers and to a range of traffic offences, and to the types of behaviour they personally engage in. Among the South African respondents the notion of a declining standard of driving emerges very clearly, and specific new norms of driving are identified. Such norms are explained to be a consequence of new social values or challenges inherent within contemporary South African society.  相似文献

South Africa, like many other nation-states in sub-Saharan Africa, has been a multi-lingual, multi-ethnic, multi-cultural and multi-religious state for more than a century. This mosaic character of South African society stimulated Archbishop Desmond Tutu to aptly describe it as ‘the rainbow nation’. The population of South Africa's rainbow nation numbers in the region of 44.8 million, and is predominantly Christian. Other members of this nation belong to numerous other religious traditions, including Muslims, who make up roughly 1.5% (less than one million) of the total population. Despite their small numbers, Muslims have played a prominent role in South African society before and throughout the twentieth century, and their relationship with the majority Christian society, particularly within the African, Coloured and Indian communities, may generally be described as cordial.  相似文献

Drawing on interviews with creators of Christian hip hop music in South Africa, this article demonstrates that this genre of popular music and youth culture is utilised as a form of pedagogy to transmit religious beliefs and values to contemporary youth. The pedagogical aspects of hip hop have been recognised in research on the topic, but the religious pedagogical uses of hip hop have been under-analysed within the social sciences. After outlining the global development of hip hop as a pedagogical practice, this article will demonstrate that, under the influence of North American Evangelicalism, South African Christian hip hop attempts to promote Evangelical orthodoxy and orthopraxy in response to the secular and religious practices of South African youth.  相似文献

The authors use examples of youth civic engagement from Chile, South Africa, Central/Eastern Europe, and the United States--and also emphasize diversities among youth from different subgroups within countries--to illustrate common elements of the civic domain of youth development. These include the primacy of collective activity for forming political identities and ideas and the greater heterogeneity of civic compared to other discretionary activities, the groupways or accumulated opportunities for acting due to the groups (social class, gender, ethnic, caste, etc.) to which a young person belongs, and the role of mediating institutions (schools, community-based organizations, etc.) as spaces where youths' actions contribute to political stability and change.  相似文献
