In this article we present a training program based on the empirical research conducted in the project 'argumentational integrity'. After a brief sketch of the problem dimensions concerning unfair argumentation we give an overview of the training concept and the underlying empirical research. Exemplification of the instructional design is given for the second and the fifth training dimension (standards of argumentational integrity and reactions to unfair contributions). Finally we indicate how the training is to be evaluated and present initial results demonstrating that in comparison with an untrained control group participants in the training significantly improve their skills in identifying and naming argumentative rule violations. 相似文献

Whilst hermeneutics had been traditionally associated with the interpretation of texts, Martin Heidegger gave it a new meaning, associating it with the interpretation of the existence (the ‘being’) of Dasein. This paper will explain the Heideggerian understanding of hermeneutics, based on the early work of Heidegger (especially Being and Time and other related works from this period) which focuses on the analysis of the being of Dasein. His main contribution was a shift of focus from the interpretation of an unknown object (a text) to the interpretation of the human being (Dasein), which Heidegger sees as primary, since it is on the basis of Dasein’s understanding that other things and beings are interpreted. Firstly, the paper discusses hermeneutics in relation to human being (Dasein), with a brief introduction to the main characteristics of Dasein (including the ‘existentialia’), showing the place of hermeneutics within Dasein’s existence, together with Heidegger’s re-interpretation of the hermeneutic circle. Secondly, this understanding is applied to sport, focusing on the experience of athletes and on the possibilities for interpretations towards authentic existence, including its ethical aspect. 相似文献

In this paper, it is explained that a dialogical approach to complex argumentation can be fruitful for solving two important problems concerning the analysis of the argumentation structure. First, such an approach makes it possible to clarify the distinction between coordinative and multiple argumentation structures, and to identify clues in the presentation for each of these structures. This paper answers the question how pragmatic argumentation which occurs in a legal context, can be analyzed and evaluated adequately. First, the author surveys various ideas taken from argumentation theory and legal theory on the analysis and evaluation of pragmatic argumentation. Then, on the basis of these ideas, she develops a pragma-dialectical instrument for analyzing and evaluating pragmatic argumentation in a legal context. Finally she demonstrates how this instrument can be used by giving an exemplary analysis and evaluation of pragmatic argumentation in a decision of the Dutch Supreme Court. 相似文献

Robert Kimball, in “What’s Wrong with Argumentum Ad Baculum?” (Argumentation, 2006) argues that dialogue-based models of rational argumentation do not satisfactorily account for what is objectionable about more malicious uses of threats encountered in some ad baculum arguments. Teleological argumentation in a legal context is approached as a specific form of pragmatic argumentation. The legal criteria
that are relevant for the evaluation of teleological argumentation are discussed and translated in terms of critical questions
that are relevant for the evaluation of the various forms of teleological argumentation.

Empirical research in the field of legal interpretation shows that, in many cases, analogy argumentation is complex rather
than simple. Traditional analytical approaches to analogy argumentation do not explore that complexity. In most cases analogy
argumentation is reconstructed as a simple form of argumentation that consists of two premises and a conclusion. This article
focuses on the question of how to analyze and evaluate complex analogy argumentation. It is shown how the pragma-dialectical
approach provides clues for analyzing complex analogy argumentation and how the criteria for evaluating analogy argumentation
can be used to reconstruct these types of complex analogy argumentation in Dutch case law. The critical questions in the argumentation
scheme do not only serve as a tool for analyzing arguments justifying analogy argumentation, but are also helpful in analyzing

This article presents a critical analysis of the main modern approaches to the problem of meta‐argumentation and suggests a method for developing a general conception of meta‐argumentation. A set of theoretical‐methodological difficulties (aporias) along this path is revealed. This paper explores the meaning of dreamless sleep. First, I consider four reasons why we commonly pass over sleep’s ontological significance. Second, I compare and contrast death and sleep to show how each is oriented to questions regarding the possibilities of “being-a-whole.” In the third and final part, I explore the meaning and implications of “being-toward-sleep,” arguing that human existence emerges atop naturally anonymous corporeality (i.e. living being). In sum, I try to show that we can recover an authentic – if somewhat ambiguous – sense of “being-a-whole” only by recognizing the ontological significance of dreamless sleep. 相似文献

Coalescent argumentation is a normative ideal that involves the joining together of two disparate claims through recognition and exploration of opposing positions. By uncovering the crucial connection between a claim and the attitudes, beliefs, feelings, values and needs to which it is connected dispute partners are able to identify points of agreement and disagreement. These points can then be utilized to effect coalescence, a joining or merging of divergent positions, by forming the basis for a mutual investigation of non-conflictual options that might otherwise have remained unconsidered. This paper is concerned with argumentation in legal proceedings, namely in criminal cases. My interest is to explore how in the legal realm different argumentation fields interact, the juridical field being just one of them. The paper lays out an approach of studying argumentation in the legal realm in the framework of an ethnographic methodology by identifying the “topical rules” the participants in criminal trials adhere to. Suggesting the notion of field-dependence as a good starting point for the analysis of legal argumentation, I will give several examples of different fields of argumentation interacting in criminal proceedings. The examination of what counts as a good reason and how arguments are employed, negotiated, and evaluated within a criminal proceeding might shed light on the practice of constructing facts and arriving at decisions in court. It can furthermore point at the constitution of legal rationality and how it is produced in criminal trials. I argue that rationality in criminal proceedings is interactively accomplished by negotiating different standards of validity. 相似文献

Presupposing that our consideration of ethical issues can be enriched by examining literary works, this paper focuses on Marsha Norman's play ‘night, Mother. The play describes the last hour and a half in the life of Jessie, a young woman who decides to die by suicide. Before ending her life, Jessie explains to her mother her reasons for her suicide. In the context of the play, these are presented as quite weighty and as, perhaps, justifying her decision. Scholarly research on the play has also treated Jessie's suicide favorably. In this paper I argue that Jessie, and people in similar conditions, are wrong to die by suicide. Among other points, I criticize Jessie's arguments from the impossibility to improve life; the assured termination of suffering; the badness of the world; and the right for suicide. I also criticize arguments in the scholarly literature that view Jessie's suicide favorably, such as the arguments from independence, heroism, authenticity, and emotional closeness. 相似文献
