The traditional concepts of rhetorical strategy and argumentative fallacy cannot be readily reconciled. Doing so requires escaping the following argument: All argumentation involves rhetorical strategies. All rhetorical strategies are violations of logical or dialectical ideals. All violations of logical or dialectical ideals are fallacies. Normative pragmatics provides a perspective in which rhetorical strategies can be seen to have the potential for constructive contributions to argumentation and in which fallacies are not simply violations of ideals. One kind of constructive contribution, framing moves, is illustrated with the case of Lyndon Johnson’s 1964 TV campaign commercial known as the Daisy ad.  相似文献

In the pragma-dialectical approach, fallacies are considered incorrect moves in a discussion for which the goal is successful resolution of a dispute. Ten rules are given for effective conduct at the various stages of such a critical discussion (confrontation, opening, argumentation, concluding). Fallacies are discussed as violations of these rules, taking into account all speech acts which are traditionally recognized as fallacies. Special attention is paid to the role played by implicitness in fallacies in everyday language use. It is stressed that identifying and acknowledging fallacies in ordinary discussions always has a conditional character. Differences between the pragma-dialectical perspective, the Standard Treatment, and the formal logic approach to fallacy analysis are discussed.  相似文献

(1) The aim of the paper is to develop a reduction of fallacy theory, i.e. to 'deduce' fallacy theory from a positive theory of argumentation which provides exact criteria for valid and adequate argumentation. Such reductionism has several advantages compared to an unsystematic action, which is quite usual in current fallacy but which at least in part is due to the poor state of positive argumentation theory itself. (2) After defining 'fallacy' (3) some principle ideas and (4) the exact criteria for (argumentatively) valid and adequate arguments of the 'practical theory of argumentation' of the author are expounded. These criteria will be used as the positive basis for the following reduction. (5) In the main part of the paper a systematization, definition and explanation of the main types and many subforms of fallacies of argumentative validity and (6) adequacy is developed, following the list of positive conditions of validity and adequacy. In addition to many new types of fallacies, this systematization contains the most important of the traditionally known and named fallacies; these are explained and the criteria for some of them are corrected or put more precisely.  相似文献

In this paper it is argued that much can be gained for the analysis and evaluation of arguing when fallacies are not, or not only, conceived of as flawed premise–conclusion complexes but rather as argumentative moves which distort harmfully an interaction aiming at resolving communication problems argumentatively. Starting from Normative Pragmatics and the pragma-dialectical concept of fallacy, a case study is presented to illustrate a fallacy which is termed the 'revelation argument' because it is characterized by an interactor's revealing her thoughts and/or emotions to the addressees and claiming that these would have justificatory or refutatory potential with respect to the problem discussed. Although the revelation argument may not be a paradigm case of resolution- hindering moves, it is an extreme case of flawed reasoning that illustrates plainly the advantages of a communicational perspective on arguing and fallacies.  相似文献

This article analyses the fallacy of wrenching from context, using the dialectical notions of commitment and implicature as tools. The data, a set of key examples, is used to sharpen the conceptual borderlines around the related fallacies of straw man, accent, misquotation, and neglect of qualifications. According to the analysis, the main characteristics of wrenching from context are the manipulation of the meaning of the other’s statement through devices such as the use of misquotations, selective quotations, and quoting out of context. The theoretical tools employed in the analysis are pragmatic theories of meaning and a dialectical model of commitment, used to explain how and why a standpoint is distorted. The analysis is based on a conception of fallacies as deceptive strategic moves in a game of dialogue. As a consequence, our focus is not only on misquotations as distortions of meaning, but on how they are used as dialectical tools to attack an opponent or win a dispute. Wrenching from context is described as a fallacy of unfairly attributing a commitment to another party that he never held. Its power as a deceptive argumentation tactic is based on complex mechanisms of implicit commitments and on their misemployment to improperly suggest an attribution of commitment.  相似文献

Free speech fallacies are errors of meta-argument. One commits a free speech fallacy when one argues that since there are apparent restrictions on one’s rights of free expression, procedural rules of critical exchange have been broken, and consequently, one’s preferred view is dialectically better off than it may otherwise seem. Free speech fallacies are meta-argumentative, since they occur at the level of assessing the dialectical situation in terms of norms of argument and in terms of meta-evidential principles of interpreting how and why people follow (or fail to follow) argumentative rules. Our plan here is to begin with a brief explanation of meta-argument and meta-argumentative fallacy. We will then turn to the variety of forms of the free speech fallacy, which we will explain as meta-argumentatively erroneous.

Why are some arguments fallacious? Since argumentation is an intellectual activity that can be performed better or worse, do we evaluate arguments simply in terms of their content, or does it also make sense to evaluate the arguer in light of the content put forward? From a ‘virtue’ approach, I propose understanding fallacies as having some link with intellectual vice(s). Drawing from recent work by Paul Grice, Linda Zagzebski, Andrew Aberdein, and Douglas Walton, this essay argues that if there is some sense of argumentation where an argument is (1) truth-propagating and not (2) put forward in order to ‘win’, fallacies may be the vicious element in arguments that undermines (1), most often because the arguer’s goal is only (2). From this perspective, fallacies may not only be improper ‘moves’ in an argument, but may also reveal something lacking in the arguer’s intellectual character.  相似文献

The fallacy fallacy is either the misdiagnosis of fallacy or the supposition that the conclusion of a fallacy must be a falsehood. This paper explores the relevance of these and related errors of reasoning for the appraisal of arguments, especially within virtue theories of argumentation. In particular, the fallacy fallacy exemplifies the Owl of Minerva problem, whereby tools devised to understand a norm make possible new ways of violating the norm. Fallacies are such tools and so are vices. Hence a similar problem arises with argumentative vices. Fortunately, both instances of the problem have a common remedy.

In this paper I will attempt a unified analysis of the various examples of the fallacy of accident given by Aristotle in the Sophistical Refutations. In many cases the examples underdetermine the fallacy and it is not trivial to identify the fallacy committed. To make this identification we have to find some error common to all the examples and to show that this error would still be committed even if those other fallacies that the examples exemplify were not. Aristotle says that there is only one solution “against the argument” as opposed to “against the man”, and it is this solution the paper attempts to find. It is a characteristic mark of my analysis that some arguments that we might normally be inclined to say are fallacious turn out to be valid and that some arguments that we would normally be inclined to say are valid turn out to be fallacious. This is (in part) because what we call validity in modern logic is not the same as the apodicticity that Aristotelian syllogisms require in order to be used in science. The fallacies of accident, uniquely among the fallacies, are failures of apodicticity rather than failures of, in particular, semantic entailment. This makes sense in a tensed and token-based logic such as Aristotle’s. I conclude that the closest analogue to the fallacy of accident that we can point to is a fallacy in modal logic, viz., the fallacy of necessity.  相似文献

The notion of “the burden of proof” plays an important role in real-world argumentation contexts, in particular in law. It has also been given a central role in normative accounts of argumentation, and has been used to explain a range of classic argumentation fallacies. We argue that in law the goal is to make practical decisions whereas in critical discussion the goal is frequently simply to increase or decrease degree of belief in a proposition. In the latter case, it is not necessarily important whether that degree of belief exceeds a particular threshold (e.g., ‘reasonable doubt’). We explore the consequences of this distinction for the role that the “burden of proof” has played in argumentation and in theories of fallacy.  相似文献

Traditionally, logicians construed fallacies as mistakes in inference, as things that looked like good (i.e., deductively valid) arguments but were not. Two fallacies stood out like a sore thumb on this view of fallacies: the fallacy of many questions (because it does not even look like a good argument, or any kind of argument) and the fallacy of petitio principii (because it looks like and is a good argument). The latter is the concern of this paper. One possible response is to say that the tradition is right about the concept of fallacy but wrong about its extension: petitio principii is not a fallacy. If the only proper ways to criticize an argument are to say that it is invalid or that it is unsound, and petitio principii is not criticisable on either of these counts, then calling it a fallacy is tantamount to saying we should prefer invalid or unsound arguments Robinson (Analysis, 31(4): 114 ,1971). I will present a third way to logically criticize arguments and show that fallacious instances of petitio principii are so criticisable while other instances of petitio principii are non-fallacious; hence, this fallacy is not a reductio of the Standard Treatment. It is not my intention in this paper to come out on the side of any of the competing theories—the Standard Treatment, the dialectical theories, and the epistemic theories—as general theories of fallacy. I show only that petitio principii can be handled by something closely resembling the Standard Treatment in so far as that, on entirely logistical principles, there can be made a distinction such that circular arguments form at best a degenerate kind of argument. Circular arguments look like good arguments but are not, not because they are deductively invalid (which they are not) but because they do not deserve to be called arguments at all.  相似文献

Criticisms of fallacy theory have been lodged from many different directions. In this paper, I consider the classic criticism of incompleteness by DeMorgan, Finocchiaro's claim that fallacies probably exist only in the mind of the interpreter, McPeck's claim that fallacies are at best context-dependent and Paul's complaints about the teaching of fallacies. I seek not merely to defend fallacy theory against unfair criticisms but also to learn from the criticisms what can be done in order to make fallacy theory a viable theory of criticism. I argue that this will involve several changes: rethinking of the nature of fallacy; addressing some theoretical issues; and presenting fallacy theory in a more rigorous fashion. The paper concludes with reflections on how Quine's ontological advice about the resolution of ontological disputes might be applied to the issue of whether or not there are fallacies.  相似文献

Most work on fallacies continues to conceptualize fallacious reasoning as involving a breach of a formal or quasi-formal rule. Chaim Perelman's theory of argumentation provides a way to conceptualize fallacies in a completely different way. His approach depends on an understanding of standards of rationality as essentially connected with conceptions of universality. Such an approach allows one to get beyond some of the basic problems of fallacy theory, and turns informal logic toward substantive philosophical questions. I show this by reinterpreting three so-called fallacies - theargumentum ad baculum, equivocation and composition/division - in the light of Perelman's account.  相似文献

The fallacies approach to argument evaluation can exacerbate problems it aims to address when it comes to social bias, perpetuating social injustice. A diagnosis that an argument commits a fallacy may flag the irrelevance of stereotypical characterizations to the line of reasoning without directly challenging the stereotypes. This becomes most apparent when personal bias is part of the subject matter under discussion, in ethotic argument, including ad hominem and ad verecundiam, which may be recognized as fallacious without addressing whether the ethotic presumptions are true. Yap (2013; 2015) makes this case for ad hominem and the pragma-dialectical understanding of fallacies, expanded here to show related patterns in some other fallacies, and employing the argument schemes understanding of fallacies. Adding critical questions increases the ways reasoners can dismiss arguments as fallacious, and could include directly addressing bias, but if an argument fails on a different critical question, that may yet allow the bias to pass. The fallacies approach is a form of meta-debate and techniques of meta-debate need to address the ubiquity of social bias, not convey them as specialized problems. The view that the fallacies approach to argument evaluation can provide neutrality is dangerously false. Arguers thus should avoid using fallacies for argument evaluation where social stereotypes or schemas might be involved, especially when the subject matter relates closely to social justice.

(AR-PFC) All sophistical refutations are exclusively either ‘apparent refutations’ or ‘proofs of false conclusions’. (AR-F) ‘Apparent refutations’ and ‘fallacies’ name the same thing. (ID-ED) All fallacies are exclusively either fallacies in dictione or fallacies extra dictionem. (ID-nAMB) Not all fallacies in dictione are due to ambiguity. (AMB-nID) Not all fallacies due to ambiguity are fallacies in dictione. (AMB&ID-ME) The set of fallacies due to ambiguity and fallacies in dictione together comprise the set of arguments said to be “dependent on mere expression”. Being “dependent on mere expression” and “dependent on language” are not the same (instances of the latter form a proper subset of instances of the former). (nME-FACT) All arguments that are not against the expression are “against the fact.” (FACT-ED) All fallacious arguments against the fact are fallacies extra dictionem (it is unclear whether the converse is true). (MAN-ARG) The solutions of fallacious arguments are exclusively either “against the man” or “against the argument.” (10) (F-ARG) Each (type of) fallacy has a unique solution (namely, the opposite of whatever causes the fallacy), but each fallacious argument does not. However, each fallacious argument does have a unique solution against the argument, called the ‘true solution’ (in other words, what fallacy a fallacious argument commits is determined by how it is solved. However, if the solution is ‘against the man’ then this is not, properly speaking, the fallacy committed in the argument. False dilemma is a specific form of reasoning: despite the fact that it is based on a deductively valid argument form, it is rightly depicted as fallacy. A systematic exposition of false dilemma is missing in theoretical approaches to fallacies. This article formulates six criteria for a well-grounded exposition of a fallacy, suggesting also a systematic exposition of false dilemma. These criteria can be used to both explain, and categorise, the various false dilemma fallacies. The article introduces distinction between four types of false dilemma (and the respective subtypes): (1) False quandary, (2) Defeasible sound quandary, (3) False obstruction and (4) Defeasible sound obstruction. The types of criticism appropriate for each variant of false dilemma are suggested. Being able to discover false dilemma in situations when it is important to make good and free choices is a significant dimension of critical thinking. It may liberate us from accepting the consequences that necessarily follow from prearranged alternatives, when these are not the only alternatives possible. It may also liberate us from refraining from actions on the basis of obstructive disjunctive statements. In that respect, the faculty of critical thinking directed at uncovering reasoning based on false dilemma may also initiate the discovery of new alternatives, or discover the ways of unifying seemingly opposing alternatives. Thus, a well-developed ability to understand the tricky argumentative moves of false dilemma may be a good step towards initiating some features of creative thinking.  相似文献

This paper discusses the fallacies of combination and division as they are presented by Aristotle in chapter 4 of his Sophistici Elenchi. Aristotle's examples are concise, their discussion is unclear, and it is difficult to distinguish the cases of combination from those of division. I analyse the Aristotelian examples and the interpretations offered so far. I show that these interpretations suffer from a major defect: they fail to identify a common characteristic whereby the Aristotelian examples can be classified as instances of combination or division. In my reconstruction of the examples, I repair this deficiency: I give a single pattern of explanation for the fallacy of combination and another (similar) pattern for the fallacy of division. Thus, it is possible to free Aristotle from the following charges: (i) he did not clearly distinguish between combination and division, and (ii) he reduced combination and division to a single fallacy. My explanation of the fallacies uses the notion of scope of an expression: in modern terminology, the fallacy of combination can be described as ‘fallacy of the wide scope’, the fallacy of division as ‘fallacy of the narrow scope’.  相似文献

In this paper I focus on the fallacy known as Complex Question or Many Questions. After a brief introduction, in Sect. 2 I highlight its pragmatic dimension, and in Sect. 3 its dialectical dimension. In Sect. 4 I present two accounts of this fallacy developed in argumentation theory, Douglas Walton’s and the Pragma-Dialectics’, which have resources to capture both its pragmatic and its dialectical nature. However, these accounts are unsatisfactory for various reasons. In Sect. 5 I focus on the pragmatic dimension of the fallacy and I suggest amendments to the accounts mentioned drawing on the study of the phenomenon of presupposition in theoretical pragmatics. I argue that the central notion in the definition of the fallacy is that of an informative presupposition. In Sect. 6 I focus on the dialectical dimension of the fallacy. This dimension needs to be explicitly acknowledged in the definition of the fallacy in order to distinguish it from a different, non-dialectical, fallacious argumentative move involving presuppositions.

The literature presents two major theories on the cause of the conjunction fallacy. The first attributes the conjunction fallacy to the representativeness heuristic. The second suggests that the conjunction fallacy is caused by people combining p(A) and p(B) into p(A&B) in an inappropriate manner. These two theories were contrasted in two category‐learning experiments. As predicted by the latter theory, data showed that participants that could assess p(A&B) directly made fewer conjunction fallacies than participants who had to compute p(A) and p(B) separately and then combine them into p(A&B). Least conjunction fallacies were observed in the cases where the representativeness heuristic was applicable. Overall, data showed that an inability to appropriately combine probabilities is one of the key cognitive mechanisms behind the conjunction fallacy. Copyright © 2008 John Wiley & Sons, Ltd.  相似文献
