abstract   We seem to have conflicting intuitions regarding luck and war, and we seem to be faced with a dilemma. Either, we deny that a war can be made just or unjust as a result of luck, and we accept that we should not appeal to the outcome when claiming that the war was or was not justified. Or, alternatively, we allow that it is legitimate to base our judgements on the outcome, but as a result we must accept that luck can make a war just or unjust. Traditionally, these have been taken to be the two forks of the dilemma, but, in this paper, I argue that they are not the only options. Rather, we can appeal to the outcome of our actions without claiming that this is, in anyway, an appeal to moral luck. Rather, the outcome provides us with evidence.  相似文献

In Liberalism's Religion, I analyse the specific conception of religion that liberalism relies upon. I argue that the concept of religion should be disaggregated into its normatively salient features. When deciding whether to avert undue impingements on religious observances, or to avoid any untoward support of such observances, liberal states should not deal with ‘religion’ as such but, rather, with relevant dimensions of religious phenomena. States should avoid religious entanglement when ‘religion’ is epistemically inaccessible, socially divisive and/or comprehensive in scope. In turn, states should show special deference to religious observances insofar as they exhibit what I call integrity – whether personal or collective. The upshot of this interpretive strategy is that liberal law need not recognise religion as such. As a result, there are gaps between the liberal construal of disaggregated religion and the lived experience of religion as a uniquely integrated experience. Are these gaps morally regrettable? In recent literature, there has been much debate about whether and how luck egalitarianism, given its focus on personal responsibility, can justify universal health care. In this paper we argue that, whether or not this is so, and in fact whether or not egalitarianism should be sensitive to responsibility at all, the question of personal responsibilization for health is not settled. This is the case because whether or not individuals are responsible for their own health condition is not all that is relevant when considering whether we should somehow hold them responsible for their own health condition, e.g. cost-wise. There may also be efficiency-based reasons to hold them responsible, and there may even be egalitarian reasons. Defining universal health care as an insurance system where everyone’s deductible and premium is 0, we will argue that efficiency-based reasons for cost-responsibilization are not convincing, but that there are egalitarian reasons for cost-responsibilization. Luck egalitarianism, therefore, cannot, at least not on its own term, justify universal health care.

In his paper, “Should the Numbers Count?" John Taurek imagines that we are in a position such that we can either save a group of five people, or we can save one individual, David. We cannot save David and the five. This is because they each require a life-saving drug. However, David needs all of the drug if he is to survive, while the other five need only a fifth each. Typically, people have argued as if there was a choice to be made: either numbers matter, in which case we should save the greater number, or numbers don't matter, but rather there is moral value in giving each person an equal chance of survival, and therefore we should toss a coin. My claim is that we do not have to make a choice in this way. Rather, numbers do matter, but it doesn't follow that we should always save the greater number. And likewise, there is moral value in giving each person an equal chance of survival, but it doesn't follow that we should always toss a coin. In addition, I argue that a similar approach can be applied to situations in which we can save one person or another, but the chances of success are different.  相似文献

This article addresses the issues of whether mentally ill defendants charged with serious crimes who refuse to plead a viable and counsel-recommended insanity defense for delusional reasons (but who are otherwise competent to stand trial) should be considered to be competent, or incompetent, to stand trial; whether such defendants should be allowed to represent themselves with a delusional defense; and whether an insanity defense may properly be imposed upon such defendants. Based on an analysis of relevant Supreme Court decisions and other relevant cases, it is concluded that such defendants should not be allowed to go forward with a delusional defense (at least until reasonable efforts to treat the defendants' delusions are made). It is also argued, however, that unless an insanity defense would be viable (as well as recommended by counsel) delusional defendants who are otherwise competent to stand trial should be permitted to go forward, and represent themselves, with the defense of their choosing.  相似文献

Many have attempted to justify various courts’ position that bare or naked statistical evidence is not sufficient for findings of liability. I provide a particular explanation by examining a different, but related, issue about when and why stereotyping is wrong. One natural explanation of wrongness of stereotyping appeals to agency. However, this has been scrutinised. In this paper, I argue that we should broaden our understanding of when and how our agency can be undermined. In particular, I argue that when we take seriously that our agency is exercised in the social world, we can see that stereotyping can and does undermine our agency by fixing the social meaning of our choices and actions as well as by reducing the quality and the kinds of choices that are available to us. Although this improves the agency-based explanation, it must be noted that undermining agency is not an overriding reason against stereotyping. Much depends on the balance of reasons that take into account moral stakes involved in a case of stereotyping. This results in a messier picture of when and why stereotyping is wrong, but I argue that this is a feature, not a bug. I end by applying this agency-based explanation to cases that have motivated the so-called Proof Paradoxes.  相似文献

Many pastors feel that their work in the secular sphere can best be described as an exploration of the meaning of life: as spiritual care. However, the idea that it is possible and easy to find such a thing as “the meaning of life,” as well as the concurrent idea that this meaning will help to make life more agreeable, should not be taken for granted but, rather, should be considered to be open for further exploration. To get a better understanding of the difference between spiritual care and the care of souls, I will discuss three central themes in any pastoral practice: sin, sense, and sorrow, together with three related constructs: soul, self, and the sacred. My exposition will result in a plea for revaluing two traditional but ever relevant modes of religious leadership: the modes of shepherd and teacher, of tutor and theologian, which are performed either in the context of the church or the secular institutional environment.  相似文献

Although dogs are almost totally incapable of symbolic behaviour, they can hope, for a dog's behaviour can manifest not only a desire for something but varying degrees of expectation that it will get what it desires; but since they are almost totally incapable of symbolic behaviour, nothing they do can indicate that they both desire something and yet are certain that they will not get it. So the suggestion that dogs entertain idle wishes is, apparently, vacuous, i.e. untestable, or nonsensical. Nonetheless, we can imagine situations in which we would be tempted to say of a dog that it had an idle wish, but since idle wishes so often and typically require language, we should be reluctant to impute it.  相似文献

This article reassesses Peter Abelard's account of moral intention,or, better, consent, in light of recent work on his own thought and on the twelfth-century background of that thought. The author argues (1) that Abelard's focus on consent as the determining factor for morality does not rule out, but, on the contrary, presupposes objective criteria for moral judgment and (2) that Abelard's real innovation does not lie in hisdoctrine of consent as the sole source of merit or guilt, but, rather, in his exploration of the ways in which this doctrine affects our understanding of the objective criteria for moral judgment. In particular, Abelard is led by his doctrine of consent to a thoroughgoing reassessment of the moral significance of the passions, which, in turn, leads him to reject the view that actions should be evaluated in terms of the praiseworthy or vicious character of the passions they express.  相似文献

Debates over the politicization of science have led some to claim that scientists have or should have a “right to research.” This article examines the political meaning and implications of the right to research with respect to different historical conceptions of rights. The more common “liberal” view sees rights as protections against social and political interference. The “republican” view, in contrast, conceives rights as claims to civic membership. Building on the republican view of rights, this article conceives the right to research as embedding science more firmly and explicitly within society, rather than sheltering science from society. From this perspective, all citizens should enjoy a general right to free inquiry, but this right to inquiry does not necessarily encompass all scientific research. Because rights are most reliably protected when embedded within democratic culture and institutions, claims for a right to research should be considered in light of how the research in question contributes to democracy. By putting both research and rights in a social context, this article shows that the claim for a right to research is best understood, not as a guarantee for public support of science, but as a way to initiate public deliberation and debate about which sorts of inquiry deserve public support.  相似文献

The overwhelming majority of those who theorize about implicit biases posit that these biases are caused by some sort of association. However, what exactly this claim amounts to is rarely specified. In this paper, I distinguish between different understandings of association, and I argue that the crucial senses of association for elucidating implicit bias are the cognitive structure and mental process senses. A hypothesis is subsequently derived: if associations really underpin implicit biases, then implicit biases should be modulated by counterconditioning or extinction but should not be modulated by rational argumentation or logical interventions. This hypothesis is false; implicit biases are not predicated on any associative structures or associative processes but instead arise because of unconscious propositionally structured beliefs. I conclude by discussing how the case study of implicit bias illuminates problems with popular dual‐process models of cognitive architecture.  相似文献

This paper examines the problem of selecting a number of candidates to receive a good (admission) from a pool in which there are more qualified applicants than places. I observe that it is rarely possible to order all candidates according to some relevant criterion, such as academic merit, since these standards are inevitably somewhat vague. This means that we are often faced with the task of making selections between near-enough equal candidates. I survey one particular line of response, which says that we should allow our choice of borderline candidates to be guided by non-relevant criteria such as gender-balancing. I argue that this would not, as commonly objected, be a case of sex discrimination if it is to be applied either in favour of men or women. Nonetheless, I argue that such policies are problematic because they violate the demand for publicity, which is required for legitimacy and to assure everyone that discrimination has not in fact taken place. Instead, I suggest that, if we are concerned to avoid discrimination, there may be a case for using lotteries as tie-breakers, not on grounds of fairness but to prevent taint of bias.  相似文献

I argue that free will and determinism are compatible, even when we take free will to require the ability to do otherwise and even when we interpret that ability modally, as the possibility of doing otherwise, and not just conditionally or dispositionally. My argument draws on a distinction between physical and agential possibility. Although in a deterministic world only one future sequence of events is physically possible for each state of the world, the more coarsely defined state of an agent and his or her environment can be consistent with more than one such sequence, and thus different actions can be “agentially possible”. The agential perspective is supported by our best theories of human behaviour, and so we should take it at face value when we refer to what an agent can and cannot do. On the picture I defend, free will is not a physical phenomenon, but a higher‐level one on a par with other higher‐level phenomena such as agency and intentionality.  相似文献

Frequently, the just war principle of noncombatant immunity is interpreted as morally prohibiting the intentional targeting of noncombatants. Apparently, many just war theorists assume that to target means to (intend to) kill. Now that effective nonlethal weapons have been envisaged, it should be evident that there is no conceptual connection between intentionally targeting and intentionally killing. For, using nonlethal weapons, there could be intentional targeting without intentional killing. This paper explores the question of whether the noncombatant immunity principle should be revised, so as to allow uses of nonlethal weapons. Preliminary to answering this question, some other questions are explored, among which are the following. Why should a noncombatant immunity principle be accepted? Why is it morally permissible to intentionally target enemy combatants? Are noncombatants grievously harmed when they are incapacitated by nonlethal weapons? Is it morally permissible to intentionally incapacitate enemy combatants with nonlethal weapons, while knowingly but not intentionally incapacitating noncombatants? In order to focus on moral questions involving nonlethal weapons, questions about their effectiveness or legality are set aside. Instead of the idea of noncombatant immunity as expressed above, a delimited principle of noncombatant immunity is proposed—namely, that, in the conduct of war, the intentional grave injuring or killing of noncombatants is morally prohibited. Also proposed is a principle of noncombatant targeting, which would allow some uses of nonlethal weapons to intentionally incapacitate noncombatants.  相似文献

There is recent evidence that children naturally divide syllables into the opening consonant or consonant cluster (the onset) and the rest of the syllable (the rime). This suggests an explanation for the fact that preschool children are sensitive to rhyme, but often find tasks in which they have to isolate single phonemes extremely difficult. Words which rhyme share a common rime and thus can be categorized on that speech unit. Single phonemes on the other hand may only be part of one of these speech units. This analysis leads to some clear predictions. Young children, even children not yet able to read, should manage to categorize words on the basis of a single phoneme when the phoneme coincides with the word's onset ("cat," "cup") but not when it is only part of the rime ("cat," "pit"). They should find it easier to work out that two monosyllabic words have a common vowel which is not shared by another word when all three words end with the same consonant ("lip," "hop," "tip") but the odd word has a different rime than when the three words all start with the same consonant ("cap," "can," "cot") and thus all share the same onset. The hypothesis also suggests that children should be aware of single phonemes when these coincide with the onset before they learn to read. We tested these predictions in two studies of children aged 5, 6, and 7 years. The results clearly support these predictions.  相似文献

Abstract: A common view is that relativism requires tolerance. We argue that there is no deductive relation between relativism and tolerance, but also that relativism is not incompatible with tolerance. Next we note that there is no standard inductive relation between relativism and tolerance—no inductive enumeration, argument to the best explanation, or causal argument links the two. Two inductive arguments of a different sort that link them are then exposed and criticized at length. The first considers relativism from the objective point of view ‘of the universe’, the second from the subjective point of view of the relativist herself. Both arguments fail. There is similarly no deductive relation between absolutism and tolerance—neither entails the other—and no inductive connection of any sort links the two. We conclude that tolerance, whether unlimited or restricted, is independent of both relativism and absolutism. A metaethical theory that says only that there is one true or valid ethical code, or that there is a plurality of equally true or valid ethical codes, tells us nothing about whether we should be tolerant, much less how tolerant we should be.  相似文献

In the field of character education role-modelling is advocated as an important pedagogical strategy. It is supposed that students learn from ‘significant others’ who exemplify important virtues and values. However, in these strategies it is not clear what and how students precisely can and should learn from exemplars and how the following of exemplars relates to the educational aim of ‘becoming a self.’ In this article, it is argued that modelling is only a relevant pedagogical strategy if moral exemplars are somehow related to life in its full extent, including its moral complexities and ambiguities. Understanding moral exemplarity demands not only the reappropriation of an Aristotelian conception of emulation but also an understanding of the typical modern relocation of moral exemplarity in the fullness of life, importantly originating from what Charles Taylor calls the Protestant ‘affirmation of ordinary life.’ In addition, a distinction is introduced between ‘role exemplarity’ and ‘existential exemplarity.’ Based on this distinction it is argued that emulation should not be limited to learning from role models, but should also include something that runs deeper, to the depth of our own subjectivity or self.  相似文献

The present research tested relations between extraversion and emergent leadership among men in situations that differed in potential reward availability. Four-person groups of men engaged in a Leaderless Group Discussion (LGD) task and were randomly assigned to be evaluated by an attractive female observer, an attractive male observer, or not be evaluated. Evolutionary theories suggest that impressing a female evaluator in an intrasexually competitive situation should hold greater reward potential for men than impressing either a male evaluator or no evaluator. Accordingly, more extraverted men (who are more sensitive to reward cues) should display more group leadership when being evaluated by a woman than either a man or no one. Self-and peer ratings confirmed that more extraverted men were significantly more likely to emerge as leaders, but only in the female-evaluator condition. The results are discussed in terms of the interplay between personality, situational factors, and evolutionary principles.  相似文献

Nineteenth- and twentieth-century North Atlantic theology has seen a succession of Trinitarian revivals. Some observers take as an index of a theologian's success whether he or she has much interesting to say about the Holy Spirit, and some, including Robert Jenson, have also noted a tendency to announce the Spirit and talk about the Son. While Rogers shares that concern, he qualifies the characterization to note that authors in three traditions sometimes admit the charge and demur, claiming that is how it should be, citing passages in Calvin, Rahner, and Pavel Florensky. Of these the boldest is Florensky, who anticipates Jenson's critique but, writing in 1913, makes it not of Barth but of Eastern Orthodox theology (usually seen as a model to follow here), even in its liturgy.
