Many who believe that human embryos have moral status are convinced that their use in human embryonic stem cell (hESC) research can be morally justified as long as they are discarded embryos left over from fertility treatments. This is one reason why this view about discarded embryos has played such a prominent role in the debate over publicly funding hESC research in the United States and other countries. Many believe that this view offers the best chance of a compromise between the different sides in this debate. This paper focuses on what seems to be the most plausible argument for this view about discarded embryos. It shows that this argument is unsound regardless of how one understands the claim that embryos have moral status. It also discusses the implications of this conclusion for attempts to use this argument as a basis for public policy.

Malebranche’s so-called conservation is continuous creation (CCC) argument has been celebrated as a powerful and persuasive argument for Occasionalism—the claim that only God has and exercises causal powers. In this paper I want to examine the CCC argument for Occasionalism by comparing it to Jaegwon Kim’s so-called Supervenience argument against non-reductive physicalism. Because the arguments have deep similarities it is interesting and fruitful to consider them in tandem. First I argue that both the CCC argument and the Supervenience argument turn on the same general principle, what Kim calls Edward’s Dictum. It is doubtful that Malebranche or Kim succeed in grounding Edward’s Dictum, though Malebranche, I think, has more resources at his disposal to make his case. Even if this worry is waived, however, I argue that the completion of Stage 1 of the Supervenience argument can be used to raise a further worry for the CCC argument that cannot easily be resolved.  相似文献

Assuming that one believes that individuals and states can morally defend values, beliefs, and institutions with force (in short, that just wars are morally possible), one logically wants just combatants to possess the physical, mental, and spiritual capacities that will enable them to win the war. On the other hand, being a just combatant in a just war does not morally entitle that combatant to do anything to win that war. The moral requirement for just combatants to fight justly is codified in international law of war and in state-specific legal documents such as the United States Uniform Code of Military Justice. While it is almost unequivocally clear to soldiers and civilians who soldiers cannot harm in the performance of their duties, and why these people are exempt from harm, it is less clear what the state itself (assuming throughout the discussion that the state is a just combatant in a just war) can morally do to its own soldiers to enhance their chances of victory: can the state do anything to soldiers to give them an advantage on the field of battle? For United States soldiers and their counterparts in most Western liberal democracies, the answer is obviously no. Deeply embedded social and cultural norms in Western democracies mandate that the state set and enforce rigid lines which drill sergeants and earnest commanders cannot cross, even in the name of combat readiness, grounding these norms in notion of basic rights appealed to in the U.S. Constitution. In this essay, I argue against some types of drug-induced internal biotechnical enhancement of soldiers on the grounds that, in the present state of technology, it is not reasonable to suppose that the military can perform such enhancement operations on soldiers without causing irrevocable psychological damage that would certainly and unjustifiably alienate the soldiers from the very society they serve.  相似文献

The modal scientific approach in consumer research is to deduce hypotheses from existing theory about relationships between theoretic constructs, test those relationships experimentally, and then show “process” evidence via moderation and mediation. This approach has its advantages, but other styles of research also have much to offer. We distinguish among alternative research styles in terms of their philosophical orientation (theory-driven vs. phenomenon-driven) and their intended contribution (understanding a substantive phenomenon vs. building or expanding theory). Our basic premise is that authors who deviate from the dominant paradigm are hindered by reviewers who apply an unvarying set of evaluative criteria. We discuss the merits of different styles of research and suggest appropriate evaluative criteria for each.  相似文献

In order to be a general theory of human cognition, the theory of mental models needs to accommodate a variety of forms of reasoning in addition to deduction. The mental model theory of induction is a crucial step in establishing generality. After suggesting that the theory of mental models can also account for abduction and analogy, the paper points out that inductive performance is likely to be constrained both by the nature of the representation used and by strategic factors. Since human cognition involves the communication of arguments, a final section explores the relationship between the theory of mental models and the notion of an argument. An attempt is made to integrate Thomas Szasz's 0974) theory of personal conduct and George Kelly's (1955) theory of personal constructs (PCT). It is argued that PCT provides an alternative to the void left behind by Szasz's negation of mental illness. Because PCT is concerned with psychological, rather than physiological, constructions of problems in living, it is not compatible with the biological model associated with Diagnostic and Statistical Manual of Mental Disorders (DSM) diagnostic categories. Rather, it is in keeping with the views of Szasz. Kelly's and Szasz's writings are used to support this view. Kelly's transitive diagnosis approach to “mental illness”, wherein diagnosis and therapy are construed as process oriented as opposed to category driven, is described as an alternative to the biological model. A contextualist approach (Sarbin & Mancuso, 1980) is also discussed. These approaches not only empower clients and allow them to assert responsibility and control over their lives, but also provide an alternative system to the one rejected by Szasz.  相似文献

We examine the proposition that, in ordinary conversation, people are concerned to argue — to justify their claims and to counter potential and actual counter claims. We test out the proposition by analysing explanations in one particular conversation. We attend to the validity claims of what the speakers say, and to the authority with which they say it. Viewed in that light, we find that the majority of what might look like causal attributions turn out to look like argumentative claim-backings. We then go on to flesh out the quasi-pragmatic rules which might help to decide formally whether any given utterance is be er understood as an argument or a causal explanation. These rules revolve around the speaker's apparent intention and the projected relationship between the clauses in what she or he says. All of this takes us a fair way from attribution theory's model of explanation as the reporting of a cause, and we end up with an argumentative model of ordinary explanation.  相似文献

How psychopaths and their capacity for moral action are viewed is not only philosophically interesting but is also important and relevant for policy. The philosophical discussion of psychopathy has focussed upon the psychological faculties that are prerequisites for moral responsibility and empirical findings regarding psychopathy that are relevant to philosophical accounts of moral understanding and motivation. However, there are legitimate worries about whether psychopathy is a robust scientific construct, and there are risks attached to reifying psychopathy or other psychiatric constructs. We defend the concept of psychopathy by pointing out the relevance of empirical studies about it for our ordinary practices of ascribing moral responsibility and folk psychological accounts of moral understanding and motivation.  相似文献
